Some viewers may catch a <a href=\"https:\/\/www.ispot.tv\/ad\/fLrj\/head-and-shoulders-tiny-troy-clinical-strength-featuring-troy-polamalu-patrick-mahomes\" rel=\"nofollow noopener\" target=\"_blank\">commercial<\/a> aired last season featuring star quarterback Patrick Mahomes shampooing a salon-goer\u2019s hair. It evolves into a conversation with a microscopic ex-NFLer Troy Polamalu on the merits of regularly using dandruff-control shampoo to prevent flakes.<\/p>\n<p>It\u2019s silly, but what\u2019s sillier is that Mahomes would break the law if he tried shampooing anyone\u2019s hair for a fee in New York without a license.<\/p>\n<p>Of course, Mahomes makes <a href=\"https:\/\/www.spotrac.com\/nfl\/player\/_\/id\/21751\/patrick-mahomes\" rel=\"nofollow noopener\" target=\"_blank\">an average $45 million per year<\/a> as an NFL quarterback, plus shampoo endorsements. He does not need to moonlight in a salon as a shampooer. Nor would he qualify for the bucket of goodies Governor Hochul is giving New Yorkers to counter the high cost of living in New York.<\/p>\n<p>Rather than sending <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-hochul-announces-inflation-refund-checks-400-coming-fall-82-million-households-across\" rel=\"nofollow noopener\" target=\"_blank\">inflation rebate<\/a> and <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-hochul-announces-checks-are-way-new-yorkers-receiving-child-tax-credit-payments\" rel=\"nofollow noopener\" target=\"_blank\">child tax credit<\/a> checks, Hochul should advocate for breaking down barriers to earning wages that last a lifetime. A good starting point is removing onerous occupational licensing requirements.<\/p>\n<p>Hair shampooing falls under Albany\u2019s legal definition of natural hair styling. To qualify for a license, a natural hair stylist must <a href=\"https:\/\/dos.ny.gov\/get-natural-hair-styling-license\" rel=\"nofollow noopener\" target=\"_blank\">complete 300 hours of instruction and pass written and practical exams<\/a>. Of those 300 hours, 220 relate to hair braiding, locking, weaving and styling.<\/p>\n<p>It\u2019s not clear why someone who could work as a salon assistant with duties that include shampooing and rinsing hair needs the other 80 hours of training for a natural hair stylist. Nor is it clear why a blow dry bar worker needs 300 hours of instruction to wash and style hair.<\/p>\n<p>Hair shampooers and hair braiders need almost double the instruction time as the 150 to 180 hours <a href=\"https:\/\/www.health.ny.gov\/professionals\/ems\/\" rel=\"nofollow noopener\" target=\"_blank\">EMTs require to be licensed<\/a> in the Empire State.<\/p>\n<p>The rationale for licensing salon services centers around the use of dyes and chemicals and certain public health considerations that may require some assurance there is a responsible salon worker present who knows what he or she is doing. But the state\u2019s curriculum is a hammer, not a scalpel.<\/p>\n<p>New York\u2019s natural hair styling education requirements create an unnecessary barrier to entry for new job seekers like high schoolers who may be interested in a future cosmetology career. It forces others to pay tuition to specialized training schools \u2014 and possibly take on unnecessary student loan debt \u2014 without knowing whether such a career is the right choice for them.<\/p>\n<p>Dry bar services and hair braiding have been the targets of licensing reform in other states. Minnesota governor Tim Walz <a href=\"https:\/\/www.revisor.mn.gov\/laws\/2020\/0\/106\/#laws.0.1.0\" rel=\"nofollow noopener\" target=\"_blank\">signed a bill in 2020<\/a> exempting makeup services and hairstyling, defined as cleaning, drying, or styling hair, including using shampoos, conditioners, and hairsprays, from the definition of cosmetology.