{"id":234329,"date":"2025-09-17T17:26:11","date_gmt":"2025-09-17T17:26:11","guid":{"rendered":"https:\/\/www.europesays.com\/us\/234329\/"},"modified":"2025-09-17T17:26:11","modified_gmt":"2025-09-17T17:26:11","slug":"teachers-file-lawsuit-to-maintain-control-of-ohio-pension-board","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/234329\/","title":{"rendered":"Teachers file lawsuit to maintain control of Ohio pension board"},"content":{"rendered":"<p class=\"article__paragraph article__paragraph--left\" id=\"3IJCXQAXLBBDZE567UPF6HYYPU\">COLUMBUS, Ohio &#8212; Three educators\u2019 groups have sued to stop a new law that <a href=\"https:\/\/www.cleveland.com\/news\/2025\/06\/how-a-last-minute-budget-move-changed-who-controls-ohios-teacher-pensions.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.cleveland.com\/news\/2025\/06\/how-a-last-minute-budget-move-changed-who-controls-ohios-teacher-pensions.html\">shifts control<\/a> of Ohio\u2019s State Teachers Retirement System board from educators to political appointees.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"INYHL7LYQJBWNOK7EWPM2YTQMM\">The Ohio Education Association, the Ohio Federation of Teachers, and the Ohio Conference of the American Association of University Professors filed the case Tuesday in Franklin County Court of Common Pleas. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NOVUDI6PRZFUNJR4K7P3O7LBFM\">The STRS board has 11 members. Teachers and retirees elect seven members, and state officials appoint the other four. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XHKSBKUB6BCNDADLH3ZAMG6FM4\">But lawmakers <a href=\"https:\/\/www.cleveland.com\/news\/2025\/06\/how-a-last-minute-budget-move-changed-who-controls-ohios-teacher-pensions.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.cleveland.com\/news\/2025\/06\/how-a-last-minute-budget-move-changed-who-controls-ohios-teacher-pensions.html\">added four new appointees<\/a> and phased out four elected members when they passed the state\u2019s operating budget in June.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ITTZE4ZV6JHYDFQ6IPA7URBHM4\">That means the board will have eight appointed members and three elected members by 2028.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"EWIG3R5SX5CAXGH2HLTUANKPQU\">Republicans said the change will stabilize the fund after years of controversy and <a href=\"https:\/\/www.cleveland.com\/open\/2023\/11\/director-of-ohios-teachers-retirement-system-placed-on-leave-amid-misconduct-investigation.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.cleveland.com\/open\/2023\/11\/director-of-ohios-teachers-retirement-system-placed-on-leave-amid-misconduct-investigation.html\">leadership turnover<\/a>.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"PMBFKKXTB5HTBPC3Q3KE4ITZHU\">\u201cWe stand by the law that was passed,\u201d Rep. Adam Bird, a Clermont County Republican, said. \u201cWe believe the change was needed to provide stable governance to protect the pensions for hardworking teachers, current retirees, and future retirees.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FEVKYDMFKNBEVL4QO337AF2TW4\">The lawsuit says the shift unfairly targeted STRS and was unconstitutional. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FYYZTX24U5DXFIBJHDZUSHX6EY\">\u201cThis lawsuit is about restoring fairness and protecting our fundamental right to have a say in how our retirement is managed,\u201d said Cincinnati Public School teacher Glenetta Kraus, the lead plaintiff on the case.<\/p>\n<p>What\u2019s behind the board fight<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZVWILKIFPFE3JFOUQK7TWPTOXE\">In 2024, Attorney General Dave Yost asked a court <a href=\"https:\/\/www.cleveland.com\/news\/2024\/05\/feud-at-state-teachers-pension-system-escalates-as-ohio-ag-sues-to-remove-board-members.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.cleveland.com\/news\/2024\/05\/feud-at-state-teachers-pension-system-escalates-as-ohio-ag-sues-to-remove-board-members.html\">to remove two STRS board members<\/a>, Wade Steen and Rudy Fichtenbaum. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ITLM4LR4HBCL7BPJCWPUYNN47E\">He accused them of trying to steer the pension fund toward QED Technologies, a new company that Yost said had no track record managing public pensions. