A federal judge in Chicago has ordered the\u00a0Department of Homeland Security\u00a0(DHS) to release more than 600 illegal immigrants <\/a>held at a suburban detention center, blasting the agency for \u201crepeated, material violations\u201d of a court-approved consent decree that limited who could be detained under US immigration law.<\/p>\n

US District Judge Jeffrey Cummings ruled that more than 600 detainees being held at the\u00a0Broadview ICE center\u00a0must be released \u201con bond and into ICE\u2019s Alternatives to Detention (ATD) program\u201d<\/a> by Nov. 21, citing what he called a \u201cpattern of unlawful arrests and confinement.\u201d<\/p>\n

The order stems from Margarito Casta\u00f1on Nava v. DHS, a class-action lawsuit claiming federal agents unlawfully detained hundreds of migrants who were not subject to mandatory detention or final removal orders, a direct violation of a 2021 Biden-era decree inherited by the Trump administration.<\/p>\n

In the ruling, Cummings accused DHS of holding migrants in \u201cunsafe and unsanitary\u201d conditions, saying detainees had been kept in overcrowded buildings \u201cnext to overflowing toilets.\u201d The judge further said the department\u2019s recent reversal on detention authority represented a \u201c180-degree change\u201d from previous legal interpretations.<\/p>\n

The decision could force the largest single-day release of ICE detainees in Illinois in years, freeing hundreds arrested during \u201cOperation Midway Blitz,\u201d<\/a>\u00a0a Trump enforcement sweep that immigration activists claim traumatized communities across the Chicago area.<\/a><\/p>\n
