{"id":208703,"date":"2025-09-07T22:41:14","date_gmt":"2025-09-07T22:41:14","guid":{"rendered":"https:\/\/www.europesays.com\/us\/208703\/"},"modified":"2025-09-07T22:41:14","modified_gmt":"2025-09-07T22:41:14","slug":"trump-tariffs-treasury-secretary-bessent-supreme-court","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/208703\/","title":{"rendered":"Trump tariffs Treasury Secretary Bessent Supreme Court"},"content":{"rendered":"<p>US Secretary of the Treasury Scott Bessent speaks as US President Donald Trump signs executive orders in the Oval Office of the White House in Washington, DC on September 5, 2025. <\/p>\n<p>Mandel Ngan | Afp | Getty Images<\/p>\n<p>Treasury Secretary <a href=\"https:\/\/www.cnbc.com\/2025\/09\/05\/treasury-secretary-bessent-calls-for-big-changes-at-fed.html\" target=\"_blank\" rel=\"noopener\">Scott Bessent<\/a> said Sunday that he is &#8220;confident&#8221; that President <a href=\"https:\/\/www.cnbc.com\/donald-trump\/\" target=\"_blank\" rel=\"noopener\">Donald Trump&#8217;s<\/a> tariff plan &#8220;will win&#8221; at the Supreme Court, but warned his agency would be forced to issue massive refunds if the high court rules against it.<\/p>\n<p>If the tariffs are struck down, he said, &#8220;we would have to give a refund on about half the tariffs, which would be terrible for the Treasury,&#8221; according to an interview on NBC&#8217;s &#8220;Meet the Press.&#8221;<\/p>\n<p>He added, however, that &#8220;if the court says it, we&#8217;d have to do it.&#8221;<\/p>\n<p>The Trump administration last week asked the\u00a0<a href=\"https:\/\/www.cnbc.com\/supreme-court-us\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a>\u00a0for an &#8220;expedited ruling&#8221; to overturn an appeals court decision that found\u00a0<a href=\"https:\/\/www.cnbc.com\/2025\/08\/29\/trump-trade-tariffs-appeals-court-ieepa.html\" target=\"_blank\" rel=\"noopener\">most of his tariffs on imports from other countries are illegal<\/a>.<\/p>\n<p>Generally, the Supreme Court could take as long as early next summer to issue a decision on the legality of Trump&#8217;s tariffs.<\/p>\n<p>Bessent has said that &#8220;delaying a ruling until June 2026 could result in a scenario in which $750 billion-$1 trillion in tariffs have already been collected, and unwinding them could cause significant disruption.&#8221;<\/p>\n<p>The prospect of the government having to refund tariffs of that magnitude could mean an unprecedented windfall to the businesses and entities that paid them.<\/p>\n<p>Read more CNBC politics coverage<\/p>\n<p>Bessent&#8217;s comments come as Trump&#8217;s tariffs face an uncertain future after a federal appeals court ruled last month that most of his &#8220;reciprocal tariffs&#8221; are illegal.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.cafc.uscourts.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Court of Appeals for the Federal Circuit<\/a>\u00a0ruled last month that Trump overstepped his presidential authority when he introduced &#8220;reciprocal tariffs&#8221; on almost every country as part of his &#8220;liberation day&#8221; announcement.<\/p>\n<p>The appeals court paused its ruling from taking effect until Oct. 14, giving the Trump administration time to appeal the ruling to the Supreme Court. <\/p>\n<p>Trump has requested that the Supreme Court hear arguments on his appeal in early November and issue a final decision on the legality of the disputed tariffs soon thereafter, according to filings obtained by NBC News from the plaintiffs in the case.<\/p>\n<p>Before court action, Trump&#8217;s tariffs were set to affect nearly 70% of U.S. goods imports,\u00a0<a href=\"https:\/\/taxfoundation.org\/research\/all\/federal\/trump-tariffs-trade-war\/\" target=\"_blank\" rel=\"noopener\">according to the Tax Foundation<\/a>. If struck down, the duties would impact just roughly 16%.<\/p>\n<p>However, while Bessent and others have expressed confidence that the Supreme Court will rule in its favor, the administration is working on backup plans in case it does not.<\/p>\n<p>National Economic Council Director <a href=\"https:\/\/www.cnbc.com\/2025\/09\/05\/jobs-hassett-trump-rates.html\" target=\"_blank\" rel=\"noopener\">Kevin Hassett<\/a> said Sunday that there are &#8220;other legal authorities&#8221; that the administration could take if Trump&#8217;s tariffs are blocked.<\/p>\n<p>&#8220;There are other things that could happen should it go that way,&#8221; Hassett said on <a href=\"https:\/\/www.cbsnews.com\/news\/kevin-hassett-national-economic-council-director-face-the-nation-transcript-09-07-2025\/\" target=\"_blank\" rel=\"noopener\">CBS News&#8217; &#8220;Face the Nation<\/a>&#8221; if the tariffs are overturned. Some of those efforts could include implementing tariffs <a href=\"https:\/\/www.nbcnews.com\/politics\/trump-administration\/white-house-exploring-keep-trumps-tariffs-supreme-court-strikes-rcna229175\" target=\"_blank\" rel=\"noopener\">through Section 232, or sector-specific levies<\/a>.<\/p>\n<p>Section 232 of the Trade Expansion Act of 1962 allows the president to implement levies\u00a0&#8220;so that such imports will not so threaten to impair the national security,&#8221; following an investigation into trade practices, <a href=\"https:\/\/www.nbcnews.com\/politics\/trump-administration\/white-house-exploring-keep-trumps-tariffs-supreme-court-strikes-rcna229175\" target=\"_blank\" rel=\"noopener\">NBC News reports.<\/a><\/p>\n<p>For example, the Trump administration in August expanded its 50%\u00a0<a href=\"https:\/\/www.cnbc.com\/2025\/06\/04\/trumps-50percent-steel-tariffs-hit-the-world-but-uk-spared-full-blow.html\" target=\"_blank\" rel=\"noopener\">steel and aluminum tariffs<\/a>\u00a0to include more than 400 additional product categories, according to the Department of Commerce. Trump has also threatened to impose steep tariffs on semiconductors and pharmaceuticals.<\/p>\n<p>Other levies that would not be affected by Trump&#8217;s court battle are those on low-cost items.
