{"id":218182,"date":"2025-09-11T12:49:12","date_gmt":"2025-09-11T12:49:12","guid":{"rendered":"https:\/\/www.europesays.com\/us\/218182\/"},"modified":"2025-09-11T12:49:12","modified_gmt":"2025-09-11T12:49:12","slug":"in-philly-gun-stores-now-must-warn-against-straw-purchasing","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/218182\/","title":{"rendered":"In Philly, Gun Stores Now Must Warn Against Straw Purchasing"},"content":{"rendered":"<p>In an effort to further drive down shootings, Philadelphia is now requiring gun stores to post warning signs about the criminality and consequences of purchasing firearms for someone who is legally barred from owning them. The practice, known as <a href=\"https:\/\/www.thetrace.org\/2025\/07\/straw-purchasing-guns-women-philadelphia\/\" rel=\"nofollow noopener\" target=\"_blank\">straw purchasing<\/a>, can lead to a decade in prison and a six-figure fine.<\/p>\n<p>Many people still don\u2019t know that straw purchasing violates state and federal law, said Mayor Cherelle Parker, who signed the local bill into law during a City Hall ceremony on September 8.<\/p>\n<p>\u201cWhat we\u2019ve learned is that some people may not be aware of the law,\u201d she said.\u00a0<\/p>\n<p>Parker said the new law, which takes effect as <a href=\"https:\/\/www.thetrace.org\/2025\/03\/trump-funding-cuts-arpa-philly-violence\/\" rel=\"nofollow noopener\" target=\"_blank\">homicides and shootings are declining<\/a>, is part of the city\u2019s prevention, intervention, and enforcement strategy. As of early September, homicides were down 16.3 percent compared to the same time last year, while shootings were down 10.3 percent, according to data from the Philadelphia Police Department. Last year, homicides were down 37 percent and shootings were down 36 percent compared to 2023.<\/p>\n<p>\u201cIf we keep moving in this direction we could see the lowest number of homicides and shootings in Philadelphia in half a century,\u201d Parker said.\u00a0<\/p>\n<p>She and other officials said they knew of no other city that has a law requiring stores to post warnings against straw purchasing. \u201cIf our research stands firmly, we may be the first city in the nation to require a posting,\u201d Parker said.<\/p>\n<p>The law requires the Philadelphia Police Department to provide the city\u2019s seven licensed firearm dealers with free signs that must be posted near entrances and payment areas, at shooting range entrances, and by any area where customers fill out purchasing documents.<\/p>\n<p>The orange signs with black letters in English and Spanish warn that purchasing guns for someone who can\u2019t legally buy one is a crime punishable by up to 10 years in prison and a $250,000 fine.\u00a0<\/p>\n<p>\u201cStop! Think before it\u2019s too late and you become a criminal,\u201d the signs say.<\/p>\n<p>Managers and employees at four gun shops contacted by The Trace declined to comment.<\/p>\n<p>The new law is the latest piece of anti-gun violence legislation the city has pursued in recent years despite Pennsylvania\u2019s <a href=\"https:\/\/giffords.org\/lawcenter\/state-laws\/preemption-of-local-laws-in-pennsylvania\/\" rel=\"nofollow noopener\" target=\"_blank\">preemption law<\/a>, which prohibits cities and towns from regulating the ownership, possession, and transfer of firearms.<\/p>\n<p>Pennsylvania\u2019s preemption law sometimes makes Philly\u2019s gun regulations vulnerable. While a court in 2022 <a href=\"https:\/\/whyy.org\/articles\/philly-lost-gun-reporting-law-ruled-illegal\/\" rel=\"nofollow noopener\" target=\"_blank\">overturned Philadelphia\u2019s law<\/a> requiring gun owners to report their lost and stolen guns, last year a <a href=\"https:\/\/www.ceasefirepa.org\/general-interest\/ceasefirepa-applauds-pa-commonwealth-court-decision-upholding-philadelphias-ban-on-ghost-guns\/\" rel=\"nofollow noopener\" target=\"_blank\">court upheld the city\u2019s\u00a0 2021 law<\/a> banning the manufacturing of ghost guns. A<a href=\"https:\/\/www.thetrace.org\/2024\/06\/philadelphia-glock-switch-bump-stock-ban\/\" rel=\"nofollow noopener\" target=\"_blank\"> law banning switch devices<\/a> that allow guns to fire like automatic weapons is still on the books while it faces a lawsuit.<\/p>\n<p>\u201cWe\u2019re often the first ones. We were the first on the ghost gun ban and the machine-gun converter ban,\u201d said Adam Garber, executive director of CeaseFirePA, which advocates for gun safety laws. He noted that York, Pennsylvania, recently passed a machine-gun converter ban modeled on Philly\u2019s law.<\/p>\n<p>Straw purchasing has increasingly been a problem among Philadelphia\u2019s women, leading a prominent women\u2019s advocacy organization to start a campaign to educate women about the crime, <a href=\"https:\/\/www.thetrace.org\/2025\/07\/straw-purchasing-guns-women-philadelphia\/\" rel=\"nofollow noopener\" target=\"_blank\">The Trace reported in July<\/a>.<\/p>\n<p>\u201cGun violence in Philadelphia is fueled by the black market of illegal firearms, many of which have been straw purchased,\u201d City Solicitor Renee Garcia said. \u201cWe are hopeful that this legislation will contribute to a culture of safe and legal gun ownership.\u201d<\/p>\n<p><img decoding=\"async\" class=\"lazy-img lazyload false\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/09\/IMG_0035-scaled.jpg\"  data- alt=\"\" data-caption=\"Mayor Cherelle Parker points to the warning sign gun stores will have to display.&#10;\" data-credit=\"Mensah M. Dean for The Trace<\/p>\n<p>In many cases, according to police and attorneys, women who straw purchase do so because they feel they can\u2019t say no to the men who ask them to buy weapons.<strong> <\/strong>Between 2020 and 2024, the percentage of women arrested for shooting and gun possession cases increased from 6 to 10 percent, according to Philadelphia Police Department data. But women make up a larger share of those charged with straw purchasing. According to data from the District Attorney\u2019s Office, since 2018, women have accounted for 24 percent of 559 straw purchasing defendants.<\/p>\n<p>The officials behind the law say they\u2019ve witnessed such transactions up close. City Councilmember Curtis Jones, who sponsored the measure, took a field trip to a gun show in neighboring <a href=\"https:\/\/eagleshows.com\/events\/category\/oaks-gun-show\/\" rel=\"nofollow noopener\" target=\"_blank\">Oaks, Pennsylvania.<\/a> There, he said, he witnessed a woman asking a male companion which gun he wanted her to buy, and saw others face-timing men about gun purchases. In the parking lot, he said, customers were passing their newly purchased guns to others.<\/p>\n<p>\u201cWe looked with our jaws dropped and said we need to talk to our mayor about this kind of thing.
