County moves to limit license plate tracking"},"content":{"rendered":"\n<p>Drivers in Los Angeles County have a powerful new privacy advocate after the L.A. County Board of Supervisors pushed to restrict how their license plates are scanned by law enforcement.<\/p>\n<p>The board recently voted to ask the Sheriff\u2019s Department to more stringently regulate its use of the license plate data it collects through high-tech camera systems mounted on patrol cars and above roads. The measure it approved cited <a class=\"link\" href=\"https:\/\/calmatters.org\/economy\/technology\/2025\/06\/california-police-sharing-license-plate-reader-data\/\" target=\"_blank\" rel=\"nofollow noopener\">reporting from CalMatters<\/a> that roughly a dozen police and sheriff\u2019s departments throughout Southern California shared such data with federal immigration agencies.<\/p>\n<p>The September <a class=\"link\" href=\"https:\/\/file.lacounty.gov\/SDSInter\/bos\/supdocs\/207511.pdf\" target=\"_blank\" rel=\"nofollow noopener\">motion<\/a> requests that the L.A. County Sheriff\u2019s Department, which operates independently of the supervisors, conduct yearly privacy training for deputies with access to license plate cameras and that the data be barred from use for non-criminal immigration enforcement.<\/p>\n<p>It also requests the department delete plate sightings after 60 days unless they are flagged on <a class=\"link\" href=\"https:\/\/pars.lasd.org\/Viewer\/Manuals\/13233\/Content\/17439#!:~:text=Currently%2C%20LASD%20is,or%20license%20plate.\" target=\"_blank\" rel=\"nofollow noopener\">criminal lists<\/a>.<\/p>\n<p>The Sheriff\u2019s Department \u201cwelcomes\u201d the motion and plans to review its practices and policies, the department told CalMatters. Per the motion, deputies are to report their license plate reader policy changes to the county by January. It <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2025-09-17\/la-county-ice-license-plate-data\" rel=\"nofollow noopener\" target=\"_blank\">told the Los Angeles Times last month<\/a> that it operates 931 automated readers.<\/p>\n<p>Depending on the result of that report and whether Sheriff Robert Luna decides to follow the board\u2019s direction, said Supervisor Hilda Solis, who was the lead author of the motion, supervisors may take additional action to further regulate license plate readers in L.A.<\/p>\n<p>The Sheriff\u2019s Department told CalMatters it has no \u201ccurrent\u201d arrangements for sharing license plate data with federal agencies. <a class=\"link\" href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_201520160sb34\" target=\"_blank\" rel=\"nofollow noopener\">A California law enacted in<\/a> 2015 <a class=\"link\" href=\"https:\/\/oag.ca.gov\/system\/files\/media\/2023-dle-06.pdf#page=3\" target=\"_blank\" rel=\"nofollow noopener\">prohibits<\/a> the sharing of plate data with out-of-state and federal entities, and requires agencies that use plate readers to have a use and privacy policy for them.<\/p>\n<p>Many of the regulations in the L.A. County motion mirror those in a piece of statewide legislation <a class=\"link\" href=\"https:\/\/calmatters.org\/economy\/technology\/2025\/10\/newsom-vetoes-license-plate-reader-regulations\/\" target=\"_blank\" rel=\"nofollow noopener\">vetoed by the governor<\/a> earlier this month. That measure, <a class=\"link\" href=\"https:\/\/calmatters.org\/economy\/technology\/2025\/10\/newsom-vetoes-license-plate-reader-regulations\/\" target=\"_blank\" rel=\"nofollow noopener\">Senate Bill 274, <\/a>sought to prevent misuse of license plate data by limiting the lists of license plates law enforcement can track and by requiring police to detail a specific case or task force use when they use data from the cameras.<\/p>\n<p>Solis said she put forward her motion in part because she wanted to publicly support SB 274 before Newsom decided on it.<\/p>\n<p>CalMatters did not find that the L.A. County Sheriff\u2019s Department shared data with U.S. Immigration and Customs Enforcement or the U.S. Border Patrol, but some Los Angeles-area agencies did. The Los Angeles Police Department declined to comment when asked about such sharing.<\/p>\n<p>License plate readers \u201cremain a powerful investigative tool for recovering stolen vehicles, identifying violent crime suspects, and finding missing persons,\u201d supervisors wrote in a September <a class=\"link\" href=\"https:\/\/file.lacounty.gov\/SDSInter\/bos\/supdocs\/207693.pdf#page=1\" target=\"_blank\" rel=\"nofollow noopener\">letter<\/a> urging the governor to sign SB 274 into law. But \u201cits public support depends on confidence that the sensitive location data it generates will never be repurposed for impermissible civil immigration enforcement.\u201d<\/p>\n<p>Board Chairperson Kathryn Barger cast a lone \u201cnay\u201d vote against SB 274. Barger disapproved of the proposed limit on the time frame over which law enforcement agencies could retain plate data.