<\/p>\n<p>The Minnesota exemption depends on the hair stylist <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/155A.27\" rel=\"nofollow noopener\" target=\"_blank\">completing a four-hour course on health, safety and infection-control matters<\/a>. Compare that to the required <a href=\"https:\/\/govt.westlaw.com\/nycrr\/Document\/I897db0fac22411ddb9e5b2e06f1b2e15?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" rel=\"nofollow noopener\" target=\"_blank\">20 hours of safety and health instruction<\/a> in New York\u2019s 300-hour curriculum.<\/p>\n<p>Better yet, salon owners should be responsible for the education, skills, training and competence of staff and for the health and safety of customers and the salon\u2019s sanitation. The tort system can take care of enforcement if injuries occur.<\/p>\n<p>Salon owner responsibility is part of a <a href=\"https:\/\/alec.org\/model-policy\/niche-beauty-services-opportunity-act\/\" rel=\"nofollow noopener\" target=\"_blank\">model law<\/a> New York should adopt that exempts hair styling, as defined by Minnesota, and hair braiding. It should also follow suit and exempt makeup services and threading from the licensing law.<\/p>\n<p>To be sure, licensing reform is an uphill battle in a state where legislators in the last session introduced bills promoting <a href=\"https:\/\/www.nyassembly.gov\/leg\/?default_fld=%0D%0A&amp;leg_video=&amp;bn=A07924&amp;term=2025&amp;Summary=Y&amp;Text=Y\" rel=\"nofollow noopener\" target=\"_blank\">more detailed regulation of hair braiders<\/a> and making sure <a href=\"https:\/\/www.nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=A01329&amp;term=2025&amp;Summary=Y&amp;Text=Y\" rel=\"nofollow noopener\" target=\"_blank\">threaders must be licensed<\/a>.<\/p>\n<p>To her credit, Hochul has targeted some obstacles New York puts up for jobseekers. For instance, she has pushed for the state to join interstate licensure compacts to make it easier for doctors, psychologists or nurses to practice in New York, and vice versa, <a href=\"https:\/\/www.budget.ny.gov\/pubs\/archive\/fy26\/ex\/artvii\/hmh-bill.pdf#page=178\" rel=\"nofollow noopener\" target=\"_blank\">every budget cycle<\/a> since she took office.<\/p>\n<p>Hochul also dipped her toe specifically into cosmetology licensing reform in her <a href=\"https:\/\/www.governor.ny.gov\/sites\/default\/files\/2023-01\/2023SOTSBook.pdf#page=261\" rel=\"nofollow noopener\" target=\"_blank\">2023 State of the State address<\/a> by proposing a trainee license and a training option for cosmetology professionals. She noted cosmetology students pay on average $16,000 over the course of a year of training. But that proposal went nowhere in the ensuing legislative session.<\/p>\n<p>Free market-loving New Yorkers can\u2019t dare to dream of universal licensing recognition like that adopted by Arizona in 2019 for residents moving there. But New York could follow its neighbor Pennsylvania, which last fall became the <a href=\"https:\/\/ij.org\/issues\/economic-liberty\/braiding\/\" rel=\"nofollow noopener\" target=\"_blank\">34th state<\/a> to <a href=\"https:\/\/www.legis.state.pa.us\/cfdocs\/legis\/li\/uconsCheck.cfm?yr=2024&amp;sessInd=0&amp;act=100\" rel=\"nofollow noopener\" target=\"_blank\">stop requiring licenses to braid hair<\/a>, and throw in hair styling, threading and makeup services for good measure.<\/p>\n<p>Hochul does not need help from the Legislature to adopt in the executive branch <a href=\"https:\/\/www.pa.gov\/agencies\/dos\/newsroom\/pennsylvania-surges-in-national-occupational-licensing-rankings.html\" rel=\"nofollow noopener\" target=\"_blank\">Governor Josh Shapiro\u2019s focus<\/a> on slashing wait times and cutting red tape for licenses the Legislature won\u2019t eliminate.<\/p>\n<p>New York\u2019s peers have adopted occupational licensing reforms that let their citizens get to work \u2014 and get to paying taxes.
