{"id":268316,"date":"2025-10-01T04:54:13","date_gmt":"2025-10-01T04:54:13","guid":{"rendered":"https:\/\/www.europesays.com\/us\/268316\/"},"modified":"2025-10-01T04:54:13","modified_gmt":"2025-10-01T04:54:13","slug":"no-new-trial-for-sean-diddy-combs-judge-rules-as-sentencing-looms","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/268316\/","title":{"rendered":"No New Trial For Sean &#8220;Diddy&#8221; Combs, Judge Rules As Sentencing Looms"},"content":{"rendered":"<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tUnless <a href=\"https:\/\/deadline.com\/tag\/donald-trump\/\" id=\"auto-tag_donald-trump\" data-tag=\"donald-trump\" rel=\"nofollow noopener\" target=\"_blank\">Donald Trump<\/a> is finally coming through with<a href=\"https:\/\/deadline.com\/2025\/07\/combs-pardon-trump-seriously-considering-1236468313\/\" rel=\"nofollow noopener\" target=\"_blank\"> that much considered pardon<\/a> for his old pal, there will be no near eleventh-hour reprieve for <a href=\"https:\/\/deadline.com\/tag\/sean-combs\/\" id=\"auto-tag_sean-combs\" data-tag=\"sean-combs\" rel=\"nofollow noopener\" target=\"_blank\">Sean Combs<\/a> ahead of this week\u2019s sentencing in the much-accused \u201cMo Money, Mo Problems\u201d performer\u2019s sex-trafficking case.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\t<strong><a href=\"https:\/\/deadline.com\/wp-content\/uploads\/2025\/09\/combs-no-new-trial-order-sept-30.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Read the judge\u2019s ruling here.<\/a><\/strong><\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tThe government at trial presented overwhelming evidence of Combs\u2019s guilt under the Mann Act on many occasions with respect to both Ventura and Jane,\u201d Judge Arun Subramanian said in an order just posted in the federal docket with reference to both Combs\u2019 ex-girlfriends <a href=\"https:\/\/deadline.com\/tag\/cassie-ventura\/\" id=\"auto-tag_cassie-ventura\" data-tag=\"cassie-ventura\" rel=\"nofollow noopener\" target=\"_blank\">Cassie Ventura<\/a> and the pseudonymed \u201cJane.\u201d In the 16-page opinion and order, the judge noted: \u201cThat evidence consisted of testimony from Ventura and Jane, testimony from the escorts involved, and evidence from text messages and emails. The government proved its case many times over.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tAfter a less than two-hour long hearing on the morning of September 25 in federal court in a wet New York City on the defense\u2019s post-trial motions for a new trial or an acquittal for Combs, Judge Subramanian promised prosecutors, the defendant and his team that he would rule \u201cvery shortly.\u201d \u00a0Having overseen Combs\u2019 often grueling eight-week trial and the July 2 jury verdict of guilty on just <a href=\"https:\/\/deadline.com\/2025\/07\/sean-diddy-combs-verdict-trial-1236447404\/\" rel=\"nofollow noopener\" target=\"_blank\">\u00a0two counts of transportation to engage in prostitution<\/a>, Judge Subramanian pushed the notion of \u201cshortly,\u201d taking over several days to finally hand down his decision.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tWith an appeal set to be made, today\u2019s ruling still now fully clears the way for the long-scheduled October 3 sentencing of the 55-year-old Bad Boy Records founder. As it stands, even with <a href=\"https:\/\/deadline.com\/2025\/09\/as-government-shutdown-looms-donald-trumps-gop-and-democrats-start-the-media-messaging-blame-game-1236566654\/\" rel=\"nofollow noopener\" target=\"_blank\">the almost certain federal government shutdown as of midnight Tuesday<\/a>, the courts are anticipated to stay open and mainly running until at least the end of the week \u2014 so no sentencing delay for <a href=\"https:\/\/deadline.com\/tag\/diddy\/\" id=\"auto-tag_diddy\" data-tag=\"diddy\" rel=\"nofollow noopener\" target=\"_blank\">Diddy<\/a>.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tAlso, if the longer then expected wait for a new trial or acquittal decision raised hopes for the defense, the judge quashed them today. <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\t\u201cThat by itself might be enough to dispose of Combs\u2019s challenge,\u201d he says of the government\u2019s case on the prostitution charges. \u201cBut the other factors don\u2019t do much to help Combs either. He concedes that under the second factor \u2018if the inflammatory evidence would have been admissible anyway on a separate trial for the remaining counts\u201d then his \u2018claim of spillover prejudice likely fails.