{"id":222654,"date":"2025-09-13T04:32:34","date_gmt":"2025-09-13T04:32:34","guid":{"rendered":"https:\/\/www.europesays.com\/us\/222654\/"},"modified":"2025-09-13T04:32:34","modified_gmt":"2025-09-13T04:32:34","slug":"time-for-a-no-tolerance-policy-on-transit-crime","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/222654\/","title":{"rendered":"Time for a No Tolerance Policy on Transit Crime"},"content":{"rendered":"<p>Iryna Zarutska\u2019s <a href=\"https:\/\/www.city-journal.org\/article\/iryna-zarutska-decarlos-brown-charlotte-crime\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">senseless murder<\/a> on a Charlotte, North Carolina, light-rail train has reignited debate over <a href=\"https:\/\/nypost.com\/2025\/09\/08\/us-news\/iryna-zarutska-murder-suspect-was-free-on-cashless-bail-despite-rap-sheet\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">bail reform<\/a> and <a href=\"https:\/\/nypost.com\/2025\/09\/08\/us-news\/trump-rages-over-murder-of-ukrainian-refugee-iryna-zarutska-horrific-killings-require-horrible-actions\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">criminal recidivism<\/a>. This is a worthwhile debate for New York City, too. Many of what Charlotte\u2019s mayor calls \u201c<a href=\"https:\/\/x.com\/cltmayor\/status\/1965166868882477567?s=46\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">tragic failures<\/a> that contributed to Zarutska\u2019s murder also afflict Gotham\u2019s transit system. And the only way to address the problem is more aggressive enforcement of basic subway rules, including prosecuting farebeating.<\/p>\n<p>New Yorkers <a href=\"https:\/\/gothamist.com\/news\/new-yorkers-feel-somewhat-safer-in-public-but-subway-fears-persist-survey-finds\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">remain fearful<\/a> of using public transit, owing to a series of violent crimes by repeat offenders, including the gruesome <a href=\"https:\/\/www.cnn.com\/2024\/12\/24\/us\/what-we-know-subway-fire-hnk\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">murder<\/a> by arson of a woman in the Coney Island subway station last December. Comprehensive <a href=\"https:\/\/www.vitalcitynyc.org\/articles\/just-the-facts-on-new-york-city-subway-crime\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">data analysis<\/a> published by Vital City in January 2025 shows that New Yorkers have cause for concern. Subway assaults have tripled since 2009; violent-crime recidivism has doubled since 2019; 16.8 percent of violent subway offenders had prior arrests for similar crimes during the prior six years; and 24.7 percent of those same violent subway offenders had prior arrests for farebeating in the past six years.<\/p>\n<p>Three years ago, Mayor Eric Adams instituted a Safe Subway Plan to address New Yorkers\u2019 anxieties, but this <a href=\"https:\/\/www.city-journal.org\/article\/an-unfinished-plan\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">didn\u2019t go far enough<\/a>. New York needs zero tolerance for all subway crimes. That means that the city\u2019s district attorneys must resume prosecutions for turnstile jumping.<\/p>\n<p>In the summer of 2024, former NYPD commissioner William Bratton and City Journal contributing editor Rafael Mangual called on the city to <a href=\"https:\/\/www.city-journal.org\/article\/how-to-get-the-subways-under-control\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">resume fare evasion prosecutions<\/a>. They also identified some of the central obstacles to prosecuting these crimes\u2014the bail and discovery reforms of 2020 and the <a href=\"https:\/\/www.bronxda.nyc.gov\/downloads\/pdf\/safer-bronx-through%20fair-justice.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">reluctance<\/a> of district attorneys to <a href=\"https:\/\/www.manhattanda.org\/wp-content\/uploads\/2018\/12\/Fare-Beating-Fact-Sheet-v3.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">prosecute<\/a> fare <a href=\"https:\/\/www.amny.com\/law\/brooklyn-da-gonzalez-pitches-his-case-by-case-progressivism-for-third-term\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">evasion<\/a>.<\/p>\n<p>New York\u2019s 2020 <a href=\"https:\/\/www.city-journal.org\/article\/restarting-the-wheel-of-justice\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">discovery reforms<\/a> forced prosecutors to go to unnecessary lengths to acquire and share with the accused all the paperwork in their possession. Of course, all relevant material should be shared\u2014exculpatory materials, impeachment materials, and recorded statements of witnesses and the accused\u2014but the statute initially required far more. A prosecutor\u2019s failure to acquire even a single memo-book entry from a police officer, for example, <a href=\"https:\/\/www.nycourts.gov\/reporter\/3dseries\/2024\/2024_50589.htm\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">could derail<\/a> an entire prosecution.<\/p>\n<p>Since 2020, New York prosecutors have spent significantly more time requesting, compiling, and serving discovery than going to the grand jury, appearing in court, writing motions, and going to trial. The amount of time, effort, and resources required to obtain every piece of paper from every police officer even tangentially involved with a case has made the task of prosecuting hundreds of cases unduly onerous, if not impossible. During my own tenure as an assistant DA, my colleagues and I would often joke that we were glorified paper pushers first, prosecutors second.<\/p>\n<p>In practice, the 2020 discovery reforms forced young prosecutors, tasked mostly with pursuing misdemeanor charges like fare evasion, to triage offenses. To reduce the caseload and prevent <a href=\"https:\/\/www.nytimes.com\/2022\/04\/03\/nyregion\/nyc-prosecutors-jobs.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">burnout<\/a>, crimes like fare evasion never make it past the Early Case Assessment Bureau stage, in order to prioritize violent crimes and individual-victim crimes. (There were always exceptions to this rule, however\u2014particularly in cases involving contraband or more serious alleged criminality.)<\/p>\n<p>Some welcome changes have appeared on this front. Effective August 7, 2025, the state <a href=\"https:\/\/nysba.org\/annual-review-of-new-criminal-justice-legislation-4\/?srsltid=AfmBOopNexTtCzxRzxRYjWGdFfUvamjJrElLeIUspgkiEHjTrHgjnBrI\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">amended<\/a> the discovery laws to require disclosure only of information \u201crelated to the subject matter of the charges\u201d against the accused. These changes will significantly reduce the paperwork burden on young prosecutors while maintaining their ability to provide the accused with all relevant information for preparing a defense.<\/p>\n<p>More remains to be done. The New York Post <a href=\"https:\/\/nypost.com\/2025\/09\/07\/us-news\/meet-the-worst-transit-terrors-on-loose-in-nyc\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">reports<\/a> that 63 transit recidivists in New York City account for more than 5,000 arrests but only five incarcerations between them. The Metropolitan Transportation Authority (MTA) has <a href=\"https:\/\/www.crainsnewyork.com\/transportation\/mta-wants-das-prosecute-fare-evasion\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">called<\/a> for DA offices to resume prosecutions for fare evasion, citing the loss of more than $600 million in revenue in 2023. This is a good start. Boston, Massachusetts, has also begun a <a href=\"https:\/\/www.cbsnews.com\/boston\/news\/mbta-fare-evasion-crackdown-boston\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">crackdown on fare evasion<\/a>.<\/p>\n<p>It\u2019s understandable that DA offices would triage cases to avoid overwhelming young prosecutors. But they also have an obligation to deter the recidivist criminals who threaten rider safety on public transit.<\/p>\n<p>As tragedies like the murders in Charlotte and Coney Island show, no transit crime, including fare evasion, should be tolerated.<\/p>\n<p><a href=\"https:\/\/www.city-journal.org\/person\/elliott-r-hamilton\" target=\"_blank\" rel=\"noopener nofollow\">Elliott R.
