That project is scheduled to return for a final decision, but the denial makes clear that Beverly Hills isn\u2019t done <a href=\"https:\/\/www.bisnow.com\/los-angeles\/news\/construction-development\/beverly-hills-builders-remedy-projects-128587\" target=\"_blank\" rel=\"nofollow noopener\">fighting builder\u2019s remedy<\/a> just yet.\u00a0<\/p>\n<p dir=\"ltr\">The Beverly Hills Planning Commission voted 4-1 at a Tuesday night meeting to deny the 26-story <a class=\"tag tag-1589\" href=\"https:\/\/www.bisnow.com\/tags\/crescent-heights\" target=\"_blank\" data-tag-id=\"1589\" rel=\"nofollow noopener\">Crescent Heights<\/a> project at 8844 Burton Way.\u00a0<\/p>\n<p dir=\"ltr\">Commissioner Terri Kaplan served as the lone vote in favor. Kaplan\u00a0said she felt \u201cboxed in,\u201d like she had to approve the project because a denial would ultimately lead to expensive litigation.\u00a0<\/p>\n<p dir=\"ltr\">Her fellow commissioners didn&#8217;t feel the same.<\/p>\n<p dir=\"ltr\">\u201cI have very serious concerns,\u201d Beverly Hills Planning Commissioner Gary Ross said at the meeting.\u00a0<\/p>\n<p>Those concerns include the fact that the project\u2019s 22 affordable units had been relegated to the bottom five floors of the project and were concentrated around the trash chute and elevator.<\/p>\n<p dir=\"ltr\">\u201cI really don\u2019t feel good about this project,\u201d Ross said.\u00a0<\/p>\n<p dir=\"ltr\">Builder\u2019s remedy is a provision of the\u00a0<a class=\"tag tag-165458\" href=\"https:\/\/www.bisnow.com\/tags\/housing-accountability-act\" target=\"_blank\" data-tag-id=\"165458\" rel=\"nofollow noopener\">Housing Accountability Act<\/a>\u00a0that has bedeviled\u00a0several cities across\u00a0California whose state-approved housing plans were briefly noncompliant.<\/p>\n<p dir=\"ltr\">That period of being out of compliance created a window that allows developers to file applications for projects taller and with more units than might otherwise be allowed, provided that 13% or more of the units qualify as affordable housing.\u00a0<\/p>\n<p dir=\"ltr\">The five projects approved this month by the commission range\u00a0<a href=\"https:\/\/la.urbanize.city\/post\/beverly-hills-planning-commission-approves-three-builders-remedy-projects\" target=\"_blank\" rel=\"nofollow noopener\">from eight<\/a> to <a href=\"https:\/\/la.urbanize.city\/post\/two-more-builders-remedy-projects-get-go-ahead-beverly-hills\" target=\"_blank\" rel=\"nofollow noopener\">12 stories<\/a>, according to Urbanize LA. The approvals were a stark contrast to the previous tack the city had taken in responding to these larger-than-usual projects.<\/p>\n<p dir=\"ltr\">The city of Beverly Hills used myriad tools to <a href=\"https:\/\/la.urbanize.city\/post\/beverly-hills-blocks-19-story-builders-remedy-development\" target=\"_blank\" rel=\"nofollow noopener\">block developments<\/a>\u00a0proposed under builder&#8217;s remedy, which have largely received considerable community pushback and outrage.<\/p>\n<p>                        <img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/06\/1750589843_18_placeholder.png\" loading=\"lazy\" alt=\"Placeholder\"\/><\/p>\n<p>\n      A builder&#8217;s remedy project proposed for 346 N. Maple Drive in Beverly Hills\n    <\/p>\n<p dir=\"ltr\">But in August, the city <a href=\"https:\/\/beverlyhills.granicus.com\/MetaViewer.php?view_id=57&amp;clip_id=10544&amp;meta_id=656585\" target=\"_blank\" rel=\"nofollow noopener\">lost a court case<\/a> over a 19-story tower, and land use attorneys working on these projects anticipated the ruling would shift the tide.\u00a0<\/p>\n<p dir=\"ltr\">\u201cI was thinking that up until Tuesday at around\u00a04 o&#8217;clock or\u00a05 o&#8217;clock in the afternoon, when the Planning Commission recommended denial of a builder&#8217;s remedy project on Burton Way,\u201d said <a class=\"tag tag-193915\" href=\"https:\/\/www.bisnow.com\/tags\/dave-rand\" target=\"_blank\" data-tag-id=\"193915\" rel=\"nofollow noopener\">Dave Rand<\/a>, a partner at Rand Paster Nelson who represents the Burton Way project.\u00a0<\/p>\n<p dir=\"ltr\">In 2023, Santa Monica had to\u00a0<a href=\"https:\/\/www.bisnow.com\/los-angeles\/news\/multifamily\/santa-monica-builders-remedy-settlement-118919\" target=\"_blank\" rel=\"nofollow noopener\">work out a settlement<\/a>\u00a0with a developer that proposed 14 of the 16 builder\u2019s remedy projects\u00a0it received applications for while its housing element wasn&#8217;t state-approved.\u00a0La Ca\u00f1ada Flintridge\u00a0<a href=\"https:\/\/www.bisnow.com\/los-angeles\/news\/multifamily\/la-canada-flintridge-builders-remedy-cedar-street-128413\" target=\"_blank\" rel=\"nofollow noopener\">abandoned\u00a0its fight<\/a>\u00a0against an 80-unit builder\u2019s remedy project\u00a0in May.\u00a0<\/p>\n<p dir=\"ltr\">Throughout the state, local agencies that have sought to push back against builder\u2019s remedy haven\u2019t come out on top. In June, state Attorney General\u00a0<a class=\"tag tag-175232\" href=\"https:\/\/www.bisnow.com\/tags\/rob-bonta\" target=\"_blank\" data-tag-id=\"175232\" rel=\"nofollow noopener\">Rob Bonta<\/a>\u00a0put out a release directing local governments to comply with state housing laws in a timely manner, specifically including their \u201cresponsibility to\u00a0<a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-issues-builder%E2%80%99s-remedy-legal-alert-local-governments\" target=\"_blank\" rel=\"nofollow noopener\">timely process Builder\u2019s Remedy applications<\/a>.\u201d<\/p>\n<p dir=\"ltr\">There were about a dozen builder\u2019s remedy projects submitted for developments that would normally never be built in Beverly Hills. In some cases, developers have proposed 20- and even 26-story projects in areas where four stories would be the usual height limit.\u00a0<\/p>\n<p dir=\"ltr\">The state housing law makes it challenging to deny these projects,\u00a0absent a shortlist of findings, including that the project is a quantifiable risk to public safety.<\/p>\n<p dir=\"ltr\">The project at 8844 Burton Way is slated to return to the Planning Commission on Oct. 29 so the decision to deny the project can be finalized.