\u2019 That narrows any factual challenges to evidence unrelated to the Mann Act charges, like arson or forced labor, to give a few examples. But on the first factor, it isn\u2019t at all clear that this evidence worked to incite the jury or prejudice Combs. It weighs heavily that the jury declined to convict him on any of the counts related to that conduct. Had the prejudice indeed been so great, one would expect a jury to convict on the most relevant counts before it could spill over and infect the others.\u201d <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\t\u201cA new trial is not warranted.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tA prison garb wearing Combs was in attendance, last Thursday, his first time back in court since the end of his trial almost three-months ago. Many members of Combs\u2019 family and remaining inner circle were there too. They are all expected to be back in court on Friday for the sentencing hearing.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tFound not guilty this summer by the eight men and four women jury on the sex-trafficking and racketeering charges in a big defeat for the U.S. Attorney\u2019s office of the Southern District of New York, Diddy no longer faces the possibility of life behind bars. The counts Combs was found guilty of carry a maximum sentence of 10 years each, but at this point, no one believes that the Grammy winner is going to serve anything near 20 years once sentenced.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tEarly in the morning of September 30 East Coast time, <a href=\"https:\/\/deadline.com\/2025\/09\/diddy-sentencing-prosecution-recommendation-1236565804\/\" rel=\"nofollow noopener\" target=\"_blank\">the feds filed victims statements and their 164-page sentencing recommendation <\/a>with a suggested 11 years and three months in federal prison for Combs and \u201ca hefty fine\u201d in the significant six-digit range.  <a href=\"https:\/\/deadline.com\/2025\/09\/diddy-release-motion-christmas-1236553894\/\" rel=\"nofollow noopener\" target=\"_blank\">The Marc Agnifilo and Teny Geragos-led defense are bringing a much lighter hand, aiming for 14 months, with time already served.<\/a> The latter circumstance would see Combs, who has been holed up teaching Business courses in Brooklyn\u2019s the Metropolitan Detention Center since his arrest in September 2024, out before Christmas.<\/p>\n<p>\t\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" class=\"c-lazy-image__img lrv-u-background-color-grey-lightest lrv-u-width-100p lrv-u-display-block lrv-u-height-auto\" src=\"https:\/\/deadline.com\/wp-content\/themes\/pmc-deadline-2019\/assets\/public\/lazyload-fallback.jpg\" data-lazy-src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/10\/GettyImages-2151169956.jpg\" alt=\"\" data-lazy- data-lazy- height=\"683\" width=\"1024\"\/><\/p>\n<p>\t\t\t\t\tThe Federal Bureau of Prisons Metropolitan Detention Center in Brooklyn <\/p>\n<p>\t\t\t\t\t\t\t\t\tGetty Images<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tThough it took longer that anticipated, the denial of a new trial and an acquittal for Combs by the judge comes as little surprise. Pointing to Combs\u2019 admitted acts of violence and abuse over the years, Judge Subramanian has repeatedly denied Combs\u2019 $50 million bail pitches \u2013 <a href=\"https:\/\/deadline.com\/2025\/08\/diddy-bail-denied-2-1236478459\/\" rel=\"nofollow noopener\" target=\"_blank\">including two times since the trial ended <\/a>\u2013 as well as other efforts to short circuit the case.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tStill, hoping to shift the case to a First Amendment basis, Combs\u2019 lawyers on September 24 argued that when push comes to shove the drug fueled and paid male escort added \u201cfreak offs\u201d were simply their now sober client producing \u201chighly choreographed\u201d sex tapes with his lovers. Porn videos by any other name that Combs and his girlfriends could watch for their viewing pleasure at a later date, nothing more.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\t\u201cWhat we\u2019re left with is a case about adults who traveled interstate and participated in a threesome,\u201d defense lawyer Alexandra Shapiro\u00a0asserted at the September 25 hearing of the marathon sex sessions. \u201cThe statute should be construed narrowly essentially to only apply to pimping,\u201d she added of the \u201cracist and sexist\u201d originating Mann Act.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tThe feds took another view last week in court, shutting down the Constitution angle.