{"id":258331,"date":"2025-09-27T08:58:12","date_gmt":"2025-09-27T08:58:12","guid":{"rendered":"https:\/\/www.europesays.com\/us\/258331\/"},"modified":"2025-09-27T08:58:12","modified_gmt":"2025-09-27T08:58:12","slug":"clive-palmer-ordered-to-pay-more-than-13-million-after-foreign-investor-claim-dismissed","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/258331\/","title":{"rendered":"Clive Palmer ordered to pay more than $13 million after foreign investor claim dismissed"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">Mining billionaire Clive Palmer has been ordered to pay more than $13 million after an international tribunal dismissed his claim of being a foreign investor.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The dispute focused on Western Australian government legislation in 2020, which <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2020-08-11\/clive-palmer-sues-wa-government-for-30-billion-over-iron-ore\/12547664\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/12547664\" target=\"_blank\" rel=\"noopener\">impeded his ability to pursue $30 billion<\/a> in damages against the Western Australian government.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The case related to the government&#8217;s initial refusal in 2012 to allow him to develop the Balmoral South iron ore project in the Pilbara region.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Mr Palmer claimed the law change was &#8220;targeted, weaponised legislation of an unprecedented nature&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">He claimed his financial losses were compounded because he was then unable to sell the project to a Chinese company.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In 2021, <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2021-10-13\/clive-palmer-loses-battle-against-state-of-western-australia\/100534312\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/100534312\" target=\"_blank\" rel=\"noopener\">the High Court ruled unanimously<\/a> that the law passed by the WA government to prevent Mr Palmer from suing it was valid.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Having exhausted legal challenge options in Australia, Mr Palmer still had other options under international law.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The claim was brought before the Permanent Court of Arbitration, which is an intergovernmental organisation, by Singaporean company Zeph Investments, which is owned by Mr Palmer.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Mr Palmer sought $300 billion from the Commonwealth in damages.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The case against the Commonwealth argued breaches of the ASEAN-Australia-New Zealand free trade agreement.<\/p>\n<p><img decoding=\"async\" alt=\"Michelle Rowland press conference\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/09\/05c056fe572d9f31209a07124fce2371\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Michelle Rowland has welcomed the international tribunal&#8217;s decision.\u00a0 (ABC News: Matt Roberts)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Attorney-General Michelle Rowland said the international tribunal had rejected Mr Palmer&#8217;s claim against Australia, finding it had no jurisdiction over the dispute.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">She said he had been ordered to pay Australia&#8217;s costs of $13.6 million.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Mr Palmer is not a &#8216;foreign investor&#8217; and is not entitled to any benefits under Australia&#8217;s free trade and investment agreements,&#8221; Ms Rowland said.<\/p>\n<p>Decision welcomed by governments<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Ms Rowland welcomed the decision, saying the government had &#8220;vigorously defended this claim from the outset&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">She said she hoped the decision would see Mr Palmer withdraw remaining international claims against Australia, but that the government would continue to defend them.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Ms Rowland said the government should never have had to spend over $13 million defending the claim.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;The Albanese government remains committed to actively engaging in processes to remove or reform existing investor-State dispute settlement mechanisms.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In a social media post, Western Australian Premier Roger Cook said the case against Western Australia would have &#8220;bankrupted&#8221; the state if successful.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I trust this decision will finally close the book on this long-running saga,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Senior WA minister Reece Whitby welcomed the tribunal&#8217;s decision, saying he believed the matter should now be closed.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;A $300 billion claim has now been determined that there is no case,&#8221; Mr Whitby said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;These are mind-blowing numbers, and I think the tribunal has made a very correct decision that there is no case to proceed further.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">He said Mr Palmer&#8217;s initial action against the WA government seeking compensation for the rejection of the Balmoral South mine development, a claim of close to $30 billion, at the time threatened to bankrupt the state.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It points to the fact that we&#8217;ll always defend Western Australia, we&#8217;ll always stand up for taxpayers of this state and for our economy,&#8221; Mr Whitby said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">A response from Mr Palmer&#8217;s office said he would review the judgement.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It is understood he can still seek to challenge the decision through the Federal Supreme Court of Switzerland.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">University of Western Australia International Law expert Alvin Yap said the decision was not surprising given the way modern treaties were structured.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;In older generations of investment treaties, there was a concern that an investor could set up a shell company in the foreign jurisdiction and thereby qualify as a foreign investor on those treaties, and thereby enjoy the protection that is supposed to be granted to foreign investors,&#8221;
