Trump\u2019s critics note that the last president to raise tariffs under similar circumstances was Richard Nixon, and Congress later pared back the president\u2019s power.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4rzvcm00043b6n3je4njgm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cTo the president and his most senior advisors, these tariffs thus present a\u202fstark choice:\u202fWith tariffs, we\u202fare a rich\u202fnation; without tariffs, we are a\u202fpoor nation,\u201d according to the appeal.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4rvqb200003b6nif3pibw1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The appeal follows a divided decision Friday from a federal appeals court in Washington that found Trump overstepped his authority by relying on the International Emergency Economic Powers Act to impose the tariffs. The authority to impose taxes, including tariffs, is \u201ca core congressional power\u201d that the Constitution left to the legislative branch, the appeals court ruled.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4skqop00003b5yf62nrrpw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump has relied on the 1970s-era emergency law, known as IEEPA, to reshape not just global trade, but also alliances with allies and adversaries. If some of the powers he\u2019s claimed to set those tariffs are permanently blocked, the administration would need to find other levers to accomplish its ambitious foreign policy goals.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch00053b5yai8xpghz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the center of the case are the \u201cLiberation Day\u201d tariffs Trump announced in April and tariffs placed this year against China, Mexico and Canada that were designed to combat fentanyl entering the United States. A wine importer, VOS Selections, and other small businesses sued, along with a dozen states, arguing Trump had exceeded his authority.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch00063b5y30up45jy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cBoth federal courts that considered the issue agreed that IEEPA does not give the president unchecked tariff authority,\u201d said Jeffrey Schwab, senior counsel and director of litigation for Liberty Justice Center, which is representing the plaintiffs in the case. \u201cThese unlawful tariffs are inflicting serious harm on small businesses and jeopardizing their survival. We hope for a prompt resolution of this case for our clients.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch00073b5y9f8bh6te@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Trump administration has requested an unusually speedy review by the Supreme Court, asking that the justices decide whether to hear the case by September 10 and tee up arguments for early November. The plaintiffs in the case have agreed to that rapid timeline.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch00083b5yegm1xi5h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A federal court in New York agreed in late May and sided with the companies and states. The US Court of Appeals for the Federal Circuit upheld that decision. However, the appeals court let the tariffs stand temporarily while the litigation continues.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch00093b5y4a25irap@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The lower court\u2019s decision, the Trump administration argued to the Supreme Court, \u201cwould, in the president\u2019s view, unilaterally disarm the United States and allow other nations to hold America\u2019s economy hostage to their retaliatory trade policies.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000a3b5ya9p9vtsh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While the bulk of the tariffs Trump imposed during his second term, which cited emergency economic powers, could ultimately be rendered illegal, the president has plenty of other levers he can pull to continue pushing his tariff-heavy agenda.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000b3b5ybioc60tg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That\u2019s because Trump hasn\u2019t just been using IEEPA to levy tariffs. All the sectoral tariffs Trump has imposed during his second term, most recently a 50% tariff on derivatives of steel and aluminum, such as spray deodorants and baby strollers, have used Section 232 of the Trade Expansion Act of 1962.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000c3b5ymd0uxwu7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Section 232 authority gives the president the authority to impose higher tariffs on national security grounds. But it can only be used to target specific sectors and requires an investigation to be launched before tariffs can be imposed.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000d3b5yyxcx2qk2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Similarly, there are several other methods Trump can use to impose tariffs that aren\u2019t currently facing legal challenges. However, they too have catches that could make it harder for him to dangle and then withdraw duties quickly, as he has repeatedly done since retaking power in January.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000e3b5yuo435n75@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The ongoing case is not the first to reach the Supreme Court dealing with Trump\u2019s emergency tariffs. Two American family-owned <a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.cnn.com%2F2025%2F06%2F17%2Fpolitics%2Famerican-toy-companies-bring-trumps-trade-war-to-the-supreme-court&amp;data=05%7C02%7Cclay.voytek%40cnn.com%7Cecab45c96c194ebc61b308ddeb5b0ec0%7C0eb48825e8714459bc72d0ecd68f1f39%7C0%7C0%7C638925498516843620%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=N4BKlpHDoXBZs8Evv3fQ8gyNaPEqLTvefCMz0vFOzwU%3D&amp;reserved=0\" target=\"_blank\" rel=\"nofollow noopener\">toy companies filed a similar appeal<\/a> in June. The court is scheduled to meet behind closed doors later this month to consider whether to hear arguments in that case.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000f3b5ys6dl6qpe@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The legal fight over the tariffs is likely to implicate a theory that conservative groups repeatedly used successfully at the Supreme Court in recent years to block former President Joe Biden\u2019s agenda, including his <a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.cnn.com%2F2023%2F06%2F30%2Fpolitics%2Fsupreme-court-student-loan-forgiveness-biden&amp;data=05%7C02%7Cclay.voytek%40cnn.com%7Cecab45c96c194ebc61b308ddeb5b0ec0%7C0eb48825e8714459bc72d0ecd68f1f39%7C0%7C0%7C638925498516862787%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=wqc7C2W3%2BmiNyTtYcHmM3u4NUSRCX%2BFjCzhbALU41no%3D&amp;reserved=0\" target=\"_blank\" rel=\"nofollow noopener\">effort to forgive student loans<\/a>. The court repeatedly relied on the \u201cmajor questions doctrine\u201d to trim the power of the White House and federal agencies to act without congressional approval.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000g3b5ygh1d6xis@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The federal law at issue allows a president to \u201cregulate \u2026 importation\u201d during emergencies, but the statute does not specifically address tariffs.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000h3b5yc5yainxh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The law \u201cbestows significant authority on the president to undertake a number of actions in response to a declared national emergency,\u201d the appeals court wrote in its decision. \u201cBut none of these actions explicitly include the power to impose tariffs, duties, or the like, or the power to tax.\u201d\n    <\/p>\n<p>        Trade agreements and tariff revenue at stake<\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000j3b5ypq8kuyqd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Record levels of tariff revenue have been flowing into the US Treasury Department\u2019s general account since Trump ramped up in the spring. Over the course of the 2025 fiscal year, more than $210 billion in tariff revenue stemmed from the IEEPA-related tariffs, according to data from US Customs and Border Protection.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000k3b5ynmsdmu8w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            If the Supreme Court doesn\u2019t hear the Trump administration\u2019s appeal or sides with the lower courts, American importers could be <a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.cnn.com%2F2025%2F09%2F03%2Feconomy%2Ftrump-tariff-refund&amp;data=05%7C02%7Cclay.voytek%40cnn.com%7Cecab45c96c194ebc61b308ddeb5b0ec0%7C0eb48825e8714459bc72d0ecd68f1f39%7C0%7C0%7C638925498516876577%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=rgqotcdx9kPafqMYzzv4tf%2BcaSUTRMJmn9IOGAcwHeI%3D&amp;reserved=0\" target=\"_blank\" rel=\"nofollow noopener\">due refunds.<\/a>\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000l3b5yn4von4y1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump acknowledged that potential consequence earlier this week, as well as the impact the case outcome could have on a handful of recent trade agreements that are still being worked out.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000m3b5yjr21z3th@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cNumerous of the trade deals that I made were because of tariffs. It gives you a great negotiating ability,\u201d Trump said Tuesday.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmf4sl0ch000n3b5ytiaom3fe@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But those agreements could quickly fall apart because Trump has cited IEEPA in imposing tariffs on other trading partners\u2019 goods.
