(City Limits)<\/p>\n<p><a href=\"http:\/\/citylimits.org\/cdn-cgi\/l\/email-protection#a4c1c0cdd0cbd6e4c7cdd0ddc8cdc9cdd0d78acbd6c3\" rel=\"nofollow noopener\" target=\"_blank\"><img loading=\"lazy\" src=\"https:\/\/citylimits.org\/wp-content\/plugins\/trx_addons\/components\/lazy-load\/images\/placeholder.png\" decoding=\"async\" width=\"400\" height=\"400\" data-trx-lazyload-src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/06\/Title-2-1.jpg\" alt=\"CityViews Opinion\" class=\"wp-image-22454514\" data-trx-lazyload-height=\"\" style=\"height: 0; padding-top: 100%; width:248px;height:auto\"\/><\/a><\/p>\n<p>The New York City Office of Technology and Innovation recently extended its deadline to respond to a <a href=\"https:\/\/citylimits.org\/how-to-use-the-freedom-of-information-law\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Freedom of Information Law<\/a> (FOIL) request by The Legal Aid Society\u2014for a whopping 40th time. The request, which was submitted back in January of 2021, sought access to records related to the agency\u2019s purchase and\/or use of surveillance giant Palantir\u2019s products.\u00a0\u00a0<\/p>\n<p>This more-than-four-year wait for records is not an aberration. Legal Aid is still waiting on responses to a 2022 FOIL request to the New York City Police Department (NYPD) for records related to the accuracy of ShotSpotter (a tool the NYPD uses to try to detect gunshots), a 2023 FOIL request to the NYPD for video from the <a rel=\"noreferrer noopener nofollow\" href=\"https:\/\/www.nytimes.com\/2024\/02\/02\/nyregion\/nypd-subway-robot-retires.html\" target=\"_blank\">Knightscope K5 Times Square Robot<\/a> from a single day, and many more.\u00a0<\/p>\n<p><a rel=\"noreferrer noopener nofollow\" href=\"https:\/\/legalaidnyc.org\/\" target=\"_blank\">Legal Aid<\/a> is a nonprofit law firm for New York City residents who are unable to afford private counsel, and our <a rel=\"noreferrer noopener nofollow\" href=\"https:\/\/legalaidnyc.org\/programs-projects-units\/digital-forensics-unit\/\" target=\"_blank\">Digital Forensics Unit<\/a> submits FOIL requests like these to maintain an up-to-date understanding of the surveillance technologies and practices that affect the people we serve. We believe\u2014and the <a rel=\"noreferrer noopener nofollow\" href=\"https:\/\/opengovernment.ny.gov\/system\/files\/documents\/2024\/09\/foil-law-text-09112024_0.pdf\" target=\"_blank\">text<\/a> of FOIL itself recognizes\u2014that \u201cgovernment is the public\u2019s business.\u201d But agencies\u2019 seemingly endless delays leave us, our clients, and the public at large, without access to information about how our government is using its power and resources.\u00a0<\/p>\n<p>That\u2019s why we\u2019ve been pushing for legislation both in Albany and at City Hall that would significantly improve FOIL processes. This year, the full New York State Legislature passed the FOIL Timeline Act, which would have imposed limitations on agencies\u2019 delays in producing responsive records. Unfortunately, Gov. Kathy Hochul vetoed it.\u00a0<\/p>\n<p>But there is still hope for greater transparency in New York City. <a href=\"https:\/\/legistar.council.nyc.gov\/LegislationDetail.aspx?ID=7297922&amp;GUID=45A761F3-58A9-46AC-AAF6-C397ABD9BB65&amp;Options=ID%7cText%7c&amp;Search=\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Intro 1235<\/a> aims to make the FOIL process more efficient and auditable by allowing the public to access and search all records produced by city agencies in response to FOIL requests, and by providing statistics on city agencies\u2019 FOIL practices\u2014including their average response times. <\/p>\n<p>All requests to city agencies would be processed through an online portal that would also indicate relevant dates, extensions, and decisions with respect to each request. The portal would also contain information about any appeals to agencies\u2019 denials of FOIL requests and any subsequent lawsuits. And the portal would show the amount that the requester paid to the agency in fees, and any attorney\u2019s fees that the agency was required to pay to a requester in a FOIL-related lawsuit against the agency.\u00a0\u00a0<\/p>\n<p>Intro 1235 would reduce unnecessary inefficiencies in the FOIL process for both requesters and agencies. The ability to access other FOIL requests and responses through the portal would obviate the need to submit duplicative requests\u2014which in turn would obviate the need to fulfill duplicative requests. And publicizing agencies\u2019 patterns and practices with respect to producing records would make clear where additional reforms or resources are necessary.\u00a0\u00a0<\/p>\n<p>It is time for New York City to pave the way to a modern, functioning FOIL landscape. The public is unable to understand, debate, and challenge government practices if it is kept in the dark about what they are.
