Credit: Shutterstock \/ Philip Arno Photography<\/p>\n<p>A San Antonio federal judge has issued a preliminary injunction requiring Comal School District and eight others to remove displays of the Ten Commandments by Dec. 1.<\/p>\n<p><a href=\"https:\/\/www.aclutx.org\/sites\/default\/files\/cribbs-ringer-v.-comal-isd-tro-11.18.25.pdf\" target=\"_blank\" rel=\"noopener\">The order<\/a> issued Tuesday by U.S. District Judge Orlando L. Garcia is yet another blow to the Republican-controlled Texas Legislature\u2019s recently Senate Bill 10, which mandates that public schools place the religious text in every classroom despite federal courts <a href=\"https:\/\/www.npr.org\/2025\/06\/21\/nx-s1-5441035\/louisiana-ten-commandments-schools-court-blocks\" target=\"_blank\" rel=\"noopener\">striking down a nearly identical Louisiana law<\/a>.<\/p>\n<p>Garcia\u2019s ruling came in response to a lawsuit <a href=\"https:\/\/www.sacurrent.com\/news\/texas-news\/yet-another-suit-filed-in-san-antonio-federal-court-to-challenge-texas-ten-commandments-law\/\" target=\"_blank\" rel=\"noopener\">filed this fall<\/a> by 15 multi-faith and nonreligious families with children attending schools in the districts named as defendants. In his ruling, the judge said the legislation violates the Establishment Cause of the U.S. Constitution, which bars the government from establishing an official religion or favoring one over others.<\/p>\n<p>\u201cIt is impractical, if not impossible, to prevent Plaintiffs from being subjected to unwelcome religious displays without enjoining Defendants from enforcing SB 10 across their districts,\u201d Garcia wrote. <\/p>\n<p>The defendants moved ahead with hanging posters showing the Ten Commandments despite an <a href=\"https:\/\/www.sacurrent.com\/news\/san-antonio-judge-temporarily-blocks-texas-ten-commandments-rule-in-11-school-districts-38321196\/\" target=\"_blank\" rel=\"noopener\">August ruling<\/a> in a separate federal lawsuit calling the posters\u2019 installation in other districts \u201cplainly unconstitutional.\u201d Families involved both cases sent letters to all Texas school districts urging them not to act on SB 10\u2019s mandate. <\/p>\n<p>\u201cI am relieved that as a result of today\u2019s ruling, my children, who are among a small number of Jewish children at their schools, will no longer be continually subjected to religious displays,\u201d\u00a0plaintiff Lenee Bien-Willner said in a statement about Garcia\u2019s ruling. \u201cThe government has no business interfering with parental decisions about matters of faith.\u201d<\/p>\n<p>The plaintiffs in both cases are represented by the American Civil Liberties Union of Texas, the ACLU, Americans United for Separation of Church and State and the Freedom From Religion Foundation. Simpson Thacher &amp; Bartlett LLP served as pro bono counsel.<\/p>\n<p>ACLU officials said the latest ruling indicates all Texas school districts \u2014\u00a0even those not directly involved in the litigation\u00a0\u2014 should follow the U.S. Constitution, which supersedes state law.<\/p>\n<p>\u201cToday\u2019s ruling is yet another affirmation of what Texans already know: The First Amendment guarantees families and faith communities \u2014\u00a0not the government \u2014\u00a0the right to instill religious beliefs in our children,\u201d ACLU staff attorney Chloe Kempf said. \u201cOur schools are for education, not evangelization. This ruling protects thousands of Texas students from ostracization, bullying, and state-mandated religious coercion. Every school district in Texas is now on notice that implementing SB 10 violates their students\u2019 constitutional rights.\u201d<\/p>\n<p class=\"has-normal-font-size\"><a
