{"id":200448,"date":"2025-09-04T20:33:13","date_gmt":"2025-09-04T20:33:13","guid":{"rendered":"https:\/\/www.europesays.com\/us\/200448\/"},"modified":"2025-09-04T20:33:13","modified_gmt":"2025-09-04T20:33:13","slug":"man-arrested-for-clapping-at-tarrant-county-commissioners-court-gets-case-dismissed","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/200448\/","title":{"rendered":"Man arrested for clapping at Tarrant County Commissioners Court gets case dismissed"},"content":{"rendered":"<p>The criminal case against a man arrested for clapping at a Tarrant County Commissioners Court meeting has been dropped.<\/p>\n<p>Charles Hermes <a href=\"https:\/\/www.keranews.org\/government\/2025-01-28\/more-arrests-made-at-tarrant-county-commissioners-court-during-discussions-about-courtroom-behavior\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">was arrested on Jan. 28<\/a> when he clapped for a speaker, after County Judge Tim O\u2019Hare warned him not to clap. He fell to the floor as sheriff\u2019s deputies moved in on him, and they carried him out by his wrists and ankles.<\/p>\n<p>Hermes was charged with hindering proceedings by disorderly conduct, a high-level misdemeanor that can be punished with up to a year in jail and a $4,000 fine. The case was dismissed in July, but Hermes\u2019 attorney, <a href=\"https:\/\/www.pantheon-legal.com\/mark-streiff\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">Mark Streiff<\/a>, said in an interview Thursday he&#8217;s still concerned about free speech at county meetings.<\/p>\n<p>\u201cTim O&#8217;Hare and some of the commissioners, they don&#8217;t like being called out for what they&#8217;re doing by their constituents,\u201d he said.<\/p>\n<p>    <img decoding=\"async\" class=\"Image\" alt=\"A screenshot of a court document laying out the criminal charges against Charles Hermes for clapping during a government meeting.\"  width=\"880\" height=\"514\" loading=\"lazy\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/09\/1757017992_198_\"\/><\/p>\n<p>     The criminal complaint against Charles Hermes lays out his charge for clapping at a Tarrant County Commissioners Court meeting, after being told not to clap.<\/p>\n<p>The court was debating <a href=\"https:\/\/www.keranews.org\/government\/2025-01-27\/tarrant-county-commissioners-court-new-rules\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">new rules of decorum<\/a> at the Jan. 28 meeting where Hermes was arrested. The new rules came after meetings full of <a href=\"https:\/\/www.keranews.org\/government\/2024-07-15\/tarrant-county-residents-push-back-against-bans-from-commissioners-court-meetings\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">expulsions<\/a> and <a href=\"https:\/\/www.keranews.org\/news\/2025-01-14\/two-people-sent-to-jail-at-contentious-tarrant-county-commissioners-court-meeting\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">arrests<\/a>. O\u2019Hare \u2014 who is in charge of enforcing commissioners court rules \u2014 has said he\u2019s trying to run fair, civil meetings.<\/p>\n<p>Prosecutors agreed to drop Hermes&#8217; case in exchange for Hermes taking an online class about impulse control and making a charitable donation, Streiff said.<\/p>\n<p>&#8220;It&#8217;s what we call a conditional dismissal,\u201d he said. \u201cIt&#8217;s when the state is of the opinion it doesn&#8217;t really need to go to trial. It&#8217;s not, like, such a heinous case that there needs to be a strong prosecution of it.\u201d<\/p>\n<p>KERA News reached out to Hermes and the Tarrant County District Attorney\u2019s Office for comment and will update the story if they respond.<\/p>\n<p>Carolyn \u201cCarolina\u201d Rodriguez, a local YouTuber who films interactions with police, was also arrested at the Jan. 28 meeting, after she cussed and shouted.<\/p>\n<p>    <img decoding=\"async\" class=\"Image\" alt=\"A photo of a woman dressed in black, being surrounded by four sheriff's deputies in blue or black uniforms. Two people film the altercation on their phones.\"  width=\"880\" height=\"459\" loading=\"lazy\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/09\/1757017993_544_\"\/><\/p>\n<p>    Carolyn &#8220;Carolina&#8221; Rodriguez was arrested outside the Tarrant County Commissioners Court meeting room in downtown Fort Worth on Jan. 28, 2025. She was kicked out of the meeting after swearing during her public comment time.<\/p>\n<p>Her case went to trial, where Tarrant County prosecutor Lloyd Whelchel argued the commissioners court is allowed to enforce rules of decorum, and that Rodriguez is a sensationalist who wants views. Streiff \u2013 who also represented Rodriguez \u2013 said his client was being penalized for cussing, a free speech issue.<\/p>\n<p>Judge Brian Bolton ruled Rodriguez&#8217;s case didn&#8217;t involve free speech. The jury convicted her <a href=\"https:\/\/www.keranews.org\/criminal-justice\/2025-06-17\/tarrant-county-commissioners-court-carolina-rodriguez-sentence\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">and sentenced her to probation<\/a>.<\/p>\n<p>CJ Grisham, an attorney and Second Amendment activist, was also thrown out of the January 28 meeting for cussing, but he was not arrested. He <a href=\"https:\/\/www.star-telegram.com\/news\/politics-government\/article310222715.html\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">filed a lawsuit against county officials<\/a> for that expulsion and another one on Jan. 14.<\/p>\n<p>Hermes has been arrested twice for disruptions at Tarrant County Commissioners Court meetings. He was also <a href=\"https:\/\/fortworthreport.org\/2024\/05\/03\/uta-instructor-arrested-as-students-protest-war-in-gaza-demand-university-divestment\/\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">arrested at a pro-Palestine protest<\/a> at the University of Texas at Arlington, where he taught for years. UTA placed him on administrative leave in March, citing student complaints, but Hermes refuted that, sharing a positive employee review <a href=\"https:\/\/www.keranews.org\/education\/2025-03-12\/uta-places-faculty-member-known-for-activism-arrests-on-leave-he-wonders-why\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">with the Fort Worth Report.<\/a><\/p>\n<p>Got a tip?
