(Photo by Joe Raedle\/Getty Images)<\/p>\n<p>THE TRUMP ADMINISTRATION last week announced convictions in a major fraud case against two men accused of enrolling people in the Affordable Care Act under false pretenses and then collecting the commissions.<\/p>\n<p>The men <a href=\"https:\/\/www.justice.gov\/opa\/pr\/president-insurance-brokerage-firm-and-ceo-marketing-company-convicted-233m-affordable-care\" rel=\"nofollow noopener\" target=\"_blank\">targeted<\/a> the homeless and people suffering from substance abuse, sometimes coaching them on how to qualify for coverage, according to evidence federal prosecutors presented to a jury in West Palm Beach, Florida. The pair collected millions in fees, while triggering about $180 million worth of federal payments to insurers, before the feds caught on to them.<\/p>\n<p>The <a href=\"https:\/\/www.law360.com\/trials\/articles\/2412091\/2-execs-found-guilty-in-233m-aca-fraud-scheme\" rel=\"nofollow noopener\" target=\"_blank\">conviction<\/a> was a tribute to the skills of federal investigators and prosecutors. But Trump administration officials highlighted the announcement for another reason, one that should sound familiar to you. They used it to strengthen their case against the Affordable Care Act\u2014a.k.a. Obamacare.<\/p>\n<p>For months, administration officials and their allies have been pointing to stories of fraudulent enrollment as proof the law is a hopeless, wasteful boondoggle. They did so in the spring and summer, to justify some of the Affordable Care Act cuts that were in the Republicans\u2019 <a href=\"https:\/\/www.thebulwark.com\/p\/an-ignominious-bill-passed-by-an-inglorious-body-afflict-afflicted-comfort-comfortable-trump-republicans-medicaid-bbb\" rel=\"nofollow noopener\" target=\"_blank\">One Big Beautiful Bill<\/a>. And they\u2019re doing so now, as part of the debate over whether to extend the Affordable Care Act\u2019s <a href=\"https:\/\/www.thebulwark.com\/p\/if-the-government-shuts-down-obamacare-will-be-why-subsidies-health-care-costs\" rel=\"nofollow noopener\" target=\"_blank\">enhanced subsidies<\/a> that are set to expire at year\u2019s end.<\/p>\n<p>\u201cThey ripped all of us off $180 million\u2014that\u2019s what they took before being stopped,\u201d Mehmet Oz, the Trump administration official who oversees the Affordable Care Act, said in a <a href=\"https:\/\/x.com\/drozcms\/status\/1991591341235773833\" rel=\"nofollow\">video<\/a> accompanying the Justice Department\u2019s announcement on Thursday. \u201cThese rackets are real, and we need to fix the Obamacare subsidies that allow it to happen so frequently.\u201d<\/p>\n<p>The argument might sound persuasive, in part because enrollment scams <a href=\"https:\/\/www.npr.org\/sections\/health-shots\/2024\/05\/07\/1249417648\/aca-health-insurance-brokers-obamacare-stop-fraud\" rel=\"nofollow noopener\" target=\"_blank\">really<\/a> have been an issue in the Affordable Care Act marketplaces. But there is good reason to think that Oz and other critics of the program are both overstating and mischaracterizing the fraud. There is even more reason to think \u201cfixing\u201d the Affordable Care Act subsidies in the way many Republicans envision is not just wholly unnecessary but likely to be harmful.<\/p>\n<p>Partly that\u2019s because fraud is not an Obamacare problem. It\u2019s an American health care problem, endemic to a system with such high costs and so many confusing paths to coverage.
