{"id":240392,"date":"2025-09-20T02:30:10","date_gmt":"2025-09-20T02:30:10","guid":{"rendered":"https:\/\/www.europesays.com\/us\/240392\/"},"modified":"2025-09-20T02:30:10","modified_gmt":"2025-09-20T02:30:10","slug":"new-york-dispatch-terrorism-charges-dismissed-against-luigi-mangione-in-alleged-killing-of-unitedhealthcare-ceo-jurist","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/240392\/","title":{"rendered":"New York dispatch: terrorism charges dismissed against Luigi Mangione in alleged killing of UnitedHealthcare CEO &#8211; JURIST"},"content":{"rendered":"<p style=\"text-align: center\" data-start=\"135\" data-end=\"300\"><strong>Courtroom Developments in the Luigi Mangione Hearing<\/strong><\/p>\n<p data-start=\"135\" data-end=\"300\">The New York State case against Luigi Mangione, accused of fatally <a href=\"https:\/\/manhattanda.org\/wp-content\/uploads\/2024\/12\/Mangione-Indictment-FINAL-as-filed.pdf\" rel=\"nofollow noopener\" target=\"_blank\">shooting<\/a> UnitedHealthcare CEO Brian Thompson in December 2024, saw a major development on Tuesday.<\/p>\n<p data-start=\"302\" data-end=\"557\">Shortly after proceedings began, the court <a href=\"https:\/\/cdn.sanity.io\/files\/detu0qji\/production\/e5f726ad453726cf803c27821c3c0fd4c4adde84.pdf\" rel=\"nofollow noopener\" target=\"_blank\">granted<\/a> Mangione\u2019s <a href=\"https:\/\/cdn.sanity.io\/files\/detu0qji\/production\/1b9e211bd3c7770699b4244c4e9bc5074498ee82.pdf\" rel=\"nofollow noopener\" target=\"_blank\">motion to dismiss<\/a> two terrorism-related charges: first-degree murder as an act of terrorism and second-degree murder as an act of terrorism. The sudden ruling quickly prompted cheers outside the courthouse. Judge Carro called the terrorism counts \u201clegally insufficient,\u201d <a href=\"https:\/\/cdn.sanity.io\/files\/detu0qji\/production\/e5f726ad453726cf803c27821c3c0fd4c4adde84.pdf\" rel=\"nofollow noopener\" target=\"_blank\">noting<\/a>, \u201c[t]here was no evidence presented that the defendant made any demands of government or sought any particular governmental policy change, let alone that he did so by intimidation or coercion.\u201d<\/p>\n<p data-start=\"827\" data-end=\"1435\">With the terrorism charges dismissed, Mangione is no longer <a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/PEN\/490.05\" rel=\"nofollow noopener\" target=\"_blank\">eligible<\/a> for life without parole under New York law. The <a href=\"https:\/\/manhattanda.org\/wp-content\/uploads\/2024\/12\/Mangione-Indictment-FINAL-as-filed.pdf\" rel=\"nofollow noopener\" target=\"_blank\">remaining charges<\/a> still stand, including a second-degree murder count carrying <a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/PEN\/70.00\" rel=\"nofollow noopener\" target=\"_blank\">25 years to life<\/a>, along with multiple weapons offenses. New York is unusual in <a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/PEN\/125.25\" rel=\"nofollow noopener\" target=\"_blank\">treating<\/a> intentional, premeditated killings as second-degree murder, whereas most other US jurisdictions classify such killings as first-degree\u2014unless an aggravating factor elevates the charge, as was previously the case here with the terrorism counts, or in exceptional situations such as the killing of a police officer.<\/p>\n<p data-start=\"827\" data-end=\"1435\">Having dropped the terrorism charges, Judge Carro rejected Mangione\u2019s request to pause his New York state case under the <a href=\"https:\/\/www.law.cornell.edu\/constitution-conan\/amendment-5\/dual-sovereignty-doctrine\" rel=\"nofollow noopener\" target=\"_blank\">Dual Sovereignty Doctrine<\/a>, turning down <a href=\"https:\/\/cdn.sanity.io\/files\/detu0qji\/production\/1b9e211bd3c7770699b4244c4e9bc5074498ee82.