\n\tAn unexpected and painful $619 million tax expense <\/a>from Brazil knocked the operating margin for Netflix<\/a>\u2018 September quarter, defying Wall Street\u2019s upbeat guidance and hitting the stock, which fell more than 6%.<\/p>\n

\n\tIt was unusual. Asked on the streamer\u2019s post-earnings<\/a> Q&A webcast to provide more color on what happened, CFO Spencer Neumann stressed \u201ctwo really important takeaways that I want to leave you with. The first is that \u2026 no other tax looks or behaves like this in any other major country in which we operate. And, secondly, absent this expense, we would have exceeded our Q3 \u201825, operating income and operating margin forecast. And we don\u2019t expect this matter to have a material impact on our results going forward.\u201d<\/p>\n

\n\tNetflix reported an operating margin of 28% for the third quarter. Without the Brazilian hiccup, the margin would have exceeded the company\u2019s guidance of 31.5%, it said. The culprit was a national tax on outbound payments called the Contribution for intervention in the Economic Domain (CIDE).<\/p>\n

\n\t\u201cIt\u2019s a bit complicated \u2026 It\u2019s a cost of doing business in Brazil,\u201d Neumann explained. \u201cIt involves a 10% tax on certain payments made by Brazilian entities to companies outside of Brazil. It\u2019s not a tax that\u2019s specific to Netflix. It\u2019s not even specific to streaming. So we assume other companies will be impacted by this.<\/p>\n

\n\t\u201cIn our case, Netflix Brazil<\/a> pays Netflix U.S. for services that enable Netflix Brazil to offer subscriptions to our Brazilian customers. And we actually received a favorable ruling from a lower court back in 2022 that concluded we were not subject to this tax, which is why we believed we couldn\u2019t accrue this.\u201d<\/p>\n

\n\tHe said the legal issue \u2013 which the streamer has apparently flagged in several SEC filings \u2014 relates to the scope of transactions covered by the tax \u2014 in particular, whether it applies to service payments that don\u2019t involve a transfer of technology.<\/p>\n

\n\tIn August of this year, the Brazil Supreme Court decided against an unrelated company, ruling that \u201cthe tax applies to a wider range of transactions than we thought was legally permissible,\u201d including service payments that don\u2019t involve the transfer of technology.<\/p>\n

\n\t\u201cSo given that court\u2019s ruling, that\u2019s caused us to reevaluate the likelihood of prevailing, and we now deem the loss to be probable, and that\u2019s why we recorded the expense in Q3.\u201d<\/p>\n
