{"id":390609,"date":"2025-11-19T19:56:18","date_gmt":"2025-11-19T19:56:18","guid":{"rendered":"https:\/\/www.europesays.com\/us\/390609\/"},"modified":"2025-11-19T19:56:18","modified_gmt":"2025-11-19T19:56:18","slug":"eminem-sues-australian-beach-brand-swim-shady-for-trademark-infringement","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/390609\/","title":{"rendered":"Eminem sues Australian beach brand Swim Shady for trademark infringement"},"content":{"rendered":"<p>Will the real Slim Shady please stand up?<\/p>\n<p>Eminem has taken legal action against an Australian beachwear brand called Swim Shady due to the company name being too similar to <a href=\"https:\/\/nypost.com\/2024\/09\/11\/entertainment\/eminem-opens-vmas-2024-with-death-of-slim-shady-tv-debut\/\" target=\"_blank\" rel=\"noopener\">his Slim Shady alter ego.<\/a><\/p>\n<p>The <a href=\"https:\/\/nypost.com\/2020\/02\/09\/eminem-surprises-2020-oscars-with-lose-yourself-performance-from-8-mile\/\" target=\"_blank\" rel=\"noopener\">\u201cLose Yourself\u201d rapper<\/a>, whose real name is Marshall Mathers III, filed his petition against Swim Shady with the US Patent and Trademark Office on Sept. 29, per a filing obtained by The Post.<\/p>\n<p>Eminem performs in Detroit, Michigan, on June 6, 2024. Swim Shady<\/p>\n<p>Eminem, 53, alleged that the brand\u2019s US trademark violates his own trademark on the \u201cShady\u201d name and implies a \u201cfalse association\u201d between him and the company\u2019s products.<\/p>\n<p>The hip-hop legend further argued that Swim Shady consumers are \u201clikely to be confused\u201d by the similar names and that the difference between one letter \u201cdoes not serve to distinguish\u201d the brand enough from the rapper.<\/p>\n<p>Eminem accused the Australian company \u2013 which sells beach umbrellas, bags, swimwear and more \u2013 of one count of dilution and one count of confusion in his filing.<\/p>\n<p>Slim Shady argued that Swim Shady consumers are \u201clikely to be confused\u201d by the similar names. Penske Media via Getty Images<\/p>\n<p>He went on to express concern that the continued use of \u201cSwim Shady\u201d could \u201cseriously injure the reputation\u201d of his brand or else cause \u201cblurring and tarnishment of the distinctive quality\u201d of his name.<\/p>\n<p>Swim Shady, meanwhile, has insisted that it would \u201cdefend our valuable intellectual property.\u201d<\/p>\n<p>\u201cSwim Shady is a grassroots Australian company that was born out of a desire to produce stylish and effective sun shades and other items to protect from the harsh Australian sun,\u201d the company told The Post in a statement.<\/p>\n<p>Swim Shady plans to \u201cdefend our valuable intellectual property\u201d despite Eminem\u2019s lawsuit. Swim Shady<\/p>\n<p>\u201cWe will defend our valuable intellectual property,\u201d it added. \u201cGiven the matters are before the court, we do not propose to say any more at this time.\u201d<\/p>\n<p>Although Eminem has held US trademarks for \u201cShady\u201d and \u201cSlim Shady\u201d since July 2001, per his filing, the business regulator <a href=\"https:\/\/search.ipaustralia.gov.au\/trademarks\/search\/view\/2518197?q=slim+shady\" target=\"_blank\" rel=\"noopener\">IP Australia<\/a> shows that he didn\u2019t apply to trademark \u201cSlim Shady\u201d in the country until January of this year.<\/p>\n<p>Swim Shady, on the other hand, registered its trademark as \u201cSlim Shade\u201d in Australia in 2023 before officially launching its current brand one year later.<\/p>\n<p>Swim Shady sells beach umbrellas, bags, swimwear and other beachware. Getty Images<\/p>\n<p>The company filed a US trademark for \u201cSwim Shady\u201d earlier this year, and the \u201cWithout Me\u201d rapper has since filed petitions to cancel the brand\u2019s trademarks in both countries.<\/p>\n<p>Swim Shady has until Nov. 28 to respond to Eminem\u2019s petition.<\/p>\n<p>The Post has reached out to Eminem\u2019s rep for comment.<\/p>\n<p>The \u201cWithout Me\u201d rapper has filed petitions to cancel Swim Shady\u2019s trademarks in both Australia and the US. Getty Images<\/p>\n<p>Eminem previously trademarked the name \u201cMom\u2019s Spaghetti\u201d from his 2002 song \u201cLose Yourself.\u201d<\/p>\n<p>However, this wouldn\u2019t be the first time the \u201cRelapse\u201d artist has waged a trademark battle over his name and likeness.<\/p>\n<p>\u201cThe Real Housewives of Potomac\u201d\u00a0stars\u00a0Gizelle Bryant\u00a0and Robyn Dixon received a legal complaint <a href=\"https:\/\/pagesix.com\/2023\/02\/20\/eminem-files-opposition-to-gizelle-bryant-robyn-dixons-podcast\/\" target=\"_blank\" rel=\"noopener\">over the name of their \u201cReasonably Shady\u201d podcast<\/a> in February 2023. That case is reportedly still ongoing.<\/p>\n<p>Eminem has also <a href=\"https:\/\/nypost.com\/2021\/09\/30\/eminem-delights-fans-with-surprise-shift-at-moms-spaghetti\/\" target=\"_blank\" rel=\"noopener\">trademarked the name \u201cMom\u2019s Spaghetti,\u201d<\/a> which he first made famous in his 2002 hit \u201cLose Yourself.\u201d<\/p>\n<p>The rapper later launched a \u201cMom\u2019s Spaghetti\u201d pasta sauce, merchandising brand and pop-up shop in 2017, before <a href=\"https:\/\/nypost.com\/2021\/09\/28\/eminem-opens-detroit-restaurant-called-moms-spaghetti\/\" target=\"_blank\" rel=\"noopener\">turning the shop into a permanent restaurant<\/a> in his hometown of Detroit in 2021.<\/p>\n","protected":false},"excerpt":{"rendered":"Will the real Slim Shady please stand up?