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Mangione\u2019s argument<\/a> that the <a href=\"https:\/\/www.law.cornell.edu\/wex\/double_jeopardy\" rel=\"nofollow noopener\" target=\"_blank\">Double Jeopardy<\/a> rule prevents him from being tried for the same crime in both state and federal courts. While the Fifth Amendment\u2019s Double Jeopardy rule prevents someone from being tried for the same crime twice, the dual sovereignty rule makes this inapplicable, allowing other jurisdictions to prosecute the same act.<\/p>\n<p data-start=\"827\" data-end=\"1435\">In Tuesday\u2019s hearing, Judge Carro also <a href=\"https:\/\/cdn.sanity.io\/files\/detu0qji\/production\/1df689d773d976dc3060b9613102f236b8ceec24.pdf\" rel=\"nofollow noopener\" target=\"_blank\">blocked<\/a> prosecutors from using 120 pages of Mangione\u2019s health records they had subpoenaed from his health insurance company, Aetna. The judge declined to decide whether the subpoenaed health records had violated Mangione\u2019s privacy rights under the <a class=\"DTlJ6d\" href=\"https:\/\/www.cdc.gov\/phlp\/php\/resources\/health-insurance-portability-and-accountability-act-of-1996-hipaa.html\" target=\"_blank\" rel=\"noopener nofollow\" data-hveid=\"CA4QAQ\">Health Insurance Portability and Accountability Act<\/a> (HIPAA).<\/p>\n<p>The Manhattan District Attorney\u2019s Office issued a brief statement on the Court\u2019s ruling: \u201cWe respect the Court\u2019s decision and will proceed on the remaining nine counts, including Murder in the Second Degree\u2026.\u201d<\/p>\n<p style=\"text-align: center\"><strong>Courtroom Observations\u00a0<\/strong><\/p>\n<p>The day of Mangione\u2019s hearing, 24 members of the public were allowed into the courtroom. Inside, spectators were ushered into three pews in the back. Before me stood attorneys Jacob Kaplan, Karen Friedman-Agnifilo, and Marc Agnifilo. They stood near the defense table, thumbing through papers and conversing softly, occasionally cracking a few smiles within the private triangle they\u2019d formed. I quietly marveled at the staggering amount of legal prowess in that courtroom. Regardless of your views on Mangione, you have to admit that he has a lethal legal team.<\/p>\n<p>Mangione soon entered the courtroom wearing a tan prison jumpsuit, paired with a cream-colored long-sleeve shirt and a maroon shirt layered underneath. His outfit stood in stark contrast to his state December and February hearings when he <a href=\"https:\/\/www.yahoo.com\/lifestyle\/luigi-mangione-merchandise-gains-popularity-234700157.html\" rel=\"nofollow noopener\" target=\"_blank\">appeared<\/a> in civilian clothing. The defense legal team has been reached for comment regarding the discrepancy.<\/p>\n<p>His demeanor was somber yet calm as he entered and left the courtroom, his face noticeably pale, wrists and ankles shackled.<\/p>\n<p>Throughout the hearing, Mangione mostly kept his head down, and he appeared to be taking notes in his lap while restrained by a front-facing shackle belt. Occasionally, he would raise his head only to lower it again with feverish focus.<\/p>\n<p style=\"text-align: center\"><strong>Legal Background<\/strong><\/p>\n<p>Mangione had <a href=\"https:\/\/www.jurist.org\/news\/2024\/12\/luigi-mangione-pleads-not-guilty-in-the-murder-of-us-health-insurance-company-ceo\/\" rel=\"nofollow noopener\" target=\"_blank\">pleaded<\/a> not guilty to all charges in December 2024. In addition to the New York state charges, he\u00a0is also facing a federal <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.640793\/gov.uscourts.nysd.640793.22.0_1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">indictment<\/a> in <a href=\"https:\/\/www.courtlistener.com\/docket\/69908890\/united-states-v-mangione\/\" rel=\"nofollow noopener\" target=\"_blank\">United States v. Luigi Nicholas Mangione<\/a>, charged with interstate stalking and murder using a firearm equipped with a suppressor. He faces the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.640793\/gov.uscourts.nysd.640793.25.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">death penalty<\/a> for the firearm-related murder charge and has <a href=\"https:\/\/www.courtlistener.com\/docket\/69908890\/united-states-v-mangione\/\" rel=\"nofollow noopener\" target=\"_blank\">pleaded not guilty<\/a> to all federal counts.