{"id":359525,"date":"2025-11-06T10:01:23","date_gmt":"2025-11-06T10:01:23","guid":{"rendered":"https:\/\/www.europesays.com\/us\/359525\/"},"modified":"2025-11-06T10:01:23","modified_gmt":"2025-11-06T10:01:23","slug":"its-a-disgrace-chicagoans-describe-jarring-encounters-with-feds-as-judge-prepares-to-rule-on-blitz","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/359525\/","title":{"rendered":"&#8216;It&#8217;s a disgrace&#8217;: Chicagoans describe jarring encounters with feds as judge prepares to rule on &#8216;blitz&#8217;"},"content":{"rendered":"<p>For nearly every person who visited her courtroom Wednesday to talk about dodging tear gas, being shot in the head with pepperballs while praying, and having to stare down the barrel of a gun, U.S. District Judge Sara Ellis had a similar question.<\/p>\n<p>How did it affect them? Did they hesitate before protesting again? Did the experience \u201cplace a burden\u201d on their faith?<\/p>\n<p>Later, she interrupted a Justice Department lawyer who praised people for remaining courageous and steadfast in opposing the Trump administration\u2019s deportation campaign despite those experiences.<\/p>\n<p>\u201cIf they are making changes to what they do because they have been tear gassed, because they\u2019ve been hit in the head with a pepperball \u2014 twice \u2014 because they\u2019ve been staring down barrels of guns, then that is what matters,\u201d Ellis said.<\/p>\n<p>The judge made her comment hours ahead of a ruling she promised to hand down Thursday on whether to more permanently restrict the feds\u2019 treatment of protesters and journalists in Chicago during the campaign known as \u201cOperation Midway Blitz.\u201d<\/p>\n<p>An eight-hour hearing in her courtroom featured emotional testimony from witnesses who spoke of jarring encounters with armed federal agents, as well as sworn testimony by U.S. Border Patrol commander Gregory Bovino. And it revealed the ongoing disconnect over the level of danger faced here by federal law enforcement.<\/p>\n<p>Decorum even broke down at one point, with Ellis being forced to take two opposing lawyers into a hallway amid a slew of objections that started when a federal agent was challenged to say whether he\u2019d been out \u201clooking for people with brown skin?\u201d<\/p>\n<p>Bovino, in full uniform, testified on video that the use of force by federal agents in Chicago has been \u201cmore than exemplary.\u201d He also testified he would have used more tear gas in Little Village last month if he\u2019d had it. He denied that it\u2019s a \u201cserious\u201d or \u201cdangerous\u201d<b> <\/b>weapon<b> <\/b>and said it \u201cdoesn\u2019t harm people.\u201d<\/p>\n<p>Still, he later testified that agents properly arrested someone for kicking a tear gas can after it was thrown by agents because that\u2019s \u201cassaultive.\u201d<\/p>\n<p>Near the end of the day, lawyer Steven Art told Ellis the Trump administration defendants in the case \u201cshould be ashamed of themselves.\u201d<\/p>\n<p>\u201cIt\u2019s a disgrace,\u201d Art said of the way people in Chicago have been treated during Operation Midway Blitz. \u201cAnd one of the great things about our Constitution is that, if that\u2019s what we think, we can say it.\u201d<\/p>\n<p>Ellis previously forbade federal agents from using tear gas or other \u201criot control\u201d weapons against people who pose no immediate threat and without two warnings during the immigration campaign. However, that order expires at 11 a.m. Thursday.<\/p>\n<p>So Ellis says she will rule on a more permanent preliminary injunction at 10 a.m. Thursday. That ruling will almost certainly be appealed to the 7th U.S. Circuit Court of Appeals.<\/p>\n<p>The appellate court last week <a class=\"Link\" href=\"https:\/\/chicago.suntimes.com\/immigration\/2025\/10\/31\/bovinos-daily-meetings-with-judge-would-infringe-on-separation-of-powers-appeals-court-says\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">found that Ellis infringed<\/a> on the separation of powers by ordering Bovino to meet with her every weeknight over seven days to discuss agents\u2019 actions in Chicago, and whether it complied with her orders.<\/p>\n<p>Ellis presides over a lawsuit filed by media organizations such as the Chicago Headline Club, Block Club Chicago and the Chicago Newspaper Guild, which represents journalists at the Chicago Sun-Times.