{"id":235466,"date":"2025-09-18T04:03:09","date_gmt":"2025-09-18T04:03:09","guid":{"rendered":"https:\/\/www.europesays.com\/us\/235466\/"},"modified":"2025-09-18T04:03:09","modified_gmt":"2025-09-18T04:03:09","slug":"cuban-migrant-facing-capital-murder-charges-in-dallas-beheading-unlikely-to-be-deported","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/235466\/","title":{"rendered":"Cuban migrant facing capital murder charges in Dallas beheading unlikely to be deported"},"content":{"rendered":"<p class=\"body-text-paragraph\">AUSTIN \u2014 A man being held in connection with a Dallas homicide that <a href=\"https:\/\/www.dallasnews.com\/news\/crime\/2025\/09\/11\/motel-manager-attacked-beheaded-in-old-east-dallas-by-employee-affidavit-says\/\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"https:\/\/www.dallasnews.com\/news\/crime\/2025\/09\/11\/motel-manager-attacked-beheaded-in-old-east-dallas-by-employee-affidavit-says\/\">occurred last week<\/a> is unlikely to be deported from the U.S. before his case is resolved, despite President Donald Trump\u2019s comments on the man\u2019s immigration status. <\/p>\n<p class=\"body-text-paragraph\">Yordanis Cobos-Martinez, 37, is facing a capital murder charge by terroristic threat after he attacked 50-year-old <a href=\"https:\/\/www.gofundme.com\/f\/chandra-mouli-bob-nagamallaiah-support-for-his-family\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"https:\/\/www.gofundme.com\/f\/chandra-mouli-bob-nagamallaiah-support-for-his-family\">Chandra Nagamallaiah<\/a> with a machete at the Downtown Suites motel on the morning of Sept. 10. Cobos-Martinez is accused of decapitating Nagamallaiah in front of his wife and son who had shown up to try to stop the attack. <\/p>\n<p class=\"body-text-paragraph\">Cobos-Martinez is an undocumented migrant from Cuba and has a prior deportation order to the country, said Tricia McLaughlin, a spokeswoman for the Department of Homeland Security. Rather, if Cobos-Martinez is able to pay the bond amount, the detainer allows for him to be held for an additional 48 hours to give time for ICE agents to pick him up. <\/p>\n<p class=\"body-text-paragraph\">A grand jury would still need to indict Cobos-Martinez for felony charges, unless he chooses to waive the indictment. <\/p>\n<p class=\"body-text-paragraph\">Claire Crouch, a spokeswoman for Dallas County District Attorney John Creuzot, said Tuesday in an email that a case had not been filed with the office. <\/p>\n<p class=\"body-text-paragraph\">\u201cWe do not comment on pending cases or investigations,\u201d Crouch said. <\/p>\n<p class=\"body-text-paragraph\">Over the weekend, Trump and McLaughlin blamed former President Joe Biden for Nagamallaiah\u2019s death. Cobos-Martinez was held at the Bluebonnet Detention Center earlier this year and was released Jan. 13 because Cuba would not accept him, McLaughlin said. <\/p>\n<p class=\"body-text-paragraph\">Trump went further in his statement, saying it was time to stop being \u201csoft\u201d on migrants who are convicted of crimes. <\/p>\n<p class=\"body-text-paragraph\">\u201cRest assured, the time for being soft on these Illegal Immigrant Criminals is OVER under my watch!\u201d Trump posted on Truth Social on Sept. 14. <\/p>\n<p class=\"body-text-paragraph\">Cobos-Martinez has prior criminal convictions and charges. In Harris County, he was charged with indecency with a child and assault causing bodily injury. Court records show the indecency charge was dismissed because of insufficient evidence and showed Cobos-Martinez pleaded guilty in the assault case and received a one-year jail sentence in January 2023.<\/p>\n<p class=\"body-text-paragraph\">He was also arrested in California in 2017 after he allegedly attempted to carjack a woman while naked, <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article155903539.html\" rel=\"noopener\" target=\"_blank\">according to The Sacramento Bee<\/a>.<\/p>\n<p class=\"body-text-paragraph\">McLaughlin said the killing was \u201ccompletely preventable\u201d if the individual had not been released by the Biden administration after Cuba declined to accept his deportation.
