{"id":414079,"date":"2025-11-30T01:53:28","date_gmt":"2025-11-30T01:53:28","guid":{"rendered":"https:\/\/www.europesays.com\/us\/414079\/"},"modified":"2025-11-30T01:53:28","modified_gmt":"2025-11-30T01:53:28","slug":"nyc-man-detained-by-ice-is-released-reunited-with-disabled-son-in-time-for-thanksgiving","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/414079\/","title":{"rendered":"NYC man detained by ICE is released, reunited with disabled son in time for Thanksgiving"},"content":{"rendered":"<p>A <a href=\"https:\/\/www.nydailynews.com\/2025\/11\/01\/a-dad-spent-ages-preparing-to-care-for-his-disabled-son-at-home-then-ice-took-him-into-custody\/\" target=\"_blank\" rel=\"noopener\">Manhattan green card holder detained<\/a> by <a href=\"https:\/\/www.ice.gov\/\" target=\"_blank\" rel=\"noopener\">Immigration and Customs Enforcement<\/a> for more than three months was released to reunite with his disabled son just in time for the Thanksgiving holiday.<\/p>\n<p>When Heury Gomez returned home on Nov. 22, he said his first order of business was eating a decent meal, then seeing his mother and 18-year-old son Noah, who lives in a hospital in Westchester county. Gomez is the sole caretaker for Noah, who is non-verbal, suffers epilepsy and depends on a tracheostomy tube.<\/p>\n<p>Gomez\u2019 cousin, Carolina Zapata, described the father and son\u2019s reunion as a \u201cbeautiful moment,\u201d that brought her to tears.<\/p>\n<p>\u201cI was filled with so much emotion. I was so happy,\u201d Gomez, 43, said in Spanish. \u201cNoah was really happy. He was smiling and laughing a lot. Every time I see him happy, it\u2019s very fulfilling for me. (Carolina Zapata)<\/p>\n<p>In a cancellation of removal hearing on Nov. 12, a government attorney did not show to counter Gomez\u2019s attorney\u2019s argument that he should not be deported. Zapata was one of more than 150 supporters who showed up to the virtual hearing online.<\/p>\n<p>\u201cWhen I got on, he was crying out of fear,\u201d Zapata said of Gomez. \u201cBut then when it was informed to him, the judge\u2019s decision, and everything the judge was saying, as far as his character, he was smiling and then just crying out of joy. He was very, very overwhelmed with emotion.\u201d<\/p>\n<p>Judge Ian Simons issued the decision to release Gomez from <a href=\"https:\/\/www.ice.gov\/detain\/detention-facilities\/north-lake-processing-center\" target=\"_blank\" rel=\"noopener\">North Lake Correctional Facility<\/a> in Baldwin, Michigan, citing the extraordinary hardship his son would face if he was deported, according to his lawyer, Brian Pu-Folkes.<\/p>\n<p>\u201cAfter nearly three months of unnecessary detention, the Court recognized what was always true, that Heury met the law\u2019s requirements and deserved to be reunited with his son. Justice, at long last, prevailed,\u201d Pu-Folkes said in a statement.<\/p>\n<p>\u201cI just felt an overwhelming sense of just pride and joy and just confirmation of who Heury is,\u201d Zapata said. \u201cYes, this is about justice and this is about fighting back. (GoFundMe)<\/p>\n<p>Federal agents detained Gomez at Newark International Airport on Aug. 6 as he returned home from a short birthday trip to Mexico \u2014 a respite before he began the medical home training necessary to bring Noah home from the hospital where he has lived permanently for seven years.<\/p>\n<p>Gomez\u2019 decision to bring Noah home to his Manhattan apartment and care for him full time came followed by a months-long custody battle, Zapata said.<\/p>\n<p>Gomez, originally from the Dominican Republic, entered the country legally and has held a green card for nearly twenty years, according to Zapata.<\/p>\n<p>Homeland Security officials cited a prior arrest as the reason for his detention.<\/p>\n<p>\u201cOn August 6, <a href=\"https:\/\/www.cbp.gov\/\" target=\"_blank\" rel=\"noopener\">CBP<\/a> arrested Heury Gomez Grullon, a criminal illegal alien, who was deemed inadmissible when he tried to enter the country. He was previously convicted of two counts of assault with intent to cause physical injury and petty larceny,\u201d a DHS statement said.<\/p>\n<p>The <a href=\"https:\/\/www.nydailynews.com\/2025\/07\/02\/ice-agents-now-snatching-migrants-with-open-court-cases-nyc-officials-lawyers-say-its-utterly-unlawful\/\" target=\"_blank\" rel=\"noopener\">Trump administration<\/a> has labeled green card holders illegally in the country if they have criminal histories\u00a0 the administration believes disqualifies them from remaining in the country.<\/p>\n<p>Zapata says her cousin\u2019s arrest was a decade ago and that he was convicted on misdemeanor charges.<\/p>\n<p>The convictions stemmed from a \u201cpetty argument\u201d over an EBT card with his former partner, she said. (Carolina Zapata)<\/p>\n<p>While detained in Michigan, Gomez said he felt unsafe.<\/p>\n<p>\u201cIt was a very frustrating and stressful experience, because you\u2019re in an environment where there\u2019s good people, but there\u2019s also a lot of not so good people. So you don\u2019t feel safe or secure. You\u2019re mixed in there with other people who are real criminals.\u201d<\/p>\n<p>Gomez also said there was sometimes not enough food to go around, sparking several detainee riots.<\/p>\n<p>The friends he\u2019d made in detention were \u201cso happy, and so surprised,\u201d when he was released, given how unusual it was, Gomez said.<\/p>\n<p>\u201cThey\u2019re taking away a lot of innocent people who haven\u2019t really done anything or who have super minor convictions but aren\u2019t really a danger to society, and having them go through this entire detention process that is really unfair. It\u2019s very frustrating,\u201d he said.<\/p>\n<p>Gomez and Zapata have already resumed the medical training required to bring Noah home to their Hell\u2019s Kitchen apartment where they will care for him around the clock.<\/p>\n<p>\u201cI\u2019m focusing on my son Noah, and continuing to provide for my family, to get back on my feet and work hard. And doing everything I can to just move past this,\u201d Gomez said.<\/p>\n<p>Zapata said she hopes her cousin will take the time he needs to process the whole ordeal.<\/p>\n<p>\u201cThis has been a traumatizing experience for him,\u201d Zapata said. \u201cAs happy as we are and I know as relieved as he is, only he knows what he went through in there.
