{"id":271641,"date":"2025-10-02T10:35:14","date_gmt":"2025-10-02T10:35:14","guid":{"rendered":"https:\/\/www.europesays.com\/us\/271641\/"},"modified":"2025-10-02T10:35:14","modified_gmt":"2025-10-02T10:35:14","slug":"countys-pharmacy-chief-also-works-at-a-law-firm","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/271641\/","title":{"rendered":"County\u2019s Pharmacy Chief Also Works at a Law Firm"},"content":{"rendered":"<p>The county of San Diego\u2019s chief pharmacy officer, who collects a $232,419 yearly salary, moonlights as a partner at a New York-based law firm that advises pharmaceutical companies.\u00a0<\/p>\n<p>County officials refused Voice of San Diego\u2019s request for disclosure documents that county staff must submit about outside work or other activities that may conflict with their county duties.\u00a0<\/p>\n<p>Dr. Emily Do is the county\u2019s full-time chief pharmacy officer, who oversees county pharmacy practices and standards and has been in that role since 2019. In April, she joined the law firm Dilworth &amp; Barrese as a partner and patent attorney, according to her LinkedIn profile.\u00a0<\/p>\n<p>The firm\u2019s website lists Do as a partner and member of its West Coast team based in San Diego. The firm also notes that it \u201cserves as counsel for leading companies in the pharmaceutical industry\u201d but doesn\u2019t identify specific ones.\u00a0\u00a0<\/p>\n<p>\u201cEmily Do is a registered patent attorney and works with independent inventors, healthcare and pharmaceutical companies to protect their intellectual property interests in the United States and abroad,\u201d her Dilworth &amp; Barrese <a href=\"https:\/\/www.dilworthbarrese.com\/team\/emily-do\/\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">bio reads<\/a>. \u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"1021\" height=\"826\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/10\/Emily-Do-law-firm-bio.png\" alt=\"\" class=\"wp-image-757306\"  \/>A screenshot of Emily Do\u2019s bio on the Dilworth &amp; Barrese, LLP website. <\/p>\n<p>The law firm bio doesn\u2019t mention that Do is also <a href=\"https:\/\/www.sandiegocounty.gov\/content\/sdc\/hhsa\/programs\/mcsd\/MCS_ABOUT_PAGE.html\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">San Diego County\u2019s chief pharmacy officer<\/a> \u2013 or specific companies she has advised.\u00a0<\/p>\n<p>Do joined county government after working almost five years in the state public health department, according to her LinkedIn profile.\u00a0<\/p>\n<p>Per a <a href=\"https:\/\/www.sandiegocounty.gov\/content\/dam\/sdc\/hr\/jobs\/CPO_Director_Agency_Ops_Brochure.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">2018 county job description<\/a>, the chief pharmacy officer works with county Health and Human Services officials, including pharmacy staff, to implement pharmacy policies and standards, recommend changes to county pharmacy services \u201cbased on community need\u201d and ensure the county is following regulations.\u00a0<\/p>\n<p>In a more recent statement seeking to become the next president of the California Society of Health-System Pharmacists, Do <a href=\"https:\/\/cdn.ymaws.com\/www.cshp.org\/resource\/resmgr\/files\/cshp_elections\/2025\/BOD-Slate2025_-_EDo.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">wrote<\/a> that her county role has also involved advocacy for legislation such <a href=\"https:\/\/www.housingca.org\/wp-content\/uploads\/2022\/03\/Fact-Sheet-SB-872.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">Senate Bill 872<\/a>, which in <a href=\"https:\/\/www.cbsnews.com\/sanfrancisco\/news\/sb872-mobile-pharamcies-new-california-law-sen-bill-dodd\/\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">2022 allowed counties to operate mobile pharmacies<\/a> to provide medications and vaccines to homeless residents and others. Do is now set to become the state society\u2019s <a href=\"https:\/\/cdn.ymaws.com\/www.cshp.org\/resource\/resmgr\/files\/news3\/Member_Spotlight_-_EDo.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">next president<\/a>.\u00a0<\/p>\n<p>County officials have decided Do\u2019s legal work doesn\u2019t present a conflict.\u00a0<\/p>\n<p>\u201cProviding records regarding an employee\u2019s activities outside of work, which has not been deemed to constitute a conflict, would impede on an individual\u2019s personal life and right to privacy,\u201d the county wrote in its Monday response denying Voice\u2019s records request. \u201cTherefore, withholding these documents clearly outweighs the public interest in the disclosure of these records.\u201d\u202f\u202f\u202f\u00a0<\/p>\n<p>County spokesperson Tim McClain wrote in a separate statement that that \u201cbased on the information provided by Dr. Do as required by county policy, no incompatible activities were identified.\u201d\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"752\" height=\"284\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/10\/DoCountySite.png\" alt=\"\" class=\"wp-image-757305\"  \/>A screenshot of Emily Do\u2019s bio on the county of San Diego website. <\/p>\n<p>Michael Musella, a managing partner at Dilworth &amp; Barrese, confirmed the same.\u00a0<\/p>\n<p>\u201cDr. Do has made full disclosure about her employment with us to the county and the county is satisfied with everything so there really isn\u2019t any follow up here that needs to be made,\u201d Musella said.\u00a0<\/p>\n<p>Musella declined to answer other questions about the nature of Do\u2019s employment at his firm.\u00a0<\/p>\n<p>Do did not respond to emails and other messages seeking comment.\u00a0<\/p>\n<p>Do has for years juggled both pharmaceutical and legal work.\u00a0<\/p>\n<p>At the time the county hired Do, her LinkedIn page indicates that she was practicing intellectual property law as a sole proprietor though she didn\u2019t report any related income in state-mandated economic disclosures for 2019. Her disclosures only mention volunteer legal work for two local organizations.\u00a0<\/p>\n<p>Do reported that she was working for Virginia-based law firm FRESH IP by 2022, initially reporting no more than $10,000 in income. In both 2023 and 2024, she reported receiving total commissions of between $10,001 and $100,000 for intellectual property legal services.\u00a0<\/p>\n<p>Do\u2019s latest disclosure, filed in March for 2024, does not include income or details on her work as a partner at Dilworth &amp; Barrese.\u00a0\u00a0<\/p>\n<p>The county this week denied Voice of San Diego\u2019s state Public Records Act request for county forms that Do may have submitted reporting her outside employment. In those <a href=\"https:\/\/www.sandiegocounty.gov\/content\/sdc\/cob\/incompatible_activities.html\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">forms<\/a>, county officials are charged with reporting outside activities or jobs they are paid for and their duties so the county can decide whether that work is incompatible with their county job.\u00a0<\/p>\n<p>Voice also asked the county whether officials have flagged concerns about potential conflicts tied to Do\u2019s legal work or if they have counseled her on how to avoid conflicts.\u00a0<\/p>\n<p>McClain declined to directly answer those questions and instead responded generally.\u00a0<\/p>\n<p>\u201cEthics and integrity are fundamental to the county and the work of our employees, and all employees are expected to know and follow the county\u2019s Code of Ethics which includes incompatible activities, as well as the Code of Conduct,\u201d McClain wrote.\u00a0<\/p>\n<p>The county\u2019s <a href=\"https:\/\/www.sandiegocounty.gov\/cao\/docs\/elspstmt.pdf\" target=\"_blank\" rel=\"noreferrer noopener external\" data-wpel-link=\"external\">Code of Ethics<\/a> advises county employees to \u201cavoid becoming involved in activities that improperly influence their actions or job functions\u201d including outside employment.
