Jon Husted delivered a detailed healthcare policy pitch in a Senate floor speech Thursday, outlining his approach to resolving a dispute over Affordable Care Act premium subsidies that was a sticking point during the 43-day government shutdown that ended earlier this month. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FOA7AAGTGVFZZHAOO3YEZOF5KI\">The Columbus-area Republican, who was appointed to fill Vice President JD Vance\u2019s seat in January and must win a November 2026 special election to keep the job, focused on what he called a \u201cfraud, freeze and fix approach\u201d to healthcare reform, which he said could be paired with \u201ca short extension of the premium subsidies\u201d to address ACA shortcomings.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FA3NBHG3ZFHWTEQSWAV7CADNBU\">\u201cI have been in the Senate less than a year, and I wasn\u2019t here when Congress passed Obamacare or the Biden COVID subsidies that have been used to prop up the ACA exchanges,\u201d said Husted, who serves on the Senate\u2019s Health, Education, Labor and Pensions Committee. \u201cBut I want to be part of the solution.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WLQJGTON2ZC2LPEENBRU3W445Q\">Husted, who faces a competitive 2026 race against former Democratic U.S. Sen. Sherrod Brown, noted that <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-bill\/2529\/text?s=1&amp;r=9\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-bill\/2529\/text?s=1&amp;r=9\">bipartisan legislation<\/a> he sponsored called the <a href=\"https:\/\/www.husted.senate.gov\/press-releases\/icymi-husted-bill-to-expand-access-to-affordable-medications-becomes-law\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.husted.senate.gov\/press-releases\/icymi-husted-bill-to-expand-access-to-affordable-medications-becomes-law\/\">SMART OTC Act<\/a>, became law this month when it was included in recent government funding legislation.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MQAFMUXIMRDJ5N6L74MHQQ37RQ\">The legislation reforms the Food and Drug Administration\u2019s process for converting prescription drugs to over-the-counter status. Husted noted that when prescription drugs become available over the counter, \u201cprices go down. In fact, on average, cases where we\u2019ve been able to do this reduces prices from 30 to 95%.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VB7JKJCJT5G3JN2WB5VFSTQPYE\">The bulk of Husted\u2019s speech focused on what he called a \u201cfraud, freeze and fix approach\u201d to healthcare reform, which he said could be paired with \u201ca short extension of the premium subsidies\u201d to address ACA shortcomings.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"J4K2BOQD2BAORBJZ5CG7FC7OMI\">Using a chart displayed on the Senate floor, Husted argued that healthcare inflation has been \u201cthe number one driver of inflation in the 21st century,\u201d claiming the ACA made medical costs go up.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GWNJ24DUUNES7CM6NUTCI74QZU\">Husted highlighted what he described as widespread fraud in ACA marketplace enrollment, attributing much of it to zero-premium subsidies created in 2021. He said brokers enroll people who didn\u2019t ask for coverage, insurance companies get paid, the brokers get commissions, and taxpayers foot the bills.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"3ZLTE5CINZB5NLSBMMW7VZAWMM\">He claimed that \u201chard-working taxpayers have footed the bill for almost $35 billion to insurers who enrolled people who did not use the plan a single time,\u201d adding there have been \u201ccriminal convictions in many states\u201d related to such fraud.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NWCT4M5OFZFYHBWFSKSJ5FLTKE\">The fraud problem Husted described is well-documented. Between January and August 2024, federal regulators received approximately 275,000 complaints about unauthorized enrollments or plan changes, according <a href=\"https:\/\/www.commonwealthfund.org\/blog\/2025\/policymakers-can-protect-against-fraud-aca-marketplaces-without-hiking-premiums\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.commonwealthfund.org\/blog\/2025\/policymakers-can-protect-against-fraud-aca-marketplaces-without-hiking-premiums\">to the Commonwealth Fund<\/a>, a private foundation that aims to improve healthcare systems and promote health equity in the United States through research, policy analysis, and grantmaking. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4KCI77RWQ5HPVCKFPRD2PXEDH4\">This week, <a href=\"https:\/\/www.justice.gov\/opa\/pr\/president-insurance-brokerage-firm-and-ceo-marketing-company-convicted-233m-affordable-care\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.justice.gov\/opa\/pr\/president-insurance-brokerage-firm-and-ceo-marketing-company-convicted-233m-affordable-care\">a federal jury in West Palm Beach convicted two men<\/a> for their roles in a scheme that sought over $233 million in fraudulent ACA plan subsidies, according to the Justice Department. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QQFD4BSFINEENFJNTDGNEFQH34\">The fraud typically works through lead-generating firms running fraudulent ads that lure consumers with false promises of cash benefits, then enrolling them without their knowledge in zero-premium plans. Armed with only a person\u2019s name, date of birth and state, a licensed agent can access coverage through the federal exchange. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"KTBJP77TJJHORKYH5YSACWVKXA\">Husted proposed requiring everyone receiving a premium tax credit to pay at least a small amount toward their healthcare insurance, saying this would \u201chelp realign the incentives and reduce fraud\u201d and ensure Americans cannot be enrolled in plans without their knowledge.