Tips ot keep things from getting messy."},"content":{"rendered":"<p><img decoding=\"async\" style=\"position:absolute;top:0;left:0;right:0;bottom:0;width:100%;height:100%;z-index:2\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/06\/81760351007-digital-legacy-8.jpg\"\/><img decoding=\"async\" class=\"vidplayicon\" src=\"https:\/\/www.gannett-cdn.com\/appservices\/universal-web\/universal\/icons\/icon-play-alt-white.svg\" alt=\"play\" style=\"height:40px;margin:auto 18px auto 27px;width:40px\"\/><\/p>\n<p>Easy, affordable ways to create a will online<\/p>\n<p>Online will makers can help you divvy up your assets the way you want to at a more affordable rate.<\/p>\n<p>Problem Solved<\/p>\n<p>&#8220;The best-laid plans of mice and men often go awry,&#8221; wrote poet Robert Burns.<\/p>\n<p>That may be no truer than in estate planning.<\/p>\n<p>Rupert Murdoch, 94, patriarch of the News Corp empire, last year lost a <a href=\"https:\/\/www.usatoday.com\/story\/news\/money\/business\/2025\/05\/07\/rupert-murdoch-family-trust-case\/83503671007\/\" target=\"_blank\" rel=\"noreferrer noopener\">legal battle<\/a> over <a href=\"https:\/\/www.usatoday.com\/story\/news\/2024\/09\/13\/murdoch-succession-battle-to-play-out-in-reno-courtroom\/75193711007\/\" target=\"_blank\" rel=\"noreferrer noopener\">control of his media businesses<\/a>, including Fox News. <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2023\/09\/05\/jimmy-buffett-death-cancer-tribute-american-original\/70761396007\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jimmy Buffett<\/a>\u2019s widow Jane and his longtime business manager and financial adviser Richard Mozenter currently have dueling lawsuits for control of the late Margaritaville singer\u2019s $275 million estate.<\/p>\n<p>With the great wealth transfer underway, people \u2013 even the rich, famous and business savvy \u2013 still struggle to get the transfer right. Laws, assets and especially, relationships change over time, making long-term planning tricky.<\/p>\n<p>\u201cEffective estate planning accounts for the moment when family members no longer see eye to eye, rather than assuming harmony will last,\u201d said Kevin Ghassomian, Venable LLP partner.<\/p>\n<p>What could go wrong?<\/p>\n<p>More Baby Boomers \u2013 the largest generation until recently \u2013 are aging, <a href=\"https:\/\/www.usatoday.com\/story\/money\/2025\/04\/29\/alzheimers-cure-americans-research-cuts\/83213014007\/\" target=\"_blank\" rel=\"noopener\">suffering from dementia<\/a>, dying, and according to research and consulting firm Cerulli Associates, passing on their nearly $70 trillion in assets between 2018 and 2042.<\/p>\n<p>All those factors, and more, contribute to the increase in estate litigation, lawyers said. The State of New York\u2019s court system, for example, reported an approximate 350% increase to 3,500 from 1,005 in contested estate cases between 2016 and 2019.\u00a0They declined in 2020 amid pandemic-related court closures, but the growing trend remains intact.<\/p>\n<p>Some well-known figures have recently been at the center of such legal battles.<\/p>\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.usatoday.com\/videos\/news\/2024\/09\/16\/future-of-murdoch-media-empire-to-be-decided-in-court\/75256042007\/\" target=\"_blank\" rel=\"noreferrer noopener\">Murdoch used an irrevocable trust<\/a>, which typically isn\u2019t changeable, to give each of four children equal voting rights over his famously conservative media empire. Court proceedings are sealed, but according to accounts from journalists&#8217; sources privy to confidential documents, as years passed, Murdoch began to feel his oldest son Lachlan would best reflect and carry on his right-leaning views. He tried to change the trust to give Lachlan full control of his businesses while keeping intact the equal financial split among the children, news reports said.<\/li>\n<\/ul>\n<p>Ultimately, a <a href=\"https:\/\/www.usatoday.com\/story\/news\/2024\/12\/09\/rupert-murdoch-media-empire-trust-hearing-reno\/76866316007\/\" target=\"_blank\" rel=\"noreferrer noopener\">Nevada probate commissioner ruled<\/a> father and son acted in \u201cbad faith\u201d and that instead of making changes in the best interests of all of the beneficiaries, the goal was simply to put Lachlan in charge, <a href=\"https:\/\/www.nytimes.com\/2024\/12\/09\/business\/media\/rupert-lachlan-murdoch-family-trust.html\" target=\"_blank\" rel=\"noreferrer noopener\">according to The New York Times<\/a>.<\/p>\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.usatoday.com\/story\/entertainment\/music\/2023\/09\/02\/jimmy-buffett-dies-at-76\/70373861007\/\" target=\"_blank\" rel=\"noreferrer noopener\">Buffett<\/a> used a marital trust, an irrevocable trust that allows transfer of assets to a surviving spouse tax free and may prevent a spouse from squandering assets if he\/she isn\u2019t adept at managing money.<\/li>\n<\/ul>\n<p>Buffett\u2019s mistake was naming cotrustees of the trust, Ghassomian said. \u201cWhen cotrustees are given equal authority without a process for resolving disagreements, the result is not governance but gridlock,\u201d he said. \u201cWithout a clear framework for decision-making, the trust becomes vulnerable to personal conflict and, ultimately, litigation.