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\t\u201cMs. Ventura was getting punched in the face,\u201d Assistant U.S. Attorney Christy Slavik said of the years long abuse Combs\u2019 then girlfriend Cassie Ventura, who testified for days at the trial, suffered by Combs\u2019 lawyers\u2019 own admission. \u201cJane was getting hit and kicked,\u201d she said of another Combs girlfriend and frequent freak-offs participant. \u201cThe defendant was <a href=\"https:\/\/deadline.com\/2025\/06\/diddy-trial-witness-drug-mule-1236423174\/\" rel=\"nofollow noopener\" target=\"_blank\">providing drugs to all parties.<\/a>\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\t\u201cThe Mann Act criminalizes transportation of individuals for the purpose of prostitution,\u201d AUSA Slavik told the Judge and others in the Chinatown-adjacent Daniel Patrick Moynihan United States Courthouse Thursday. \u201cIt does not criminalize filming sex acts of any kind.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tBefore wrapping things up in court Thursday, Judge Subramanian asked the defense if they would be throwing up any objections on sentencing if their motions were denied. Attorney Shapiro\u00a0said they would not be.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tAlso on September 25, after the hearing was over and done, the judge denied a September 23 defense filing to allow Combs \u201cnon-prison clothing\u201d for the session and this week\u2019s sentencing. \u201cThe application was made the afternoon before the hearing, and it doesn\u2019t explain the basis for a clothing order of this kind outside of the context of a jury trial, whether this has been done in other cases, or whether relevant personnel were consulted and it posed any issues,\u201d he wrote. \u201cThe Court will entertain an application relating to the sentencing proceeding, but it needs to provide some explanation along these lines.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tFriday saw Combs\u2019 team send another letter and attached proposed order to the Judge seeking \u201cnon-prison clothing\u201d for the defendant for the October 3 sentencing hearing. \u201cThe sentencing proceeding holds significant importance for Mr. Combs,\u201d the two-page correspondence from Teny Geragos stated. \u201cHe wishes to appear before the Court, address Your Honor, and allocute in the most dignified and respectful fashion possible.\u201d <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tToday, in a tease of his later motions ruling, Judge Subramanian issued an order that Combs \u201cwill be permitted to receive non-prison clothing at the MDC to wear for his sentencing on October 3, 2025.\u201d As he had during the trial this summer, the Judge got very specific: \u201cHe is permitted to have one button down shirt, one pair of pants, one sweater, and one pair of shoes without laces to wear to court.\u201d <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tEarlier in the week, Combs\u2019 ex-stylist \u00a0Deonte Nash filed a sexual battery and human trafficking civil suit against her much accused and sued ex-boss in LA Superior Court. \u201cNash personally experienced sexual, physical, mental, and emotional abuse at the hands of Defendants during his ten-year employment,\u201d the 37-page complaint alleges. Getting specific, Nash\u2019s action cites \u201cforced tests of loyalty and manipulation, sexual harassment and sexual assaults, physical violence and manhandling, labor trafficking, threats of harm, and threats of death,\u201d the lawsuit against Combs reads.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tClose to Cassie Ventura,<a href=\"https:\/\/deadline.com\/2025\/05\/diddy-trial-witness-rape-testimony-1236412407\/\" rel=\"nofollow noopener\" target=\"_blank\"> Nash testified at Combs criminal trial on May 28,<\/a> though he noted at the time he did not want to be in court, and was only there under subpoena. \u201cAfter enduring years of abuse, I finally found the courage during the criminal trial, and I am now ready to take action,\u201d a September 24 statement from Nash declared of that testimony and his time working for Combs and Ventura from 2008 to 2018. \u201cSean Combs has never taken accountability for the years of harm he inflicted on me and so many others,\u201d he added, in a 18 words that certainly undercut most of the positive spin Combs\u2019 defense put on their client said in court on September 25. <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tLast week, Combs lawyer Erica Wolff directly threw shade on this latest suit by saying that \u201cMr. Nash is another opportunist looking to profit off his proximity to celebrity.\u201d Recycling terms Combs\u2019 team has used over and over on past suits, Wolff added: \u201cThis complaint is riddled with falsehoods and stands in stark contrast to the record that has already been established in court.
