{"id":34086,"date":"2025-07-03T01:50:23","date_gmt":"2025-07-03T01:50:23","guid":{"rendered":"https:\/\/www.europesays.com\/us\/34086\/"},"modified":"2025-07-03T01:50:23","modified_gmt":"2025-07-03T01:50:23","slug":"nyc-law-dept-files-amicus-brief-supporting-venezuelan-high-school-student-detained-by-ice-after-immigration-hearing","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/34086\/","title":{"rendered":"NYC Law Dept. files amicus brief supporting Venezuelan high school student detained by ICE after immigration hearing"},"content":{"rendered":"<p>New York City\u2019s Law Department said it will stand behind a 20-year-old Venezuelan migrant and Queens high school student who was <a href=\"https:\/\/www.nydailynews.com\/2025\/06\/04\/ice-arrests-multiple-migrants-lower-manhattan-mandatory-visit\/\" rel=\"nofollow noopener\" target=\"_blank\">arrested by ICE agents<\/a> in a Manhattan courthouse after attending an immigration hearing, arguing in an amicus brief that he is being \u201cdetained without cause and in violation of his right to due process.\u201d<\/p>\n<p>Jose Luis Rojas Figuera, who attended the <a href=\"https:\/\/panamericanihs.org\/\" rel=\"nofollow noopener\" target=\"_blank\">Pan American International High School<\/a> in Elmhurst for roughly a year after arriving in New York in October 2023, has no criminal history and was pursuing a green card, according to the brief filed Tuesday.<\/p>\n<p>Rojas Figuera went to <a href=\"https:\/\/www.google.com\/maps\/place\/26+Federal+Plaza,+New+York,+NY+10278\/data=!4m2!3m1!1s0x89c25b4282c6451d:0x60c7548065ebe9e?sa=X&amp;ved=1t:242&amp;ictx=111\" rel=\"nofollow noopener\" target=\"_blank\">26 Federal Plaza<\/a> on June 2, accompanied by his mother, for what he expected would be a routine immigration hearing. He had no legal representation. During the hearing, a <a href=\"https:\/\/www.dhs.gov\/\" rel=\"nofollow noopener\" target=\"_blank\">Department of Homeland Security<\/a> attorney moved to dismiss Rojas Figuera\u2019s case \u2014 a common tactic used by Homeland Security to strip individuals of their pending status, making them subject to expedited removal if granted by the judge.<\/p>\n<p>The judge denied the motion to dismiss Rojas Figuera\u2019s case and gave him another court date, but <a href=\"https:\/\/www.ice.gov\/about-ice\" rel=\"nofollow noopener\" target=\"_blank\">ICE agents<\/a> detained Rojas Figuera anyway.<\/p>\n<p><img decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"Federal agents patrol the halls of immigration court at the Jacob K. Santiago\/Getty Images)<\/p>\n<p>\u201cTactics like those used to detain Jose present many city residents with an impossible choice: risk detention by attending court proceedings or run the same risk by failing to attend. Such tactics undermine the public interest,\u201d <a href=\"https:\/\/www.nyc.gov\/site\/law\/index.page\" rel=\"nofollow noopener\" target=\"_blank\">city Corporation Counsel<\/a> Muriel Goode-Trufant wrote in the brief. \u201cFree access to courts is a pillar of the rule of law. Our judicial system cannot work as it should, as it must, if courthouses are treated as convenient places to spring traps.\u201d<\/p>\n<p>The brief, filed in Brooklyn <a href=\"https:\/\/www.nyed.uscourts.gov\/\" rel=\"nofollow noopener\" target=\"_blank\">Federal Court<\/a>, said Rojas Figuera had a pending application for <a href=\"https:\/\/www.uscis.gov\/working-in-US\/eb4\/SIJ\" rel=\"nofollow noopener\" target=\"_blank\">Special Immigrant Juvenile Status<\/a> (SIJS) \u2014 a pathway to lawful permanent residency status for those younger than 21 who obtain a state court order finding they were abused, neglected or abandoned.<\/p>\n<p>Goode-Trufant said Rojas Figuera\u2019s detention has upended his SIJS court proceedings, and sent the message to other SIJS applicants that showing up to court could abruptly upend the legal residency process \u201cthey were otherwise willing to follow.\u201d<\/p>\n<p>\u201cI have always said that our immigrant New Yorkers should be able to go to court, send their children to school, seek medical care at our hospitals, and ask for help from our police officers when they are in need,\u201d Mayor Adams wrote in a statement. \u201cThat is what it means to be a safe city, and we will continue to fight to ensure that our public resources are safe, and that people \u2026 going through the legal process that we encourage for new arrivals are protected under the law.\u201d<\/p>\n<p>Paige Austin, an attorney at <a href=\"https:\/\/maketheroadny.org\/\" rel=\"nofollow noopener\" target=\"_blank\">Make the Road New York<\/a>\u00a0who is now repping Rojas Figuera and fighting for his release, said she was \u201creally grateful to the city for weighing in and sharing how harmful this policy is.\u201d<\/p>\n<p>\u201cHis dismissal was denied by the immigration judge. At the moment ICE detained him there was absolutely no change in his case, and no grounds to detain him,\u201d Austin said. \u201cThis detention served absolutely no purpose. It was cruel and it has deeply traumatized him and his mother.\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"lazyautosizes lazyload\" alt=\"Federal agents patrol the halls of immigration court at the Jacob K. (Photo by Michael M. Santiago\/Getty Images)<\/p>\n<p>After arriving in 2023, Rojas Figuera visited a city asylum help center, according to the brief. He attended public high school for roughly a year before leaving to work in order to support and care for his mother, who has severe diabetes, according to Austin.<\/p>\n<p>Austin said Rojas Figuera has had \u201ca really hard time in detention,\u201d noting that he\u2019d been first held at 26 Federal Plaza before being shuffled around to a detention facility in Nassau County and another in Texas. He was then returned to New York, where he is being held upstate.<\/p>\n<p>For the first five days he was unable to contact his mother, Austin said. Since returning to New York 10 days ago, he has again been incommunicado, unable to get phone access inside the jail.<\/p>\n<p>\u201cThe communication issues have been really hard for him because he really misses his mom and they\u2019re really close,\u201d Austin said. \u201cHe\u2019s very worried about his mom\u2019s health.
