{"id":325547,"date":"2025-10-23T04:07:35","date_gmt":"2025-10-23T04:07:35","guid":{"rendered":"https:\/\/www.europesays.com\/us\/325547\/"},"modified":"2025-10-23T04:07:35","modified_gmt":"2025-10-23T04:07:35","slug":"phoenix-widow-sues-to-stop-sale-of-gun-that-killed-husband-a-police-officer","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/325547\/","title":{"rendered":"Phoenix widow sues to stop sale of gun that killed husband, a police officer"},"content":{"rendered":"<p class=\"text | text-start article-text\"><b>PHOENIX (AZFamily)<\/b> \u2014 A Valley widow is taking the city of Phoenix and its police chief to court to stop the sale of the gun used to murder her husband, a Phoenix police officer killed in the line of duty.<\/p>\n<p class=\"text | text-start article-text\">Julie Erfle, the widow of Officer Nick Erfle, argues that auctioning off the weapon violates her rights as a crime victim under the <a href=\"https:\/\/www.azleg.gov\/const\/2\/2_1.htm\" rel=\"noopener\" target=\"_blank\">Arizona Victims\u2019 Bill of Rights<\/a>.<\/p>\n<p class=\"text | article-text\">The lawsuit was filed last week and seeks a court order preventing the city from selling the gun and instead requiring it to be destroyed.<\/p>\n<p class=\"text | article-text\">\u201cHe died a hero, doing the job he loved the most,\u201d Erfle said, reflecting on the day her husband was killed.<\/p>\n<p class=\"text | article-text\">On Sept. 18, 2007, Officer Nick Erfle was shot twice while approaching a man blocking traffic in central Phoenix. For nearly two decades, his widow has worked to heal, but one question always lingered: what happened to the gun that took his life?<\/p>\n<p class=\"text | article-text\">\u201cI remember asking the detective where it came from and how the shooter was able to get a hold of it,\u201d she said.<\/p>\n<p class=\"text | article-text\">Erfle assumed the weapon had long been destroyed. But years later, a phone call shattered that belief.<\/p>\n<p class=\"text | article-text\">\u201cThat\u2019s when I found out, kind of by accident, that the gun still existed, that it was still in the department\u2019s possession,\u201d she said.<\/p>\n<p class=\"text | article-text\">Her shock soon turned to anger when she learned of a 2013 Arizona law that requires police departments to sell seized weapons rather than destroy them.<\/p>\n<p class=\"text | article-text\">\u201cThat\u2019s my biggest fear,\u201d Julie said. \u201cThat this gun is being given a second chance to harm another individual.\u201d<\/p>\n<p class=\"text | article-text\">The lawsuit claims Phoenix is violating Arizona\u2019s constitutional protections for crime victims by allowing the gun to be sold and potentially end up back on the streets.<\/p>\n<p class=\"text | text-start article-text\">\u201cThe Victims\u2019 Bill of Rights is actually part of the <a href=\"https:\/\/www.azleg.gov\/constitution\/\" rel=\"noopener\" target=\"_blank\">Arizona Constitution<\/a>,\u201d said <a href=\"https:\/\/www.davismiles.com\/meet-our-attorneys\/russell-richelsoph\/\" rel=\"noopener\" target=\"_blank\">Davis Miles attorney Russ Richelsoph<\/a>, who is not involved in the case. \u201cIt provides a list of rights that crime victims have in criminal cases.\u201d<\/p>\n<p class=\"text | article-text\">Richelsoph notes that Erfle\u2019s case highlights a conflict between two state laws \u2014 one that guarantees justice and respect for victims, and another that prohibits police departments from destroying firearms that can be legally sold.<\/p>\n<p class=\"text | article-text\">That 2013 statute was supported by state Sen. John Kavanagh, a Republican from Fountain Hills. <\/p>\n<blockquote class=\"blockquote | article-blockquote\">\n<p class=\"mb-2\">There is no logical reason to destroy guns used in crimes. Guns are not inherently evil. Destroying them costs money; selling them creates revenue and saves taxpayers\u2019 money.<\/p>\n<\/blockquote>\n<p class=\"text | article-text\">Kavanagh later clarified that he would support allowing guns used in murders to be destroyed.<\/p>\n<p class=\"text | article-text\">Erfle, however, sees it differently.<\/p>\n<p class=\"text | article-text\">\u201cI remember the arguments, and it was basically that we should make a buck off of these guns,\u201d she said. \u201cWe should make a buck off of somebody\u2019s murder. I find that immoral.\u201d<\/p>\n<p class=\"text | article-text\">For her, this case isn\u2019t just about the weapon that killed her husband.