<\/p>\n<p>In Pennsylvania, he was <a href=\"https:\/\/www.pacourts.us\/Storage\/media\/pdfs\/20241209\/233900-mangione12924.pdf\" rel=\"nofollow noopener\" target=\"_blank\">charged<\/a> with carrying an unlicensed firearm, forgery, and giving false identification information to a police officer. State officials say that Mangione carried a 3-D printed ghost gun, equipped with a loaded Glock magazine holding six 9-mm full metal jacket rounds, in addition to a separate 9-mm hollow point round. He has <a href=\"https:\/\/abcnews.go.com\/US\/luigi-mangiones-pennsylvania-attorney-argues-search-arrest-illegal\/story?id=119312837\" rel=\"nofollow noopener\" target=\"_blank\">pleaded<\/a> not guilty to all Pennsylvania charges.<\/p>\n<p style=\"text-align: center\"><strong>Public Response<\/strong><\/p>\n<p>After adjournment, the grinning defense team held a brief press conference outside in front of the courthouse while the crowd chanted \u201cFree Luigi!\u201d in the background. After a long pause, Karen Friedman-Agnifilo stated, \u201cthanks for coming, everyone.\u201d<\/p>\n<p>I then made my way into the crowd, where supporters linked Mangione\u2019s case to broader concerns over healthcare affordability, judicial overreach, and constitutional rights. Demonstrators held signs reading \u201cFree Luigi!\u201d and chanted, \u201cOne struggle, one fight, healthcare is a human right!\u201d When I asked one unnamed individual why they attended the hearing, they said, \u201cmy friend died from healthcare denials\u2026and my family struggled financially [when I was] growing up.\u201d<\/p>\n<p>A New York University (NYU) student, Mason Alexander, present at the rally explained that it would be, \u201c\u2026hard to find jurors who haven\u2019t been affected by healthcare denials, or don\u2019t know someone who has.\u201d I then asked him, \u201cWhat do you think about those that say violence isn\u2019t the answer?\u201d Alexander replied that while he does not condone violence, he acknowledges that it coexists alongside his concern for the broader societal issues at issue. He shared that his mother, who suffered from a spinal cyst, often delayed seeking healthcare because of exceptionally high costs. He recounted his mother and father sitting in the hospital parking lot, waiting \u201cfor it to get unbearably bad\u201d before going inside to avoid high treatment costs.<\/p>\n<p>Breigh, a woman holding a life-sized cardboard cutout of Mangione on which \u201cSTILL PRESUMED INNOCENT\u201d was written, explained that she attended the rally because of her dissatisfaction with judicial prejudice and healthcare. \u201cI want to bring light to the injustices of the healthcare system, the ways in which it is affecting everyday Americans,\u201d she stated. She further denounced how Mangione was being \u201ctreated as guilty before [being tried in] court,\u201d hence her cutout\u2019s message.<\/p>\n<p>Volunteers distributed a supporter-led newspaper, called <a href=\"https:\/\/www.instagram.com\/theplotnews\/\" rel=\"nofollow noopener\" target=\"_blank\">The Plot<\/a>, to crowd members. The newspaper contained case updates, legal analysis, and commentary on healthcare struggles and judicial injustice. One volunteer explained that the publication was created in response to a perceived media bias against Mangione.<\/p>\n<p>\u201cThe media sensationalized [coverage] and defamed him to sell clicks,\u201d they lamented. \u201cThey wouldn\u2019t give him fair coverage, so we made our own.\u201d<\/p>\n<p>Another volunteer stated, \u201cpersonally, when I joined [the volunteers\u2019 newspaper], I was more frustrated with speech suppression. I had four Twitter accounts taken down [for posting about the case]. I had posts deleted from Reddit time and time again. I know people who\u2019ve been banned from TikTok, [X], and Reddit for sharing their opinions on the case\u2026this was our only way of giving these writers their voice back.