{"id":372275,"date":"2025-11-11T20:07:17","date_gmt":"2025-11-11T20:07:17","guid":{"rendered":"https:\/\/www.europesays.com\/us\/372275\/"},"modified":"2025-11-11T20:07:17","modified_gmt":"2025-11-11T20:07:17","slug":"west-side-residents-steamed-over-academy-buses-idling-exemption-bid","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/372275\/","title":{"rendered":"West Side residents steamed over Academy buses idling-exemption bid"},"content":{"rendered":"<p>West Side residents in Manhattan are furious over a private <a href=\"https:\/\/www.amny.com\/nyc-transit\/mta-nyc-bus-routes-with-cameras-11112025\" target=\"_blank\" rel=\"noopener nofollow\">bus<\/a> company\u2019s not-so-idle threat to seek an exemption from NYC traffic idling laws, amNewYork learned on Tuesday.<\/p>\n<p>Academy, a company known in the metro area for its charter and group tour buses, is wreaking daily havoc, nearby residents say, by leaving engines running while idling on West 30th Street near 9th and 10th Avenues. Adding to its idle behavior, the company is simultaneously seeking an exemption from NYC\u2019s anti-idling regulations.<\/p>\n<p>\u201cAcademy submits this application for your consideration because Academy has done what it can to eliminate unnecessary idling and to reduce the impact of the emissions our buses produce,\u201d the bus company wrote in its variance request to the NYC Department of Environmental Protection (DEP) in September. \u201cHowever, providing bus service to visitors and residents of New York City involves some idling, which is necessary to keep essential systems powered as required by federal regulations.\u201d<\/p>\n<p>It was not immediately clear why Academy buses use this neighborhood to idle. The location is about 10 blocks south of the Port Authority Bus Terminal.\n<\/p>\n<p>Climate control, wheelchair lifts and onboard cameras are some of the systems that need to stay on when a bus is idling, Academy wrote in the application.\u00a0\n<\/p>\n<p>amNewYork contacted Academy to further inquire about their request and is awaiting a response.\u00a0\n<\/p>\n<p>A spokesperson for the DEP, which enforces the city\u2019s anti-idling laws, confirmed that Academy\u2019s variance request is pending and still under review.\n<\/p>\n<p>\u201cAs part of the process, DEP is considering comments received during the Oct. 29 hearing and in writing,\u201d the spokesperson said. \u201cIn addition, DEP is evaluating the feasibility of electrification or auxiliary power units (APUs) for these bus types.\u201d<\/p>\n<p>In NYC, with some exceptions, it is illegal for a vehicle to idle for more than three minutes or one minute if it is adjacent to a school. The law applies to both buses and trucks. Fines for not abiding range from $350 to $2,000.\u00a0<\/p>\n<p>Meanwhile, Hell\u2019s Kitchen residents are not buying into the bus company\u2019s excuses for the practice, dismissing them as \u201cwoefully inadequate.\u201d<br \/>\n<img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-137810410\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/11\/buses-dean-moses-111125.jpeg\" alt=\"people walking on a sidewalk and a bus parked in the street\" width=\"700\" height=\"467\" title=\"Engine upheaval: West Side residents steamed over charter bus company's idling-exemption bid 2\"  \/>Hell\u2019s Kitchen and Chelsea residents are concerned about buses that idle for extended periods of time on the West Side.Photo by Dean Moses\n<\/p>\n<p>The issue has become a major flashpoint for neighbors concerned about air quality and noise pollution. The bus depot is located directly below the windows of dormitories housing students from the Fashion Institute of Technology (FIT), amplifying the scope of the nuisance.<\/p>\n<p>\u201cWe strongly oppose the granting of an exemption to the idling law to Academy bus because their justification is woefully inadequate,\u201d Jesse Greenwald, co-chair of Manhattan <a href=\"https:\/\/cbmanhattan.cityofnewyork.us\/cb4\" target=\"_blank\" rel=\"noopener nofollow\">Community Board 4<\/a>\u2019s transportation planning committee, said. \u201cOur district is host to a large number of bus companies and has the third worst air quality in the city.\u201d<\/p>\n<p>According to the <a href=\"https:\/\/www.lung.org\/research\/sota\/city-rankings\/states\/new-york\/new-york\" target=\"_blank\" rel=\"noopener nofollow\">American Lung Association<\/a>, Hell\u2019s Kitchen and some nearby areas received an \u201cF\u201d grade for ozone. The grade is based on the number of days a county\u2019s air reaches unhealthful levels on the Air Quality Index. However, the organization monitors other types of particle pollution in the area, which received passing grades.\u00a0<\/p>\n<p>Greenwald explained that other bus companies have adopted \u201csimple solutions\u201d to help reduce idling.\u00a0\n<\/p>\n<p>\u201cFirst is to equip all buses with a turn-off at three minutes, and to train the drivers on using that,\u201d he said. \u201cThe solution was recently adopted by the attorney general of Washington, D.C., and has been implemented by many intercity carriers in that area.\u201d\u00a0<\/p>\n<p>On Oct. 9, Brian Schwalb, D.C.\u2019s attorney general, said local charter bus company DC Trails would pay $85,000 and program its bus engines to shut off after three minutes of idling as part of a settlement to address air pollution violations.\u00a0<\/p>\n<p>\u201cThis settlement holds DC Trails accountable for its persistent violations of the District\u2019s air pollution regulations, including requiring it to implement policies and procedures designed to protect air quality by preventing illegal bus idling,\u201d Schwalb said. \u201cThe Office of the Attorney General will continue working closely with the Department of Energy and Environment to enforce our environmental laws, stop pollution, and protect District residents.\u201d<\/p>\n<p>He also suggested the use of an auxiliary engine, which can keep certain onboard systems running, even if the main engine is shut off.\u00a0\n<\/p>\n<p>However, in its variance request, the Academy stated that it has not been able to find auxiliary products \u201ccapable of providing power for the critical onboard system.\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-137810411\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/11\/buses-west-side-dean-moses-111125.jpeg\" alt=\"several buses on a street\" width=\"700\" height=\"578\" title=\"Engine upheaval: West Side residents steamed over charter bus company's idling-exemption bid 3\"  \/>Academy buses on the West Side.Photo by Dean Moses<\/p>\n<p>Bryce Stack, who lives in Chelsea, said he complained about the issue multiple times to DEP, but the buses still idle.\u00a0<\/p>\n<p>\u201cThey haven\u2019t stopped. I\u2019m frankly very disappointed that they\u2019re going for this variance,\u201d he said. \u201cI\u2019m really concerned if they get it, all the other bus companies will follow suit.\u201d<\/p>\n<p>Meanwhile, Christine Berthet, a local activist in the area, said in a <a href=\"https:\/\/w42st.com\/post\/fatal-blow-idling-law-new-york-academy\" target=\"_blank\" rel=\"noopener nofollow\">W42ST <\/a>article that the exemption would worsen air quality in the area.<\/p>\n<p>\u201cAnd it risks undermining one of the city\u2019s most effective environmental laws,\u201d she added.\u00a0\n<\/p>\n<p>The DEP is continuing to review the variance request; however, no date has been set for when a decision will be made.
