{"id":257985,"date":"2025-09-27T05:49:10","date_gmt":"2025-09-27T05:49:10","guid":{"rendered":"https:\/\/www.europesays.com\/us\/257985\/"},"modified":"2025-09-27T05:49:10","modified_gmt":"2025-09-27T05:49:10","slug":"diddy-judge-appears-to-be-considering-vacating-his-convictions","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/257985\/","title":{"rendered":"Diddy Judge Appears to Be Considering Vacating His Convictions"},"content":{"rendered":"<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tThe federal judge overseeing Sean \u201c<a href=\"https:\/\/www.hollywoodreporter.com\/t\/diddy\/\" id=\"auto-tag_diddy_1\" data-tag=\"diddy\" rel=\"nofollow noopener\" target=\"_blank\">Diddy<\/a>\u201d Combs\u2019 imminent sentencing on the two lesser counts a jury found him guilty of in the <a href=\"https:\/\/www.hollywoodreporter.com\/news\/general-news\/diddy-verdict-split-not-guilty-racketeering-sex-trafficking-1236302562\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">split verdict<\/a> at his sensational racketeering and sex trafficking <a href=\"https:\/\/www.hollywoodreporter.com\/news\/general-news\/diddy-trial-sean-combs-new-media-guard-takes-over-1236292117\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">trial<\/a> over the summer is now weighing the argument from the mogul\u2019s defense team that his conviction should be vacated if he must have a new trial.\u00a0<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tOn Thursday, just over a week before Combs, 55, is scheduled for sentencing after he was found guilty of two counts of transportation to engage in prostitution, Judge Arun Subramanian told the court that he would issue a decision \u201cvery shortly\u201d on the defense\u2019s argument about Combs\u2019 crimes and their relation to the Mann Act. Otherwise, Subramanian said, he would \u201csee everyone back here next Friday.\u201d<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tOn Friday, the courts closed for the weekend with no announcement from Judge Subramanian on his decision. <\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tThe high-profile legal team that oversaw Combs\u2019 defense at the eight-week federal trial, which ended with him found not guilty on much weightier sex trafficking and racketeering charges, argued for a narrow interpretation of what constitutes prostitution in terms of the Mann Act in Combs\u2019 case. The legal precedent says that only those who engaged in the sexual acts or benefited financially from prostitution are criminally liable.\u00a0<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tCombs did not gain any profit, his lawyers explain, when hiring male sex workers that he had at least two long-term girlfriends of his over the past two decades engage in \u201c<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.hollywoodreporter.com\/news\/general-news\/cassie-ventura-testimony-freak-offs-sean-diddy-combs-trial-1236216061\/\">freak-off<\/a>\u201d parties \u2014 drug-fueled parties that could last for days and mostly involved Combs\u2019 partner engaging with the male prostitutes in sex acts as he looked on \u2014 with them. His attorneys also argue that Combs didn\u2019t even participate in the sex acts.\u00a0<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tAt\u00a0Combs\u2019 trial, evidence was presented that he and the two partners had hired the sex workers, but it was all funded by the near-billionaire mogul.\u00a0<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tThe Mann Act criminalizes the transport of a person across state lines for the purpose of prostitution. Whether this should apply to voyeurism, defense attorney Mark Tack said, is at the center of Combs\u2019 case at this point. He told the court it does not. Prosecutor Meredith Foster told the court that this is beside the point, as Combs had hired the men and paid for their fights and those taken by the two long-term girlfriends.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tThe defense team is also making the case that, because Combs would film the freak-off events as he directed the action taking place, lighting, music and wardrobe were all under his purview, as was stated in trial testimony \u2014 his freedom of expression rights would be violated if the Mann Act is to be enforced.\u00a0<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tFederal prosecutor Christy Slavik, in refuting this argument, told the court that the Mann Act criminalizes transportation of individuals for prostitution, and \u201cit does not criminalize filming sex acts of any kind.\u201d<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n\tIn a <a href=\"https:\/\/www.hollywoodreporter.com\/news\/general-news\/diddy-legal-team-asks-judge-immediate-release-sentencing-1236378224\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">sentencing motion<\/a> submitted this week, defense attorneys argued that Combs should be handed no more than 14 months for the two counts. Given the time he\u2019s been serving in a Brooklyn federal lock-up since September 2024, this would see the fallen rap world kingpin back at home in November.