\u201d<\/p>\n<p>Shortly after I left the rally, I read several mainstream news articles focused on one rally-goer who claimed to be in a relationship with \u201c<a href=\"https:\/\/nypost.com\/2025\/09\/16\/us-news\/luigi-mangione-fan-claims-she-married-ai-version-of-accused-ceo-killer\/\" rel=\"nofollow noopener\" target=\"_blank\">AI Luigi<\/a>.\u201d It was unclear what this meant.<\/p>\n<p>Most crowd members eagerly volunteered their perspectives on societal equality and shared stories of lost and suffering loved ones. I was quite surprised by the lack of frivolous remarks. I suddenly remembered the large seating divide between the press and public in the courtroom. Perhaps that had been a physical representation of our synergies outside of it as well.<\/p>\n<p style=\"text-align: center\"><strong>New York prepares for Mangione\u2019s hearing<\/strong><\/p>\n<p>On the evening of September 14th, light projections illuminated the buildings of Lower Manhattan, highlighting fatalities related to healthcare denials. Messages included: \u201c2,996 Americans died on 9\/11\u201d; \u201c68,000+ Americans die EVERY YEAR from lack of affordable healthcare\u201d; and \u201cProfit kills. People pay the price.\u201d Organizers People Over Profit NYC and The Illuminator told JURIST the projections were intended to draw attention to the hearing.<\/p>\n<p>In a statement to JURIST, project organizers <a href=\"https:\/\/popnyc.org\/home\" rel=\"nofollow noopener\" target=\"_blank\">People Over Profit NYC<\/a> and <a href=\"https:\/\/theilluminator.org\/\" rel=\"nofollow noopener\" target=\"_blank\">The Illuminator<\/a> wrote:<\/p>\n<blockquote>\n<p>[t]he unprecedented rush by the federal government to end the life of Mangione is a spectacle in itself, but the larger body count piles higher with every passing day and deserves notice\u2026Over 26 million people in this country are uninsured, and millions more cannot afford to use the health insurance they have\u2026<\/p>\n<\/blockquote>\n<p>Supporters began lining up for the public hearing at 3:30 AM on Monday; by 6:30 AM, 24 people had secured the maximum number of public seats. The press and public formed separate lines across the court plaza, with reporters noting that Mangione\u2019s hearings drew larger crowds than Trump\u2019s trials. TMZ released a <a href=\"https:\/\/www.imdb.com\/title\/tt35816740\/reviews\/\" rel=\"nofollow noopener\" target=\"_blank\">documentary<\/a>, \u201c<a href=\"https:\/\/tv.apple.com\/us\/show\/tmz-investigates-luigi-mangione-the-mind-of-a-killer\/umc.cmc.3z4rlzs1f8m0niax7ttadpld5\" rel=\"nofollow noopener\" target=\"_blank\">Luigi Mangione: The Mind of a Killer<\/a>,\u201d shortly after Mangione\u2019s incarceration, prompting supporter criticism for presumption of guilt.<\/p>\n<p style=\"text-align: center\"><strong>What Happens Next<\/strong><\/p>\n<p data-start=\"144\" data-end=\"252\">Following a sidebar, Judge Carro scheduled the next hearing for December 1. A trial date has not been set.<\/p>\n<p data-start=\"254\" data-end=\"653\">While the dismissal of terrorism charges marks the first official recognition of overcharging in Mangione\u2019s legal proceedings, several legal experts had previously <a href=\"https:\/\/nypost.com\/2024\/12\/18\/us-news\/luigi-mangione-returns-to-nyc-thursday-faces-first-degree-murder-charge-in-unitedheathcare-ceo-shooting\/\" rel=\"nofollow noopener\" target=\"_blank\">expressed<\/a> skepticism over the validity of those charges. Veteran defense attorney Ron Kuby <a href=\"https:\/\/nypost.com\/2024\/12\/18\/us-news\/luigi-mangione-returns-to-nyc-thursday-faces-first-degree-murder-charge-in-unitedheathcare-ceo-shooting\/\" rel=\"nofollow noopener\" target=\"_blank\">told<\/a> the New York Post last year that Manhattan District Attorney Alvin Bragg was \u201cwildly overcharging\u201d Mangione to \u201cmake a great headline.