Rosado came as part of a broader legal war between the City Council and Adams over Executive Order 50 to<a href=\"https:\/\/nypost.com\/2025\/02\/13\/us-news\/eric-adams-vows-to-reopen-ice-office-at-rikers-island\/\" rel=\"nofollow noopener\" target=\"_blank\"> reestablish a federal immigration presence at the troubled jail complex.<\/a><\/p>\n<p>Adams plainly failed to bind himself by the city charter to avoid conflicts of interest and not to use his office to benefit himself, Rosado said, citing the tossing of his federal criminal prosecution in April and his on-air TV appearances with border czar Tom Homan.<\/p>\n<p>A Manhattan judge on Monday blasted Mayor Eric Adams\u2019 controversial executive order to reopen an ICE office on Rikers Island, declaring it \u201cnull and void.\u201d  Michael Nagle<\/p>\n<p>Adams was accused by the City Council in a lawsuit of making a deal with the Trump admin to open up Rikers to ICE. Leonardo Munoz<\/p>\n<p>\u201cThe timeline of public statements and the ongoing criminal prosecution so clearly demonstrate an impermissible appearance of a conflict of interest,\u201d Rosado wrote. <\/p>\n<p>\u201cThe appearance of this conflict and Mayor Adams\u2019 failure to recuse himself fully tainted the entire process by which Executive Order No. 50 was issued, making it null and void,\u201d the decision said. <\/p>\n<p>Rosado slammed Adams\u2019 attempt to distance himself from the deal by claiming he had delegated the matter to First Deputy Mayor Randy Mastro, who ultimately signed the order.<\/p>\n<p>\u201cThe argument that this conflict was cleansed by delegating to First Deputy Mayor Mastro is farcical. First Deputy Mayor Mastro is not independent of Mayor Adams, and he was appointed and delegated the specific task of issuing Executive Order No. 50 after Mayor Adams made it publicly known his desired outcome,\u201d Rosado added.<\/p>\n<p>The judge also said Adams\u2019 claim that Mastro ought to be able to issue executive orders \u201clacks both merit and imagination,\u201d and chided Hizzoner for not consulting the city\u2019s Conflict of Interest board, or making any other attempt to determine if the order was ethically appropriate.<\/p>\n<p>Since the order is \u201cillegal and a nullity,\u201d there was no need to order the injunction sought by the City Council to block the order from taking effect, Rosado said.<\/p>\n<p>Rosado has already sided with the Council twice this year \u2014 first temporarily blocking the order, then indefinitely blocking it. Friday\u2019s ruling formally kills the order and bars Adams from signing any agreement with ICE tied to Rikers. <\/p>\n<p>Adams plainly failed to bind himself by the city charter to avoid conflicts of interest and not to use his office to benefit himself, Rosado said in her decision. @NYCMayor<\/p>\n<p>The final decision follows a scathing 29-page lawsuit filed in April by the City Council, which accused Adams of orchestrating a \u201ccorrupt bargain\u201d with the Trump administration to get the feds to drop his corruption case in exchange for greenlighting ICE\u2019s return to Rikers. <\/p>\n<p>Homan, Trump\u2019s border czar, essentially confirmed such a deal by colorfully telling Adams during a joint interview that he\u2019d be \u201c<a href=\"https:\/\/nypost.com\/2025\/02\/14\/us-news\/tom-homan-warns-mayor-adams-hell-be-up-his-butt-on-immigration\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">up his butt<\/a>\u201d if the mayor didn\u2019t fulfill an \u201cagreement,\u201d the Council\u2019s suit argued.\u00a0<\/p>\n<p>The lawsuit also extensively quoted Homan, broadly outlining his intentions to use the Rikers ICE office for wide deportations.<\/p>\n<p>However, City Hall \u201cvehemently\u201d disagreed with Rosado\u2019s decision and remains confident in Adams\u2019 ability to appeal the case.<\/p>\n<p>\u201cWe vehemently disagree with the judge\u2019s decision, and we remain confident we will prevail when we appeal this case. Let\u2019s be clear: at no point does the judge dispute that the substance of our executive order fully complies with local law \u2014 that\u2019s because it does,\u201d Mastro said in a statement to The Post.<\/p>\n<p>The final decision follows a scathing 29-page lawsuit filed in April by the City Council, which accused Adams of orchestrating a \u201ccorrupt bargain\u201d with the Trump administration. Michael Nagle<\/p>\n<p>\u201cThere is also no actual conflict of interest here, and the mayor responded to the appearance of a conflict by delegating this issue to me as his first deputy mayor \u2014 whom the judge herself described as an \u2018accomplished and highly educated attorney\u2019 \u2014 and I acted entirely independently of the mayor,\u201d he said.<br \/>\u00a0<br \/>\u201cAs I have repeatedly said, this executive order is about the criminal prosecution of violent transnational gangs committing crimes in our city. Our administration has never, and will never, do anything to jeopardize the safety of law-abiding immigrants, and this executive order ensures their safety as well,\u201d Mastro added.<\/p>\n<p>\u201cWe will also never assist in civil enforcement, in accordance with local law.
