{"id":392685,"date":"2025-11-20T17:20:22","date_gmt":"2025-11-20T17:20:22","guid":{"rendered":"https:\/\/www.europesays.com\/us\/392685\/"},"modified":"2025-11-20T17:20:22","modified_gmt":"2025-11-20T17:20:22","slug":"nyc-transit-worker-accused-of-violating-rest-rules-working-as-welder-in-private-business","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/392685\/","title":{"rendered":"NYC Transit worker accused of violating \u2018rest rules,\u2019 working as welder in private business"},"content":{"rendered":"<p>\t\t\t\t<img width=\"1200\" height=\"900\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/11\/sutter-ave-station-101625-lennon.jpg\" class=\"crop-center wp-post-image\" alt=\"stairs leading up to a train station\" decoding=\"async\" fetchpriority=\"high\"   title=\"NYC Transit worker accused of violating \u2018rest rules' with side hustle as a private welder 1\"\/>\t\t\t<\/p>\n<p>The Sutter Avenue station, home to the L train.<\/p>\n<p>Photo by Barbara Russo-Lennon<\/p>\n<p>A nearly two-year investigation found that a <a href=\"https:\/\/www.mta.info\/agency\/new-york-city-transit\" target=\"_blank\" rel=\"noopener\">NYC Transit<\/a> worker earned a whopping $300,000 while repeatedly violating the job\u2019s \u201crest rules,\u201d performing outside work as a welder for at least nine private companies, the MTA Inspector General\u2019s Office said on Thursday.\u00a0<\/p>\n<p>According to the scathing report, MTA Inspector General (IG) Daniel Cort said the employee, a structure maintainer who worked an overnight shift, \u201cignored the rest requirements\u201d for his safety-sensitive job at least 32 times.<\/p>\n<p>\u201cRest rules\u201d are in place to prevent on-the-job fatigue, especially for hands-on positions that require the utmost attention to machinery or operation. A structure maintainer at the MTA usually performs maintenance and repairs within the transit system.\u00a0<\/p>\n<p>The maintainer, who was hired by NYC Transit in 2012, received outside funding with his side hustle between April 2020 and July 2024, according to the report.\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-137812587\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/11\/welder-getty.jpg\" alt=\"welder at work nyc transit worker\" width=\"1200\" height=\"799\" title=\"NYC Transit worker accused of violating \u2018rest rules' with side hustle as a private welder 2\"  \/>The maintainer, who was hired by NYC Transit in 2012, received outside funding with his side hustle as a welder between April 2020 and July 2024, according to the report.\u00a0Photo via Getty Images<\/p>\n<p>\u201cThis employee\u2019s behavior jeopardized both his safety and the safety of others,\u201d Cort said. \u201cOutside employment rules exist for good reason: to safeguard the system, its workforce, and its customers, to avoid conflicts of interest, and to prevent time abuse. Those who violate the rules will be held accountable.\u201d<\/p>\n<p>The deep dive into the employee\u2019s questionable behavior began in April 2024. Someone made an anonymous complaint alleging that while the maintainer was performing outside work for a subcontractor installing windscreens on an NYC Transit project, he produced a track safety training card that is only issued to NYC Transit employees, the IG\u2019s office explained.<\/p>\n<p>Per the watchdog\u2019s investigation, a review of NYC Transit records, bank records, and other documents showed how much the employee was doing outside work. Only after the inspector general subpoenaed his outside employers did the maintainer fill out a \u201cdual employment request,\u201d according to the investigation.<\/p>\n<p>The maintainer admitted that he is required to have his outside employment approved by NYC Transit and claimed that he filed a dual employment form in 2017, but OIG found no record of that request, the investigation noted.\u00a0<\/p>\n<p>Meanwhile, the maintainer\u2019s supervisor said he was \u201cunaware\u201d that he was responsible for reviewing and approving his staff\u2019s outside employment requests.\u00a0<\/p>\n<p>The maintainer already served a five-month, unpaid suspension and was issued a final warning. His supervisor was re-instructed on how to handle employee requests for dual employment, the IG\u2019s office said.\u00a0<\/p>\n<p>amNewYork contacted the MTA for a comment on this story and is awaiting a response.\u00a0\n<\/p>\n<p>The report follows an investigation that occurred last month in which a group of workers from the MTA\u2019s Long Island Rail Road were <a href=\"https:\/\/www.amny.com\/news\/lirr-workers-accused-of-time-abuse-10232025\" target=\"_blank\" rel=\"noopener\">accused of making, selling and using cloned swipe cards<\/a> to get paid while not working.\u00a0<\/p>\n<p>The inspector\u2019s investigation led to disciplinary actions, including suspensions and resignations, against the accused employees, who were not publicly named. <\/p>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"The Sutter Avenue station, home to the L train.