\u201d<\/p>\n<p data-start=\"655\" data-end=\"870\">Tuesday\u2019s ruling may also prove a latent win for the prosecution, as it no longer needs to prove Mangione\u2019s intent to intimidate or coerce others for ideological reasons\u2014a high bar under New York\u2019s <a href=\"https:\/\/www.nycourts.gov\/judges\/cji\/2-PenalLaw\/490\/490.25.pdf\" rel=\"nofollow noopener\" target=\"_blank\">terrorism statute<\/a>.<\/p>\n<p data-start=\"872\" data-end=\"1393\">Attention now turns to Mangione\u2019s federal case, where he has <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.633812\/gov.uscourts.nysd.633812.16.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">moved<\/a> to preclude the government from seeking the <a href=\"https:\/\/www.jurist.org\/news\/2025\/04\/us-federal-prosecutors-to-seek-death-penalty-in-healthcare-executive-murder-case\/\" rel=\"nofollow noopener\" target=\"_blank\">death penalty<\/a>, citing further concerns of overcharging. The motion called the decision to pursue the death penalty \u201cpolitical, arbitrary, capricious, a breach of established death penalty protocol\u2026\u201d According to the motion, this was particularly demonstrated when Attorney General Pam Bondi stated in a <a href=\"https:\/\/www.facebook.com\/watch\/?v=672899485221131\" rel=\"nofollow noopener\" target=\"_blank\">Fox News interview<\/a> that she opted to pursue the death penalty via press release because \u201c[Mangione] is charged with hunting down a CEO, a father of two, a married man.\u201d<\/p>\n<p data-start=\"1395\" data-end=\"1916\">Mangione also argued in his motion that Bondi unusually issued her directive for the Department of Justice to seek the death penalty before his indictment, calling it \u201cevidence of the political and arbitrary nature of this decision.\u201d Many legal experts have suggested that the federal death penalty application is political in nature. Executive Director of the Death Penalty Information Center, Robin Maher, <a href=\"https:\/\/www.opb.org\/article\/2025\/04\/25\/mangiones-case-marks-a-shift-on-the-death-penalty-in-the-u-s\/\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a> the decision that it \u201c\u2026suggests that the death penalty is being used here to achieve some sort of political purpose.\u201d<\/p>\n<p data-start=\"1918\" data-end=\"2522\">From my discussions with judges and lawyers about Mangione\u2019s death penalty decision, the common denominator has been that the move was likely political. Simply put, this should have been a straightforward state-level murder case, but it was stretched into a federal one to bring the death penalty into play and enhance the charges. The legally dubious move effectively forces the defendant to face either <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/3594\" rel=\"nofollow noopener\" target=\"_blank\">death by lethal injection<\/a> or life without parole if convicted. The former is extremely unlikely, given that juries in New York federal courts are notoriously <a href=\"https:\/\/deathpenaltyinfo.org\/state-and-federal-info\/state-by-state\/new-york\" rel=\"nofollow noopener\" target=\"_blank\">reluctant<\/a> to impose capital punishment.<\/p>\n<p data-start=\"2524\" data-end=\"2855\">The latter\u2014a sentence of life without parole\u2014is itself a form of torture, particularly for someone who is reportedly <a href=\"https:\/\/www.rollingstone.com\/culture\/culture-features\/luigi-mangione-spinal-condition-spondylolisthesis-patients-1235202813\/\" rel=\"nofollow noopener\" target=\"_blank\">disabled<\/a> and, if true, will likely not receive the medical care they increasingly need with age. As the <a href=\"https:\/\/prisonjournalismproject.org\/2022\/09\/21\/life-without-parole-is-americas-hidden-death-penalty\/\" rel=\"nofollow noopener\" target=\"_blank\">adage<\/a> goes, life without parole is a death sentence\u2014but in this case, a slow, excruciating one for Mangione.<\/p>\n<p data-start=\"2857\" data-end=\"3063\">In other words, is torturing someone through a lifetime of nonstop pain a valid judicial sacrifice for political gain? I think not.