<\/p>\n<p>It amounts to one of the most significant pieces of litigation at the Dirksen Federal Courthouse since the feds\u2019 deportation campaign began. Judges there have also ruled against the Trump administration when it comes to <a class=\"Link\" href=\"https:\/\/chicago.suntimes.com\/donald-trump\/2025\/10\/09\/federal-judge-set-to-hear-arguments-in-high-stakes-national-guard-hearing\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">National Guard deployment<\/a> and <a class=\"Link\" href=\"https:\/\/chicago.suntimes.com\/news\/2025\/10\/09\/judge-rules-federal-agents-cant-deploy-chemical-irritants-at-journalists-protesters-who-dont-pose-threats\" target=\"_blank\" data-cms-ai=\"0\" rel=\"nofollow noopener\">conditions inside<\/a> the U.S. Immigration and Customs Enforcement facility in Broadview.<\/p>\n<p>On Wednesday, a judge issued a temporary restraining order in that case after hearing hours of testimony about unsanitary, \u201cprison-like\u201d conditions inside the facility. Meanwhile, Wednesday\u2019s hearing in Ellis\u2019 courtroom featured testimony about people\u2019s aggressive encounters with federal agents around the city.<\/p>\n<p>They included Leslie Cortez, an organizer for an environmental justice organization, who tried to film the arrest of a group of day laborers in early October. Eventually, she said an agent drew a weapon and pointed it at her. She said she could \u201csee inside the barrel.\u201d<\/p>\n<p>Ellis asked how that has affected her.<\/p>\n<p>\u201cI get really nervous,\u201d Cortez said. \u201cBecause it just feels like I\u2019m not safe. And I question my safety when I go out \u2026 I just worry that something will happen to me.\u201d<\/p>\n<p>Ald. Julia Ramirez (12th) described an early October incident in Brighton Park that included angry protests. She said an \u201carmored vehicle\u201d that \u201clooked very much like a tank\u201d arrived with an agent \u201con top of that vehicle pointing their gun down at the community.\u201d<\/p>\n<p>Ellis asked if that\u2019s caused a \u201cchilling effect\u201d on her willingness to protest. Ramirez, who is nine months pregnant,<b> <\/b>said she hasn\u2019t participated in downtown protests because \u201cI just feel like it\u2019s too much of a risk for me.\u201d<\/p>\n<p>But some of the most compelling video played Wednesday came from the rooftop of the facility in Broadview on Sept. 19. The Rev. David Black could be seen with his arms outstretched as puffs of smoke erupted on the ground around him.<\/p>\n<p>Black testified that he was praying and warning agents on the roof \u201cof the spiritual consequences of their actions\u201d when agents started firing pepperballs.<\/p>\n<p>Black testified that he was hit seven times, including twice in the head. He also said he now carries a GPS tracker in case he\u2019s confronted by immigration agents.<\/p>\n<p>Justice Department lawyer Sarmad Khojasteh challenged Black on whether he\u2019d stepped off the public sidewalk and over the property line. Ellis asked Black if it was fair to say his experience has \u201cplaced a burden\u201d on his faith.<\/p>\n<p>\u201cAbsolutely, yes,\u201d Black told her.<\/p>\n<p>                            <a class=\"AnchorLink\" id=\"image-ae0000\" name=\"image-ae0000\" data-cms-ai=\"0\"\/><\/p>\n<p>    <img loading=\"lazy\" decoding=\"async\" class=\"Image\" alt=\"A federal agent sprays Rev. In the video, played in court, Munchak yells, \u201cIt\u2019s almost like they\u2019re stormtroopers or something! \u2026 Smile nice, boys, for the Hague!\u201d<\/p>\n<p>When she left the scene, she said agents followed in SUVs. She said they blocked her car, rushed her vehicle, and aimed a gun at her head.<\/p>\n<p>She told Khojasteh the \u201cstormtrooper\u201d comment was a \u201cStar Wars\u201d reference. But when he asked if she believed agents were \u201cakin to war criminals,\u201d she said their methods are \u201ccruel,\u201d \u201cdraconian\u201d<b> <\/b>and \u201cstep over the line.\u201d<\/p>\n<p>The most contentious moments came when plaintiff attorney Jonathan Loevy questioned Border Patrol agent Hewson. Loevy asked Hewson how the deportation campaign works in practice and whether \u201cyou\u2019re looking for people with brown skin?\u201d<\/p>\n<p>\u201cI have arrested many people of all skin colors,\u201d Hewson insisted.<\/p>\n<p>\u201cWhen you are driving around looking for undocumented rapists and murderers, and you approach a brown-skinned guy walking his kids to school, do you \u2026 have an understanding that that might attract a crowd?\u201d<b> <\/b>Loevy asked.<\/p>\n<p>Hewson said he does not approach \u201cpeople of brown skin walking their kids to school\u201d and again insisted \u201cI\u2019ve approached all sorts of people.\u201d<\/p>\n<p>The exchange prompted a series of objections that led to Loevy and Justice Department lawyer Elizabeth Hedges being taken by Ellis out into a hallway. Later, Hedges had her own chance to question Hewson. He told her that \u201cjust putting your hands on somebody is not a use of force.
