{"id":274752,"date":"2025-10-03T14:25:17","date_gmt":"2025-10-03T14:25:17","guid":{"rendered":"https:\/\/www.europesays.com\/us\/274752\/"},"modified":"2025-10-03T14:25:17","modified_gmt":"2025-10-03T14:25:17","slug":"supreme-court-takes-case-that-could-allow-more-guns-in-malls-and-restaurants","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/274752\/","title":{"rendered":"Supreme Court takes case that could allow more guns in malls and restaurants"},"content":{"rendered":"<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaup0gh003o26p7gw9r9yht@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Supreme Court agreed Friday to decide if states may bar people from carrying guns on private property without permission from the property owner, wading into a thorny Second Amendment dispute that could expand carry rights in malls, restaurants and stores.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgavwk1s000a3b6nuhy56k2m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It is the first major Second Amendment case the high court has agreed to hear in more than a year.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgavzxpo00003b6n32wso0et@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The court granted five new cases on Friday as it builds out a new term that will begin on Monday and run through June.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m200053b6nzmghm8xy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The term is shaping up to be one of enormous consequence, with cases dealing with executive power during President Donald Trump\u2019s second term, transgender rights and the future prospects of a landmark civil rights era law to protect minority voters.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m200063b6nkomdzbr0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Hawaii enacted the gun law in question in 2023 in response to the Supreme Court\u2019s <a href=\"https:\/\/www.cnn.com\/2022\/06\/23\/politics\/supreme-court-guns-second-amendment-new-york-bruen\" rel=\"nofollow noopener\" target=\"_blank\">landmark ruling a year earlier<\/a> that made it easier for Americans to obtain carry permits. That decision struck down a New York law that required residents to show \u201cproper cause\u201d to carry a handgun.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m200073b6nav11bbzb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Previously, the state\u2019s law allowed someone with a permit to carry their handgun into a store, for instance, unless the property owner explicitly prohibited it. The new law flipped that around and required unambiguous written or verbal authorization. It also barred the carrying of guns on beaches and in parks as well as bars and restaurants that serve alcohol.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m200083b6nx744ps3k@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Three gun owners who hold carry permits sued, along with a gun rights group, claiming the new law and an appeals court decision upholding it rendered \u201cillusory the right to carry in public.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m200093b6nihd2ha8e@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Five states \u2013 Hawaii, California, Maryland, New Jersey, and New York \u2013 enacted similar restrictions, according to President Donald Trump\u2019s administration, which urged the Supreme Court to hear the case.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m2000a3b6n6u8holdm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The administration told the high court that people could bring \u201cbicycles, roller skates, protest banners, muddy shoes, dripping umbrellas, melting ice cream cones\u201d into private stores without permission.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m2000b3b6ns2wa304n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cOnly if someone wants to carry a gun must he obtain \u2018express authorization\u2019 under the arbitrary presumption that all property owners would view guns differently,\u201d the Department of Justice said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m2000c3b6nt1gqttef@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Anne Lopez, the Democratic attorney general of Hawaii, argued that the state\u2019s law \u201crepresents a permissible effort to vindicate the rights of Hawai\u2018i\u2019s citizens to exclude armed individuals from their private property.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m2000d3b6npuc0ym1r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A federal district court in Hawaii preliminarily barred the state from enforcing the law, but the San Francisco-based 9th US Circuit Court of Appeals reversed that decision.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m2000e3b6nfsvokmzg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cNothing in the text of the Second Amendment or otherwise suggests that a private property owner \u2013 even owners who open their private property to the public \u2013 must allow persons who bear arms to enter,\u201d the appeals court wrote in a unanimous opinion.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m2000f3b6nwid20mtf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Undergirding the fight over Hawaii\u2019s law is the Supreme Court\u2019s requirement that judges look to US history when deciding whether to uphold or strike down gun prohibitions under the Second Amendment. In its 2022 decision, New York State Rifle &amp; Pistol Association v. Bruen, the court said that a gun regulation must be \u201cconsistent with this nation\u2019s historical tradition of firearm regulation.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmgaw01m2000g3b6n923b3uei@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That prompted a flurry of challenges to gun laws from Second Amendment groups, who argued many of those prohibitions have little connection to history, and it required many federal judges to dabble in history as well as law.