<\/p>\n<p>The \u201cfreeze\u201d component<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6REM4QJURRGWJNA6AKQBZLFQX4\">Husted called for limiting subsidies \u201cto where they are right now\u201d to prevent the burden on taxpayers from growing. He proposed appropriating cost-sharing reduction payments, which he said could \u201clower premiums by 10 to 20% while also delivering savings to the taxpayer.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"M5BHHWUDNNDF5L3IFY6CZG3JCY\">This refers to a complicated ACA pricing mechanism known as \u201csilver loading.\u201d After a 2017 federal court ruling found that cost-sharing reduction payments violated the appropriations clause, the Trump administration ended direct federal payments to insurers, though insurers remained required to provide the reductions. Most insurers responded by raising <a href=\"https:\/\/www.kff.org\/affordable-care-act\/explaining-cost-sharing-reductions-and-silver-loading-in-aca-marketplaces\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.kff.org\/affordable-care-act\/explaining-cost-sharing-reductions-and-silver-loading-in-aca-marketplaces\/\">premiums on silver marketplace<\/a> plans to cover these costs, a practice called silver loading. Because ACA premium subsidies are calculated based on the second-lowest-cost silver plan, <a href=\"https:\/\/www.brookings.edu\/articles\/understanding-marketplace-silver-loading\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.brookings.edu\/articles\/understanding-marketplace-silver-loading\/\">silver loading has increased federal subsidy spending <\/a>beyond what it would have been with direct payments.<\/p>\n<p>The \u201cfix\u201d portion<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OLY5OJM64JHRDOFTLGVNFJLIYY\">The \u201cfix\u201d portion, which Husted called \u201cthe most important part,\u201d focused on several bipartisan healthcare initiatives he said would lower actual costs rather than just transferring the burden.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MEJGYMKNHBE73FCZRMKX3BLHSU\">\u201cSubsidies do not lower costs, they transfer the burden,\u201d Husted said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"D7UTM7ZTHBDH5EQHVTYP4DGPHQ\">He highlighted price transparency as \u201cone of the most bipartisan ideas in this chamber,\u201d saying it would give patients, employers and small businesses the power to see and compare prices. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Q6DG3O466JBCHCQ6RMLGUHGRK4\">Husted also pointed to pharmacy benefit manager reform, saying there\u2019s \u201cbipartisan appetite to lower the cost of prescription drugs by addressing the role that middlemen play\u201d in increasing costs. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"P2PB5Y64ANBAFDS7FOJFRDT4RM\">The senator also endorsed President Trump\u2019s proposal for Health Savings Account expansion, \u201cwhere we send money to the consumers rather than to the insurance companies,\u201d though he noted transparency is necessary \u201cif you expect people to shop.\u201d<\/p>\n<p>Political context<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DOGVV7NGHJCVHLOBHWB66L5X4Q\">The healthcare speech comes as Husted faces his first election campaign for the Senate seat. Former Democratic U.S. Sen. Sherrod Brown, who served three terms before losing to Westlake Republican Sen. Bernie Moreno last November, <a href=\"https:\/\/www.cleveland.com\/news\/2025\/08\/sherrod-brown-to-run-for-us-senate-in-2026-challenging-jon-husted.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.cleveland.com\/news\/2025\/08\/sherrod-brown-to-run-for-us-senate-in-2026-challenging-jon-husted.html\">announced in August<\/a> he would seek Husted\u2019s seat.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"PI6ND37TDVECNPRKWK72J3BQMQ\">An <a href=\"https:\/\/emersoncollegepolling.com\/ohio-2026\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/emersoncollegepolling.com\/ohio-2026\/\">Emerson College poll<\/a> released in August showed Husted leading Brown 50% to 44%, though a more recent<a href=\"https:\/\/www.newsweek.com\/sherrod-brown-chances-beating-jon-husted-flip-ohio-democrats-poll-11036495\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.newsweek.com\/sherrod-brown-chances-beating-jon-husted-flip-ohio-democrats-poll-11036495\"> Hart Research poll <\/a>conducted for the Ohio Federation of Teachers found Brown ahead 48% to 45%. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OMEXCIEDNVFT3MTZS5XNV2RZGQ\">Healthcare has emerged as a key issue in the race. On November 9, <a href=\"https:\/\/twitter.com\/SherrodBrown\/status\/1987696139450118581\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/twitter.com\/SherrodBrown\/status\/1987696139450118581\">Brown posted on X t<\/a>hat \u201chalf a million Ohioans are facing monthly premiums that are double or triple what they were paying,\u201d calling it \u201ca problem created by Jon Husted and his special interest friends.\u201d <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XDBLQSVY7ZEWZJTTKQSBETVED4\">In his floor speech, Husted framed his approach as protecting both families and the federal budget. \u201cTwo things we need to do: Protect families from the cost, the inflationary costs that the ACA has created, but also protect the taxpayer,\u201d he said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"CL5JZKI5KJFJZDG74QX2EJD2EE\">He positioned himself as seeking middle ground: \u201cIf this debate ends with one side saying extend everything and the other side saying we oppose everything, nothing will get done, and we will have failed the American people.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GPDUNBZWVBA5JHTYPV7NB63JO4\">Emphasizing his newcomer status, Husted said, \u201cI am the newest member of the U.S. Senate.