\u201d<\/p>\n<p>How can people avoid conflicts?<\/p>\n<p>When talking about estate planning, a will is often the first thing that comes to mind. A <a href=\"https:\/\/www.usatoday.com\/story\/money\/2024\/04\/03\/fewer-americans-writing-a-will\/73170465007\/\" target=\"_blank\" rel=\"noreferrer noopener\">will dictates<\/a> how your assets\u00a0will\u00a0be distributed upon your death. However, it\u2019s just one piece of the puzzle.<\/p>\n<p>Many lawyers and financial advisers will also suggest other <a href=\"https:\/\/www.usatoday.com\/story\/money\/personalfinance\/2024\/10\/24\/rich-giving-away-wealth-before-tax-cuts-end\/75796541007\/\" target=\"_blank\" rel=\"noreferrer noopener\">tools such as trusts<\/a>. Trusts can offer greater control over how and when assets are distributed, and they can also help avoid a potentially lengthy and costly legal <a href=\"https:\/\/www.usatoday.com\/story\/money\/2024\/07\/30\/inheritance-probate-process-explained\/74592143007\/\" target=\"_blank\" rel=\"noreferrer noopener\">process called probate<\/a>. But they can also be complicated.<\/p>\n<p>\u201cThere is no one-size-fits-all solution when it comes to using a trust,\u201d said Cheri Stein, senior trust officer\u00a0with Plante Moran Wealth Management.<\/p>\n<p>Choosing the right one is paramount, but that\u2019s easier said than done.<\/p>\n<p>Trusts are complicated, should people skip them?<\/p>\n<p>The Murdoch and Buffett \u201cdisputes do not reflect a failure of trusts as a planning vehicle,\u201d Ghassomian said. \u201cRather, they illustrate the consequences of inadequate structure, poor governance design, or failure to anticipate future conflict. Trusts are not inherently problematic. In fact, when thoughtfully drafted, they are <a href=\"https:\/\/www.usatoday.com\/story\/money\/2016\/08\/29\/setting-up-trust-worth-work\/89535392\/?showmenu=true\" target=\"_blank\" rel=\"noreferrer noopener\">among the most effective tools<\/a> for managing wealth, protecting beneficiaries, and carrying out long-term family objectives.\u201d<\/p>\n<p class=\"related-link\"><strong style=\"margin-right:3px\">Planning woes: <\/strong><a href=\"https:\/\/www.usatoday.com\/story\/money\/personalfinance\/2023\/10\/03\/fewer-older-americans-are-writing-wills-planning-estates\/70994383007\/\" rel=\"noreferrer noopener\" target=\"_blank\">Where&#8217;s the inheritance? Why fewer older Americans are writing wills or estate planning<\/a><\/p>\n<p class=\"related-link\"><strong style=\"margin-right:3px\">Benefits outweigh hassles: <\/strong><a href=\"http:\/\/www.greenbaypressgazette.com\/story\/money\/2016\/08\/29\/setting-up-trust-worth-work\/89535392\/\" rel=\"noreferrer noopener\" target=\"_blank\">Setting up a trust is worth the work<\/a><\/p>\n<p>What should people consider when using a trust?<\/p>\n<p>Items to consider when thinking about establishing a trust, experts say, include:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Trustee<\/strong>: \u201cMany people want to not only leave everything to their children equally, but also make them all equal cotrustees, fearing the appearance of playing favorites if they pick just one,\u201d said Joseph Fresard, attorney at Simasko Law in Mount Clements, Michigan. \u201cI find this is usually misguided. Each additional trustee greatly increases the chance of litigation, as disagreements between trustees often need court intervention to resolve. Remember that the trustee is still bound by the terms of the trust you write in, you are not giving them carte blanche, so you don\u2019t really have to worry much about the other beneficiaries not getting what you intend for them.\u201d<\/li>\n<li><strong>Structure<\/strong>: \u201cA well-conceived trust does more than name the right people, it provides the structure they need to make decisions, even when they disagree,\u201d Ghassomian said. \u201cThat might include a neutral tie-breaker, clear division of duties, or procedures to keep the trust functioning when consensus breaks down.\u00a0Even well-intentioned people can disagree, and when they do, the document should offer a way forward that protects both relationships and the administration of the trust.\u201d<\/li>\n<li><strong>Control<\/strong>: If you give assets to an irrevocable trust, \u201cyou are giving up at least some amount of power over them,\u201d Fresard said. \u201cThey\u2019re called irrevocable for a reason.\u201d<\/li>\n<li><strong>Location<\/strong>: Trust rules vary by state. \u201cWhile most individuals set up trusts in their home state, certain states, like Nevada, offer favorable trust laws,\u201d Stein said.\u00a0For example, Nevada is known for its strong asset protection laws to shield irrevocable trusts from creditors, has no state income tax that can benefit trusts with significant taxable income, allows long perpetuity period for trusts for dynasty trusts and provide greater flexibility to make changes to irrevocable trusts compared with other states, she said.<\/li>\n<\/ul>\n<p class=\"exclude-from-newsgate\">Medora Lee is a money, markets, and personal finance reporter at USA TODAY.
