Murphy wrote that he interpreted a <a href=\"https:\/\/www.cnn.com\/2025\/07\/03\/politics\/supreme-court-migrants-djibouti-south-sudan\" rel=\"nofollow noopener\" target=\"_blank\">Supreme Court decision delivered a day earlier<\/a> allowing the deportation to South Sudan to move forward as \u201cbinding\u201d on the request, which he said raised \u201csubstantially similar claims.\u201d The nation\u2019s highest court on Thursday had ruled in the Trump administration\u2019s favor and cleared the way to remove the eight migrants to South Sudan.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpf21dd00003b5y9bftv6o4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cLaw and order prevails,\u201d Department of Homeland Security spokesperson Tricia McLaughlin<a href=\"https:\/\/x.com\/TriciaOhio\/status\/1941271686503878871\" target=\"_blank\" rel=\"nofollow\"> said on X <\/a>following the decision.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcqgu6wa00003b5twfss9be5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McLaughlin told CNN, \u201cAfter weeks of delays by activist judges that put our law enforcement in danger, ICE deported these 8 barbaric criminals illegal aliens to South Sudan.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme300083b6nkjscae4i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The detainees\u2019 lawyers had argued they will face torture if they are sent to South Sudan, and say they will be deprived of their constitutional rights. They said the Trump administration is trying to unfairly hurt them with the deportation, which they cast in court filings as \u201cpunitive banishment\u201d and \u201csevere punishment\u201d and warn the detainees could be put at risk of being \u201carbitrarily imprisoned, tortured, killed or severely harmed.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpg0vnp001o3b6npguugmy8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Judge Randolph Moss in the DC District Court heard arguments in a pair of emergency hearings Friday afternoon before saying the case should be moved to Massachusetts.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000a3b6nt3cl5o3c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt seems self-evident the US government can\u2019t take human beings and send them to a place where their physical well-being is at risk,\u201d such as in South Sudan, either to punish them or to warn other possible migrants to the US of the consequences of illegal immigration, Moss said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000e3b6nxdsqi1o5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He ordered the Trump administration not to move the migrants until 4:30 p.m. ET and told the migrants\u2019 lawyers they must move fast to try to get a judge to intervene in Massachusetts. The detainees\u2019 lawyers filed their new claims just after 4 p.m. in Massachusetts\u2019 federal district court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000f3b6nc74rhzmd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Attorneys for the migrants said sending them to war-torn South Sudan would be further punishment than the sentences they\u2019ve already served for crimes. A lawyer argued to Moss in court that the administration\u2019s actions in this situation are unprecedented and \u201cunlike anything that has ever been done by the US with deportations before.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000g3b6nx0blzfon@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Justice Department, however, argued that the latest ask for relief should\u2019ve been filed earlier, in a different type of claim and a different court than Moss\u2019. \u201cThey can\u2019t justify their claim-splitting,\u201d said Justice Department attorney Hashim Mooppan.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000h3b6ntftu0hy1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Justice Department lawyer also expressed frustration to the court that the detainees\u2019 legal approach appears to be an attempt to \u201cdrag \u2026 out\u201d their being moved out of Djibouti, and said that the US diplomatic relations could be hurt by the multiple rounds of the court fight, as it negotiates with other countries to take migrants it seeks to deport.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000i3b6n5hfr8d3e@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The eight detainees in Djibouti are from countries including Myanmar, Sudan, Mexico, Vietnam, Laos and Cuba, according to court filings, but the administration since springtime has moved fast to put detainees like them and others on planes and send them to other countries, often with a history of significant safety risks and brutality.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000j3b6ngnkmamed@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The administration also revealed in court Friday additional details on the diplomatic correspondence between the United States and South Sudan, saying that upon arrival, the migrants would be granted an immigration status in accordance with South Sudan laws and immigration procedures, and that the US did not ask for them to be detained there.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000k3b6nyuz0wm57@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Moss said on Friday he believed the lawyers for the detainees were \u201cdoing their best to protect the lives and well-being of human beings.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000l3b6nz15xevyu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He also cited a stark travel warning from the State Department cautioning Americans headed to the country. \u201cIt does appear placing people in South Sudan does pose significant risks to their physical safety,\u201d Moss said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmcpajme4000m3b6ncn2vig34@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Still, Moss limited how much he intervened over the US\u2019 plans.