<\/p>\n<p>Barger told CalMatters she believes this time limit would have endangered the public and made it harder for police to solve crimes, and that she supports Newsom\u2019s veto. Newsom also opposed a 60-day data retention limit in the state bill, citing similar reasons.<\/p>\n<p>But that\u2019s the same license plate data retention period <a class=\"link\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=VEH&amp;sectionNum=2413#:~:text=(b)%C2%A0The%20Department,and%20Blue%20Alerts.\" target=\"_blank\" rel=\"nofollow noopener\">followed by<\/a> the California Highway Patrol, and last year <a class=\"link\" href=\"https:\/\/www.gov.ca.gov\/2024\/04\/02\/governor-newsom-announces-contract-to-install-480-new-high-tech-cameras-in-east-bay-to-improve-public-safety\/\" target=\"_blank\" rel=\"nofollow noopener\">the governor\u2019s office called<\/a> a 28-day retention period a balance between public safety and privacy.<\/p>\n<p> County supervisors have made immigration issues a priority, fast-tracking both the license plate motion and <a class=\"link\" href=\"https:\/\/file.lacounty.gov\/SDSInter\/bos\/supdocs\/208173.pdf\" target=\"_blank\" rel=\"nofollow noopener\">another<\/a> requesting a report on progress using new state laws to protect schools from ICE raids.<\/p>\n<p>The county motion does not apply to police departments since they are governed by local city councils. The Los Angeles City Council has acquired about $400,000 in <a class=\"link\" href=\"https:\/\/ens.lacity.org\/clk\/councilactions\/clkcouncilactions2190463_07232025.pdf\" target=\"_blank\" rel=\"nofollow noopener\">license plate reader<\/a> <a class=\"link\" href=\"https:\/\/www.youtube.com\/watch?v=BazoAgcwpH0&amp;t=2444s\" target=\"_blank\" rel=\"nofollow noopener\">technology<\/a> for the LAPD since June.<\/p>\n<p>Two Los Angeles city councilmembers, Eunisses Hern\u00e1ndez and Hugo Soto-Mart\u00ednez, consistently vote against the LAPD\u2019s use of license plate readers, citing concerns over their use in immigration enforcement.<\/p>\n<p>\u201cAt a time when so many of our neighbors live in fear, sharing sensitive data only increases risks and erodes confidence,\u201d Hern\u00e1ndez wrote in a statement to CalMatters.<\/p>\n<p>Law enforcement agencies using automated license plate readers throughout the state continue to break the law.<\/p>\n<p>California Atty. Gen. Rob Bonta filed a lawsuit against the El Cajon Police Department earlier this month for violating state law. Reporting by KPBS earlier this month found that <a class=\"link\" href=\"https:\/\/www.kpbs.org\/news\/border-immigration\/2025\/10\/08\/records-el-cajon-license-plate-data-used-in-nationwide-immigration-searches\" target=\"_blank\" rel=\"nofollow noopener\">this includes federal agencies like ICE<\/a>. The attorney general\u2019s office has also sent letters to <a class=\"link\" href=\"https:\/\/calmatters.org\/economy\/technology\/2025\/10\/newsom-vetoes-license-plate-reader-regulations\/\" target=\"_blank\" rel=\"nofollow noopener\">18 agencies statewide since 2024<\/a> for potential violations of state law.<\/p>\n<p>Following CalMatters reporting in June, subsequent reporting by Palo Alto Online and the San Francisco Standard found that police departments in<a class=\"link\" href=\"https:\/\/www.paloaltoonline.com\/investigative-story\/2025\/07\/30\/hundreds-of-agencies-tap-athertons-surveillance-system-for-feds-town-fails-to-follow-own-rules\/\" target=\"_blank\" rel=\"nofollow noopener\"> Atherton<\/a>,<a class=\"link\" href=\"https:\/\/www.paloaltoonline.com\/investigative-story\/2025\/08\/19\/menlo-park-police-broke-state-law-shared-license-plate-data-out-of-state\/\" target=\"_blank\" rel=\"nofollow noopener\"> Menlo Park<\/a> and<a class=\"link\" href=\"https:\/\/sfstandard.com\/2025\/09\/08\/sfpd-flock-alpr-ice-data-sharing\/\" target=\"_blank\" rel=\"nofollow noopener\"> San Francisco<\/a> violated state law. In the wake of that reporting, last month Jennifer Wall, a city council member in the Bay Area city of Woodside, <a class=\"link\" href=\"https:\/\/www.youtube.com\/watch?v=Jadvwd8IJAE\" target=\"_blank\" rel=\"nofollow noopener\">called on<\/a> the San Mateo County Sheriff\u2019s Office to be more transparent about how deputies conclude that searches included in quarterly reports to the council comply with <a class=\"link\" href=\"https:\/\/www.woodsideca.gov\/DocumentCenter\/View\/140\/Automated-License-Plate-Reader-ALPR-Usage-and-Privacy-Policy-PDF?bidId=\" target=\"_blank\" rel=\"nofollow noopener\">local policy<\/a>.<\/p>\n<p>When municipalities use automated license plate reader technology, \u201cwe need to make sure it\u2019s used appropriately and mechanisms [are] in place to ensure it\u2019s used appropriately,\u201d she told CalMatters. \u201cThere has to be accountability for how they\u2019re used.\u201d<\/p>\n<p>Phoebe Huss and Khari Johnson write for CalMatters.<\/p>\n","protected":false},"excerpt":{"rendered":"Drivers in Los Angeles County have a powerful new privacy advocate after the L.A.
