{"id":238106,"date":"2025-09-19T04:52:12","date_gmt":"2025-09-19T04:52:12","guid":{"rendered":"https:\/\/www.europesays.com\/us\/238106\/"},"modified":"2025-09-19T04:52:12","modified_gmt":"2025-09-19T04:52:12","slug":"alberta-to-use-notwithstanding-clause-on-its-three-transgender-laws-leaked-memo-shows","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/238106\/","title":{"rendered":"Alberta to use notwithstanding clause on its three transgender laws, leaked memo shows"},"content":{"rendered":"<p><a style=\"display:block\" href=\"https:\/\/www.theglobeandmail.com\/resizer\/v2\/3YHIO4MI4JDCJF2LKSD34Y44M4.JPG?auth=0e9003569f82c502d597c83adf9ae0ba0400f8c6bf509756dae79b0a27973226&amp;width=600&amp;height=400&amp;quality=80&amp;smart=true\" aria-haspopup=\"true\" data-photo-viewer-index=\"0\" rel=\"nofollow noopener\" target=\"_blank\">Open this photo in gallery:<\/a><\/p>\n<p class=\"figcap-text\">Alberta Premier Danielle Smith has previously said the notwithstanding clause was on the table as a &#8216;last&#8217; resort regarding the government\u2019s transgender health restrictions.JASON FRANSON\/The Canadian Press<\/p>\n<p class=\"c-article-body__text text-pr-5\">Alberta Premier <a href=\"https:\/\/www.theglobeandmail.com\/topics\/danielle-smith\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/topics\/danielle-smith\/\">Danielle Smith<\/a> has directed officials to invoke the Charter\u2019s notwithstanding clause in amending three laws that affect transgender people, says a leaked government memo obtained by The Canadian Press.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The internal document sent Sept. 10 by the Justice Department asks other departments to assemble information as per a directive from Ms. Smith\u2019s office to invoke the clause.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cAs you are aware, the premier\u2019s office has directed that legislation be developed for the fall legislative session to amend the following pieces of legislation to permit each to operate notwithstanding the Canadian Charter of Rights and Freedoms and the Alberta Bill of Rights,\u201d says the memo from Malcolm Lavoie, Deputy Minister of Justice.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cThis legislative initiative is highly sensitive and should be approached with the utmost confidentiality.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">The document directs officials to craft background information on legal implications and other options to be considered.<\/p>\n<p class=\"c-article-body__text text-pr-5\">It says the plan is to brief Ms. Smith ahead of time, then bring the proposal to cabinet Oct. 21. The house resumes sitting with a throne speech two days later.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Justice spokesperson Heather Jenkins, asked Thursday for comment on the memo, responded in a one-sentence statement.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cAlberta\u2019s government will continue to vigorously protect the safety and well-being of children using all available legal and constitutional means at our disposal, including the notwithstanding clause should our government deem it necessary,\u201d Ms. Jenkins wrote.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The three laws, introduced last year, establish rules for students changing their names or pronouns in school, ban transgender girls from participating in amateur female sports, and limit gender-affirming health care.<\/p>\n<p class=\"c-article-body__text text-pr-5\">LGBTQ+ advocacy groups Egale and Skipping Stone are challenging in court the school pronoun law and rules that would limit health care for transgender youth, calling them discriminatory.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Helen Kennedy, executive director at Egale Canada, said using the notwithstanding clause is \u201can unconscionable attack on 2SLGBTQI people, and a horrific example of state-sponsored transphobia.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cWhen our governments abuse their power by invoking the notwithstanding clause to limit the protections of the Charter of Rights and Freedoms, it\u2019s not just an attack on queer and trans communities, it is an attack on all Canadians.\u201d<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/canada\/article-ottawa-notwithstanding-clause-limits-supreme-court\/\" rel=\"nofollow noopener\" target=\"_blank\">Ottawa defends Supreme Court submission proposing notwithstanding clause limits<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">The notwithstanding clause is a rarely used provision that allows governments to override certain sections of the Charter for up to five years. It\u2019s a tool Ms. Smith has said was on the table as a \u201clast\u201d resort regarding the government\u2019s transgender health restrictions.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Ms. Smith also expressed faith the law could withstand a Charter challenge.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cWe\u2019re going to argue that we\u2019re being reasonable, proportionate and evidence-based, and we\u2019ll see how it goes in court,\u201d Ms. Smith said last December.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Meanwhile, the legal challenges continue to work their way through the courts.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The law prohibiting doctors from providing gender-affirming treatment such as puberty blockers and hormone therapy for youth under 16 isn\u2019t yet in effect because of a temporary court injunction issued in June. Alberta <a href=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-government-transgender-healthcare-law-appeal-injunction\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-government-transgender-healthcare-law-appeal-injunction\/\">appealed the injunction<\/a> in August.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The education law came into effect at the start of this school year. It requires students under 16 to have parental consent to change their names or pronouns in school. Those ages 16 and 17 don\u2019t need consent, but their parents have to be notified.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The third law, which is in effect, blocks transgender athletes 12 and older from competing in female amateur sports in Alberta. Shortly after the school year started, some school divisions sent eligibility forms to parents asking them to confirm their children were assigned female at birth so they can compete on girls teams.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Earlier this week, Ms. Smith directed Sport Minister Andrew Boitchenko to use all \u201clegal and constitutional means necessary\u201d to ensure the sports law is implemented in full.<\/p>\n<p class=\"c-article-body__text text-pr-5\"><a href=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/\">Alberta<\/a> is not alone in invoking the notwithstanding clause.<\/p>\n<p class=\"c-article-body__text text-pr-5\"><a href=\"https:\/\/www.theglobeandmail.com\/canada\/saskatchewan\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/saskatchewan\/\">Saskatchewan<\/a> Premier <a href=\"https:\/\/www.theglobeandmail.com\/topics\/scott-moe\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/topics\/scott-moe\/\">Scott Moe\u2019s<\/a> government used the clause in 2023 in its similar school pronoun law, which is also being challenged.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Last month, a Saskatchewan court ruled the notwithstanding clause prevents it from striking down that pronoun legislation. However, the judges said the use of the clause doesn\u2019t prevent them from issuing a declaratory ruling on whether the law violates constitutional rights.<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/canada\/article-saskatchewan-notwithstanding-bill-21-supreme-court-hearing\/\" rel=\"nofollow noopener\" target=\"_blank\">Saskatchewan requests notwithstanding case to be folded into Bill 21 Supreme Court hearing<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">Earlier this week, Alberta also filed arguments as part of a landmark Supreme Court of Canada case on <a href=\"https:\/\/www.theglobeandmail.com\/canada\/article-supreme-court-pressure-allow-intervenors-in-person-bill-21-hearing\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/article-supreme-court-pressure-allow-intervenors-in-person-bill-21-hearing\/\">Quebec\u2019s secularism law<\/a>.
