It also states that police failed to locate Delgado\u2019s wallet, which is still missing.<\/p>\n
However, core to the notice are allegations there could have been foul play.<\/p>\n
It claims police did not detain the person that Delgado was last seen with, and that when authorities did speak with the person, they gave inconsistent information.<\/p>\n
\u201cTo our knowledge they did have a prior intimate relationship,\u201d Fazal said. \u201cThere are also some witnesses who observed that individual, on the same day, parked down the street from this residence for hours before he entered the home.\u201d<\/p>\n
The City of Phoenix has declined to comment on the legal action and the case itself.<\/p>\n
\u201cThis is all corroborated by officers\u2019 own body cameras and police reports,\u201d Fazal added.<\/p>\n
Overall, the family accuses Phoenix PD of:<\/p>\n

- Failing to properly investigate Delgado\u2019s death and track evidence.<\/li>\n
- Wrongful death due to depriving Delgado\u2019s family of companionship and support.<\/li>\n
- Negligent infliction of emotional distress.<\/li>\n
- Intentional infliction of emotional distress.<\/li>\n
- Negligent hiring and reckless disregard.<\/li>\n<\/ul>\n
The family is seeking $15 million in damages.\u00a0<\/p>\n
\u201cWe want transparency, we want accountability and we want justice,\u201d Delgado\u2019s sister Vanessa Vasquez said at the press conference. \u201cNothing will bring her back but this forces change, the next family doesn\u2019t have to go through this.\u201d<\/p>\n
For Delgado\u2019s family \u2013 which includes her two young children \u2013 there\u2019s no getting out of the \u201cnightmare\u201d of losing a loved one.<\/p>\n
\u201cNo parent ever imagines standing here like this, speaking about their child\u2019s death and begging for someone to care enough to tell the truth,\u201d her mother Sylvia Delgado added.<\/p>\n
The City of Phoenix has 60 days from the date the notice of claim was filed, Sept. 4th, to respond before Delgado\u2019s family can seek a full lawsuit.<\/p>\n
