\n\tFilming from Brooklyn this week,<\/a> the sharp-tongued Kimmel\u2019s been back on ABC\u2019s airwaves since September 23<\/a> after a weeklong MAGA-induced benching<\/a>. However, for all the renewed attention on the outspoken and well-spoken late-nighter and his upcoming East Coast guests including Ryan Reynolds<\/a>, Stephen Colbert<\/a>, Spike Lee, Emily Blunt and Bruce Springsteen, the real Jimmy Kimmel Live<\/a>! action, or lack thereof, is in Burbank today.<\/p>\n

\n\tAs of Monday evening, \u201cthe books and records\u201d over possible \u201cimproper political or affiliate considerations\u201d that Roberta Kaplan and other lawyers for Disney shareholders the American Federation of Teachers, the AFL-CIO and Reporters Without Borders asked for on September 24 in a terse letter to the CEO<\/a> have not shown up. The shareholders are calling out the company\u2019s C-suites as responsible for \u201csignificant declines\u201d (aka $4 billion fall) in the company\u2019s stock in the blast radius of Kimmel going dark after the FCC chair started tossing his weight around<\/a> about remarks the long-serving late-night host made about Trump and MAGA\u2019s reaction to the fatal shooting of Charlie Kirk (watch his Kimmels comments here<\/a>).<\/p>\n

\n\tNow money \u2014 specifically $4 billion \u2014 may talk, but, despite laying out that the company \u201ccontact us promptly to confirm that Disney will permit AFT and RWB to inspect and copy what is being demanded, and to confirm the logistical details of that inspection,\u201d it seems to have been radio silence from Burbank so far.<\/p>\n

\n\t\u201cThis is a game of chicken, with someone getting out the way only at the last minute,\u201d an insider told Deadline today of Disney\u2019s tactics. \u201cThey know the stakes.\u201d <\/p>\n

\n\tFamous for her takedown of Donald Trump<\/a> in E. Jean Carroll\u2019s suits against the former Apprentice host, the stakes Kaplan gave Iger on September 24 was \u201cwithin five (5) business days of this letter\u201d to hand over the paperwork for \u201cinspection and copying.\u201d Failing that, with expressed concerns \u201cthe Board and executives may have breached their fiduciary duties of loyalty, care, and good faith,\u201d Kaplan and her fellow attorneys say their clients \u201creserve their rights to initiate an action compelling such production and to pursue all available remedies.\u201d<\/p>\n

\n\tCan you say (as the letter of last week actually does) \u201cderivative lawsuit\u201d?<\/p>\n

\n\tReps for shareholders main lawyer Kaplan declined comment today on the state of affairs with Disney and their demands. Disney also did not have a comment Deadline\u2019s request on the documents and other information demand from the shareholders or where the process is at Monday.<\/p>\n

\n\tOf course, even with Kimmel back and back on affiliate owners Sinclair<\/a> and Nexstar<\/a> as of September 26,<\/a> the shareholders\u2019 demand isn\u2019t the only minefield threatening Disney. Having squeezed at least $15 million out of Iger and Disney to make a thin suit over ill-chosen comments by George\u00a0Stephanopoulos\u00a0go away last December, Trump now is back on the warpath with Kimmel\u2019s return.<\/p>\n

\n\t\u201cI think we\u2019re going to test ABC<\/a> out on this,\u201d Trump posted on September 23 <\/a>after Kimmel\u2019s return show was taped but not yet aired. \u201cLet\u2019s see how we do. Last time I went after them, they gave me $16 Million Dollars. This one sounds even more lucrative. A true bunch of losers! Let Jimmy Kimmel rot in his bad Ratings.\u201d<\/p>\n
