A man accused of being involved in the gang rape of a 17-year-old girl has been granted bail.<\/p>\n
Adam Abdul-Hamid, 19, was one of two men and two boys charged in June over the alleged sexual assault that took place over several hours<\/a> in Sydney’s south-west in December last year.<\/p>\n The girl was approached by one of his co-accused \u2014 a 16-year-old boy who was not known to her \u2014 at a Liverpool shopping centre.<\/p>\n WARNING: This story contains details readers may find distressing.<\/strong><\/p>\n Sexual assault\u00a0support lines:<\/p>\n According to police, the girl reluctantly let the 16-year-old inside her car, where he video-called his co-accused while sexually assaulting her.<\/p>\n The 16-year-old then allegedly refused to leave her car but promised to do so if she drove him to Wheat Park in nearby Sadleir.<\/p>\n Upon reaching the park, two other males allegedly got into the vehicle and sexually assaulted the girl.<\/p>\n A fourth male drove to the scene in another car and allegedly entered the victim’s car with the other three.<\/p>\n According to police, they then drove the victim’s car “erratically” around Sadleir and Miller while continuing to assault her.<\/p>\n Detective Superintendent Jayne Doherty alleged in June this year that the group “encouraged each other” during the assault.<\/p>\n Justice Hament Dhanji told the court the girl was allegedly sexually assaulted by various members of the co-accused across five distinct episodes.<\/p>\n “It is sufficient to observe it makes for difficult reading,”<\/p><\/blockquote>\n Justice Dhanji said.<\/p>\n Justice Dhanji told the court Mr Abdul-Hamid was not present at the first, fourth or fifth alleged episodes.<\/p>\n He told the court it appeared the third episode was the crown’s strongest case.<\/p>\n “The crown case might be regarded as strong regarding inferences that could be drawn that the party was present at the scene and encouraging principal offenders,” Justice Dhanji said.<\/p>\n The court heard Mr Abdul-Hamid could have been filming some of the alleged sexual assaults on his phone.<\/p>\n Justice Dhanji said the complainant was allegedly being sexually assaulted at the time.<\/p>\n The court also heard allegations that the complainant might have been contacted by a phone number connected to Mr Abdul-Hamid.<\/p>\n Complicity a key part of crown case<\/p>\n The court heard Mr Abdul-Hamid, who appeared via videolink, had been on remand since his arrest more than three months ago.<\/p>\n “The applicant’s role in the third matter, where he is not suggested to have either instigated or actively participated in the alleged offending, that in itself is significant in assessing risk [bail risk] in the context of the applicant’s young age and no prior criminal record,” Justice Dhanji said.<\/p>\n However, Justice Dhanji said complicity was a key part of the crown’s case.<\/p>\n “Liability is said to be by the way of complicity, making him responsible for the acts of others, with participation in a joint criminal enterprise,” the judge said.\u00a0<\/p>\n He said if bailed was refused, the applicant will be in custody for “a significant time”.<\/p>\n “Clearly of concern given the applicant is unlikely to be tried until 2027 and should he remain in custody, that will be a substantial period of time to spend in jail not convicted of a criminal offence,” Justice Dhanji said.<\/p>\n Mr Abdul-Hamid was released into the custody of his mother and to reside in home detention in the family home, reporting daily to police.<\/p>\n The 19-year-old was also given permission to work during business hours in a barber shop, near the Liverpool shopping centre in question, but is not allowed to enter the shopping centre.<\/p>\n No pleas were entered and the matter it was scheduled to return to court next
