The Trump administration is asking a judge to side with a group of red states in their lawsuit trying to strike down New York\u2019s climate Superfund law that would make select polluters pay for their emissions.<\/p>\n

The Department of Justice alleged in a brief<\/a> filed Nov. 7 that New York\u2019s law violates the US Constitution and is pre-empted by the Clean Air Act. The administration alleged the law is at odds with US foreign policy by adding to \u201cthe national energy emergency by imposing crushing penalties on global energy production,\u201d among other things. <\/p>\n
