A U.S. District Court for the District of Columbia judge June 27 ruled<\/a> against Johnson & Johnson and sided with the Department of Health and Human Services and hospitals in a lawsuit brought by J&J challenging the government\u2019s authority to reject J&J\u2019s proposed 340B rebate model.\u00a0<\/p>\n

\u201cIn sum, based on the plain and unambiguous language of the 340B statute, and supported by its purpose and history, HRSA has the authority to \u2018provide\u2019 for discounts, rebates, or both,\u201d Judge Rudolph Contreras wrote. \u201cThis conclusion defeats J&J\u2019s claim that HRSA lacked the authority to require prior approval of J&J\u2019s rebate model.\u201d<\/p>\n

The AHA in a friend-of-the-court brief<\/a> urged the court to uphold the government\u2019s decision to reject J&J\u2019s proposed 340B rebate model. Others joining the AHA in the filing were the Children\u2019s Hospital Association, the Association of American Medical Colleges and America\u2019s Essential Hospitals.<\/p>\n
