{"id":19510,"date":"2025-06-27T16:33:11","date_gmt":"2025-06-27T16:33:11","guid":{"rendered":"https:\/\/www.europesays.com\/us\/19510\/"},"modified":"2025-06-27T16:33:11","modified_gmt":"2025-06-27T16:33:11","slug":"supreme-court-oks-fee-subsidizing-phone-and-internet-services","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/19510\/","title":{"rendered":"Supreme Court OKs fee subsidizing phone and internet services"},"content":{"rendered":"<p>    <a class=\"AnchorLink\" id=\"html-embed-module-650000\"\/><\/p>\n<p>  AP Mobile App CTA<\/p>\n<p>  <img decoding=\"async\" class=\"logo\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/06\/icon-2-copy.png\" alt=\"AP Logo\"\/><\/p>\n<p>Get the AP News App<\/p>\n<p>  <a id=\"store-link\" href=\"#\" target=\"_blank\"><br \/>\n    <img decoding=\"async\" id=\"store-badge\" class=\"badge\" src=\"#\" alt=\"Download App\"\/><br \/>\n  <\/a><\/p>\n<p>WASHINGTON (AP) \u2014 <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/us-supreme-court\" target=\"_blank\" rel=\"noopener\">The Supreme Court<\/a> on Friday upheld the fee that is added to phone bills to provide billions of dollars a year in <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/wifi-broadband-rosenworcel-322f16a1c7f510df4e45f02d1e7c09da\" target=\"_blank\" rel=\"noopener\">subsidized phone and internet services<\/a> in schools, libraries and rural areas. <\/p>\n<p>The justices, by <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.documentcloud.org\/documents\/25985305-fcc-v-consumers-research\/\" target=\"_blank\" rel=\"noopener\">a 6-3 vote<\/a>, reversed an appeals court ruling that had struck down as unconstitutional the Universal Service Fund, the charge that has been added to phone bills for nearly 30 years.<\/p>\n<p>At arguments in March, liberal and conservative justices alike expressed concerns about the potentially devastating consequences of eliminating the fund, which has benefited tens of millions of Americans.<\/p>\n<p><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/federal-communications-commission\" target=\"_blank\" rel=\"noopener\">The Federal Communications Commission<\/a> collects the money from telecommunications providers, which pass the cost on to their customers.<\/p>\n<p>A Virginia-based conservative advocacy group, Consumers\u2019 Research, had challenged the practice. The justices had previously denied two appeals from Consumers\u2019 Research after federal appeals courts upheld the program. But the full 5th U.S. Circuit Court of Appeals, among the nation\u2019s most conservative, ruled 9-7 that the method of funding is unconstitutional.<\/p>\n<p>The 5th Circuit held that Congress had given too much authority to the FCC and the agency in turn had ceded too much power to a private entity, or administrator.<\/p>\n<p>The last time the Supreme Court invoked what is known as the nondelegation doctrine to strike down a federal law was in 1935. But several conservative justices have suggested they are open to breathing new life into the legal doctrine.<\/p>\n<p>The conservative-led court also has reined in federal agencies in high-profile rulings in recent years. Last year, the court <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-chevron-regulations-environment-5173bc83d3961a7aaabe415ceaf8d665\" target=\"_blank\" rel=\"noopener\">reversed a 40-year-old case<\/a> that had been used thousands of times to uphold federal regulations. In 2022, the court ruled Congress has to act with specificity before agencies can address <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/climate-us-supreme-court-pollution-air-clean-act-0996737f311647a8576640d3d2fdf58a\" target=\"_blank\" rel=\"noopener\">\u201cmajor questions,\u201d<\/a> in a ruling that limited the Environmental Protection Agency\u2019s ability to combat climate change.<\/p>\n<p>But the phone fee case turned out not to be the right one for finding yet another way to restrict federal regulators.<\/p>\n<p>President Donald Trump\u2019s Republican administration, which has moved aggressively to curtail administrative agencies in other areas, defended the FCC program.
