If you value what we do, please support our work with <a href=\"https:\/\/support.truthout.org\/-\/XXQLBDSX\/&amp;utm_source=truthout&amp;utm_medium=bcb&amp;utm_campaign=304219\" rel=\"nofollow noopener\" target=\"_blank\">a donation<\/a>.<\/p>\n<p>People in a New York prison\u2019s mental health unit are kept in their cells 24 hours a day, with the exception of an occasional \u201ccallout,\u201d and denied therapeutic services, according to a <a href=\"https:\/\/www.dropbox.com\/scl\/fi\/kagxqei3wmr0sixiquxa3\/complaint.pdf?rlkey=z724848teoq0v508ebjquxyp4&amp;e=1&amp;st=2cgdicpu&amp;dl=0\" rel=\"nofollow noopener\" target=\"_blank\">lawsuit filed<\/a> this week by Disability Rights New York and Prisoners\u2019 Legal Services of New York against New York State Department of Corrections and Community Supervision (DOCCS), among others. <\/p>\n<p>\u201cDefendants are knowingly depriving individuals in the Residential Mental Health Unit (\u201cRMHU\u201d) at Marcy Correctional Facility (\u201cMarcy\u201d) of all out-of-cell programming and mental health and medical treatment and keeping them almost entirely isolated,\u201d the lawsuit states. <\/p>\n<p>The unit was opened more than 15 years ago in response to a lawsuit filed by Disability Advocates, Inc., Prisoners\u2019 Legal Services, and others, which alleged that people with serious mental illness were kept in isolation and denied mental health services, the same conditions that allegedly exist today. <\/p>\n<p>Stay in the loop<\/p>\n<p>Never miss the news and analysis you care about.<\/p>\n<p><a href=\"https:\/\/www.law.cornell.edu\/regulations\/new-york\/7-NYCRR-320.2#:~:text=A%20residential%20mental%20health%20unit,and%20order%20on%20the%20unit.\" rel=\"nofollow noopener\" target=\"_blank\">State regulations mandate<\/a> that people in the RMHU are offered seven hours of out-of-cell time each day \u2014 four hours of therapeutic programming and\/or mental health treatment, and three hours for group programming, services, treatment, recreation and\/or meals.<\/p>\n<p>\u201cNow, sixteen years after its opening, Defendants are operating the Marcy RMHU in precisely the same manner as the segregated confinement housing units it was created to redress,\u201d the lawsuit states. <\/p>\n<p>    Related Story<\/p>\n<p>    <a class=\"ar-list__th__lnk d-block\" href=\"https:\/\/truthout.org\/articles\/officials-knew-about-violence-in-prison-where-robert-brooks-was-fatally-beaten\/\" title=\"Officials Knew About Violence in Prison Where Robert Brooks Was Fatally Beaten\" rel=\"nofollow noopener\" target=\"_blank\"><br \/>\n      <img decoding=\"async\" width=\"400\" height=\"300\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/09\/2025_0103-marcy-400x300.jpg\" class=\"img-fluid cover wp-post-image\" alt=\"Entrance to Marcy Correctional Facility state prison on December 19, 2024, in Marcy, New York.\" loading=\"lazy\"  \/><br \/>\n    <\/a><\/p>\n<p>\n         Watchdogs called on officials to investigate racist human rights abuses at Marcy Correctional Facility back in 2023.\n      <\/p>\n<p>The suit alleges that some people in the unit were receiving out-of-cell programming and services until the correctional officers went on an <a href=\"https:\/\/truthout.org\/articles\/nys-prison-guard-strike-has-roots-in-decades-of-racialized-deindustrialization\/\" rel=\"nofollow noopener\" target=\"_blank\">illegal strike in February<\/a> after the Times Union <a href=\"https:\/\/www.timesunion.com\/capitol\/article\/sealed-indictment-handed-beating-death-robert-20167919.php\" rel=\"nofollow noopener\" target=\"_blank\">reported<\/a> that officers involved in the death of Robert Brooks would be criminally charged. In December, Marcy prison guards beat Brooks while he was handcuffed and in the prison\u2019s medical ward. The brutal attack was captured by the officers\u2019 body cameras, which they thought they had turned off. <\/p>\n<p>There are currently about 95 people housed in Marcy\u2019s RMHU. They receive their meals through a slot in their steel cell door \u2014 the same opening that is used to handcuff them before they leave the cell. The unit lacks air conditioning, causing the cells to become unbearably hot in the summer. <\/p>\n<p>People in the unit are confined to their cells and recreation pens \u201call day, every day absent an emergency, outside visit, disciplinary hearing, or a brief medical encounter, such as for insulin injection,\u201d the suit says. Counselors, therapists, and psychiatrists speak with the men through the cell\u2019s grate-covered window, which, for some people, is also covered with plexiglass. <\/p>\n<p>A recreation pen is attached to each cell. The pens, described in the suit as \u201can empty cage with a solid ceiling,\u201d are often \u201cfilthy from both debris and human feces that are frequently thrown by incarcerated individuals from their recreation pens.\u201d<\/p>\n<p>To receive medical or mental health care, people in the unit must \u201cyell through the grate-covered window in their cell door.\u201d Staff typically ignore their calls or are delayed in responding, the suit says. <\/p>\n<p>On August 6, a person yelled \u201cSUICIDE\u201d from their cell. Staff did not show up until two to five minutes later, and mental health staff arrived five to 10 minutes after that. The person was not brought out of his cell for assessment or observation, the suit says. <\/p>\n<p>One of the plaintiffs, Jose Cornejo, who has been in the unit since 2024, reported that in July he heard another incarcerated person scream for mental health help because he was in crisis. The man did not receive mental health treatment, and Cornejo saw him hang himself, according to the complaint. <\/p>\n<p>Since February, at least two people on the unit have attempted suicide, and, in the last four months, at least three have gone on hunger strike to protest the conditions, according to the complaint. Dejour Nesmith, one of the strikers, stopped his hunger strike because he was shown a piece of paper that said \u201cforce feed order.\u201d <\/p>\n<p>Another plaintiff, Tyrell Escobar, reported that an officer assaulted him in August. Escobar has been diagnosed with post-traumatic stress disorder (PTSD), among other mental health disorders. <\/p>\n<p>\u201cHe called me a \u201cf***ing n***er\u201d and slammed my fingers in the window of the cell door,\u201d Escobar said, as per the complaint. <\/p>\n<p>The suit says Escobar\u2019s ring finger on his right hand \u201cappears to be broken and his middle finger is bruised and crooked.\u201d He did not receive X-rays until almost three weeks after the attack.<\/p>\n<p>Plaintiff Luis Garcia has put in about 10 \u201csick call\u201d slips, but has not been taken to see a nurse or doctor.
