{"id":19430,"date":"2025-06-27T15:48:07","date_gmt":"2025-06-27T15:48:07","guid":{"rendered":"https:\/\/www.europesays.com\/us\/19430\/"},"modified":"2025-06-27T15:48:07","modified_gmt":"2025-06-27T15:48:07","slug":"supreme-court-preserves-key-part-of-obamacare-coverage-requirements-nbc-los-angeles","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/19430\/","title":{"rendered":"Supreme Court preserves key part of Obamacare coverage requirements \u2013 NBC Los Angeles"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.nbclosangeles.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">U.S. Supreme Court<\/a> ruled to protect a key provision of the Affordable Care Act that requires health insurers to cover preventive care such as cancer screenings at no cost to patients.<\/p>\n<p>The 6-3 ruling stemmed from a lawsuit filed by a group of Christian-owned businesses alleging the U.S. Preventive Services Task Force, which chooses what services will be covered, is composed of members who were not validly appointed. Its 16 members are appointed by the U.S. Secretary of Health and Human Services without Senate confirmation.<\/p>\n<p>The plaintiffs said the process is unconstitutional because a volunteer board of medical experts tasked with recommending which services are covered is not Senate-approved.<\/p>\n<p><a href=\"https:\/\/www.nbclosangeles.com\/tag\/trump-administration\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">President Donald Trump&#8217;s administration<\/a> defended the mandate before the court, though the Republican president has been a critic of his Democratic predecessor&#8217;s law. The Justice Department said board members don\u2019t need Senate approval because they can be removed by the health and human services secretary.<\/p>\n<p>Medications and services that could have been affected include statins to lower cholesterol, lung cancer screenings, HIV-prevention drugs and medication to lower the chance of breast cancer for women.<\/p>\n<p>The case came before the Supreme Court after an appeals court\u00a0<a href=\"https:\/\/apnews.com\/article\/preventative-health-care-obama-appeals-court-cf339b95c1d285e7844225b8021d7e54\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">struck down some preventive care<\/a>\u00a0coverage requirements. The U.S. 5th Circuit Court of Appeals sided with the Christian employers and Texas residents\u00a0<a href=\"https:\/\/apnews.com\/article\/preventative-health-care-obama-appeals-court-bc55f54ce578a20a59c517b834148a45\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">who argued<\/a>\u00a0they can\u2019t be forced to provide full\u00a0<a href=\"https:\/\/apnews.com\/article\/obamacare-insurance-preventative-care-texas-aa57fa6fd782e2170bc80210fd00065b\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">insurance coverage<\/a>\u00a0for things like medication to prevent HIV and some cancer screenings.<\/p>\n<p>Well-known conservative attorney Jonathan Mitchell, who represented Trump before the high court in a dispute about whether he could appear on\u00a0<a href=\"https:\/\/apnews.com\/article\/supreme-court-trump-insurrection-election-colorado-51e79c0f03013034c8a042cb278b6446\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">the 2024 ballot<\/a>, argued the case.<\/p>\n<p>The appeals court found that coverage requirements were unconstitutional because they came from a body \u2014 the United States Preventive Services Task Force \u2014 whose members were not nominated by the president and confirmed by the Senate.<\/p>\n<p>A 2023 analysis prepared by the nonprofit KFF found that ruling would still allow full-coverage requirements for some services, including mammography and cervical cancer screening.<\/p>\n<p><strong>This is a breaking news story.
