Chuck Schumer over the shutdown.<\/p>\n<p>Funding for the projects \u2014 a long-awaited extension of the Second Ave. subway into East Harlem and the construction of a new tunnel under the Hudson River to double train traffic between New York and New Jersey \u2014 was placed on hold by the Trump administration last Wednesday in the early hours of the federal shutdown.<\/p>\n<p>Duffy and Office of Management and Budget Director Russell Vought both claimed at the time that the decision was made over concerns that the agencies in charge of the projects \u2014 the MTA and the Gateway Development Commission \u2014 were in arrears of a rule that had only been published hours before.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"Transportation Secretary Sean Duffy doubled down on the Trump administration's decision to hold funding on two major NYC area projects on October 6, 2025. (Evan Simko-Bednarski\/NYDN)<\/p>\n<p>The rule \u2014 which was only published to the federal register <a href=\"https:\/\/www.transportation.gov\/sites\/dot.gov\/files\/2025-10\/DBE%20IFR.Published.10-03-2025.pdf\" target=\"_blank\" rel=\"noopener\">on Friday<\/a> \u2014 purports to forbid the use of race- or sex-based factors when determining whether a contractor can be considered a \u201cDisadvantaged Business Enterprise\u201d for the purposes of a Reagan-era program meant to support large-project contracts going to disadvantaged small businesses.<\/p>\n<p>Duffy spoke to reporters at Newark Airport Monday, after meeting with air traffic controllers who are working without pay while the federal shutdown continues. The secretary blamed the shutdown on Democrats in Congress, who have withheld their votes to fund the government pending a deal with the Republican majority in both houses on health care costs.<\/p>\n<p>Asked Monday if the funding hold on Second Ave. and the Hudson River Tunnel was part of an effort to hurt Democratic states in the wake of the shutdown, Duffy dodged the question, while also blaming Senate Minority Leader Chuck Schumer (D- New York).<\/p>\n<p>\u201cSeveral months ago I sent out a letter telling everyone who receives federal money to follow the law,\u201d Duffy said<\/p>\n<p>\u201cThere has been a tendency with some of these projects to look at race and sex as a [marker of a] disadvantaged business as opposed to the size of the company \u2014 this is unconstitutional, it\u2019s contrary to law,\u201d he said. \u201cWe had sent out notice, again, months ago. We let them know that this was going to go under review.\u201d<\/p>\n<p>\u201cWhen the shutdown happened, our civil rights division, most of it was furloughed,\u201d he added. \u201cSo the review process is going to take longer than what we would anticipate.\u201d<\/p>\n<p>The legality of sex- and race-based considerations in the DBE process is still a live issue, currently being litigated in federal court <a href=\"https:\/\/www.courtlistener.com\/docket\/67920383\/mid-america-milling-company-v-us-department-of-transportation\/\" target=\"_blank\" rel=\"noopener\">in the Eastern District of Kentucky<\/a>.<\/p>\n<p>As to whether the agencies leading the Hudson River Tunnel and Second Ave. subway projects were warned that their DBE practices were about to come under review, sources at both the Gateway Development Commission and the MTA told The News that last Tuesday was the first they\u2019d heard of any such plan.<\/p>\n<p>Asked if he was calling the projects illegal ahead of the completion of USDOT\u2019s review, Duffy then walked back his claim that the agencies were breaking the law.<\/p>\n<p>\u201cWhat I\u2019m saying is it\u2019s up for review,\u201d Duffy said. \u201cThere\u2019s been issues in New York, not using [the Disadvantaged Business Enterprise Program] appropriately \u2014 looking at the race and the sex of a business as opposed to the size of the business, which is what the law was intended for.\u201d<\/p>\n<p>The Transportation secretary insisted that the Trump administration supports the projects.<\/p>\n<p>\u201cWe\u2019re not trying to shut down these projects \u2013 to the contrary, we\u2019re trying to make sure these projects move forward, move forward fast. They\u2019re important,\u201d he said.<\/p>\n<p>\u201cThe question is why would Chuck Schumer, who says he cares about the projects, shut down the government so we don\u2019t have the staff to review the contracting authority used on these projects and if it\u2019s done constitutionally?\u201d<\/p>\n<p>In a statement to The News on Monday, Schumer said Democratic lawmakers were ready to negotiate<\/p>\n<p>\u201cWe\u2019re ready to work with Republicans to reopen the government, and end the health care crisis that faces tens of millions of Americans,\u201d Schumer said. \u201cBut it takes two sides to have a negotiation.