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FQ35KAW25VBXHAARWWJJI433V4\">According to Yost, the pair pushed for QED to oversee a large share of STRS\u2019s $91 billion portfolio despite warnings from staff and outside consultants that the firm was unqualified and its investment strategy untested.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"CPDVI3BMBBBEFOYXA7KKAHZXFY\">Steen and Fichtenbaum denied any wrongdoing.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BDEJDQ67EREGHMBSKSACIN4Q2Y\">\u201cWe\u2019re going to defend this rigorously,\u201d Steen told reporters in 2024. \u201cNone of it\u2019s true. It\u2019s all false.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"C3EQ5C4HRRCPRCUVOKHWEOVGPI\">Both men came into office as part of a push to change the board\u2019s direction.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4T6CIU4RBZAZXEWH525WAA74XA\">STRS didn\u2019t give out cost-of-living increases from 2017 through 2022, a fact that frustrated retirees. They filed records requests, brought lawsuits, and elected \u201creformers\u201d to the board. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BYSRDRKLFZB2ZKO2XIZFWNNQJA\">\u201cI don\u2019t think chaos strengthens the fund,\u201d Bird said in June. \u201cRetired teachers and today\u2019s teachers can be assured that the promise that was made can be kept.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"34M5LLX6G5FOJB6TMSN3XWNUZU\">But David Quolke said the board had already turned the corner. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YHIF5AZNLBGP7HRXMVBHC4TBBU\">The retired teacher is the past president of the Cleveland teachers\u2019 union and is a vice president for its retiree wing. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"HKX3MHZEXRDMZEBZ4JX7VBYARQ\">\u201cThe process isn\u2019t a simple or quick fix,\u201d Quolke said. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6FEKUR6OCVB4BCGD3E7ZVD64ME\">The board approved a 1.5% COLA this summer and lowered the years of service for full retirement benefits. <\/p>\n<p>The legal battle ahead<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6XHA7MLDVJEKXAGYHYH6M7JLMA\">The lawsuit lays out three main reasons why the unions believe the STRS board changes are unconstitutional:<\/p>\n<ul class=\"article__unordered-list\">\n<li id=\"A6BVV5INLJATVGG3VYYVJRZ2OE\"><b>Equal protection:<\/b> Ohio has five public pension systems, but STRS will be the only one where elected members are the minority.<\/li>\n<li id=\"F5HRL6IA3ZAR5K55WCQ4QEIZ4Y\"><b>Single-subject rule:<\/b> The state constitution says bills must cover only one subject. Because STRS does not get state funding, the lawsuit argues the board change had <a href=\"https:\/\/www.cleveland.com\/news\/2025\/07\/how-ohios-budget-became-the-states-most-powerful-policy-document.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.cleveland.com\/news\/2025\/07\/how-ohios-budget-became-the-states-most-powerful-policy-document.html\">nothing to do with the budget<\/a> and should not have been included.<\/li>\n<li id=\"G42AFOO725EVVJXZUORCGU75RE\"><b>Three considerations rule:<\/b> The constitution also requires every bill to be considered on three separate days in each chamber. The board change was added at the very end of budget negotiations, so unions argue it never received the required hearings.<\/li>\n<\/ul>\n<p class=\"article__paragraph article__paragraph--left\" id=\"KU2KMN2ABFGPFH2BEFGON7C354\">\u201cThis is a clear overreach by state policymakers, and it\u2019s not just targeted at teachers,\u201d said Kevin Cain, a retired teacher and plaintiff. \u201cBy hijacking control of our pension fund, legislators are sending a thinly veiled threat to the other public pensions in Ohio, \u2018if you make decisions we don\u2019t like, we\u2019ll take control of your pension too.\u2019\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"EWVDGE5T7BGZHEGAKRRTK5P5RA\">Lawmakers have broad authority to make changes to Ohio\u2019s five public pension systems. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"IRMJK477OFCFNHW7I4MCNI4S3Q\">They can set rules for how funds are invested, adjust future benefits, and even change the structure of pension boards. That\u2019s why Bird believes the court will uphold the law.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"I24O75XC4ZFVJF7FYZ725QKILE\">The unions don\u2019t dispute that.
