A quarter-mile section opened in 2018, but plans to extend it were blocked by Reading\u2019s contention that \u2014 though the rail bed from 9th Street and Fairmount Avenue to the old Reading terminal had not been used since the commuter tunnel opened in 1984 \u2014 it was still a functioning train line.<\/p>\n<p data-uri=\"www.audacy.com\/_components\/paragraph\/instances\/cminrygru002p357tu96f80tr@published\" data-editable=\"text\" class=\"paragraph paragraph--station\">Former Center City District Chief Paul Levy said it paid no taxes, skirted city codes and avoided losing the land to eminent domain until the city challenged the claim at the federal Surface Transportation Board.<\/p>\n<p data-uri=\"www.audacy.com\/_components\/paragraph\/instances\/cminryjns002w357t7zcd0z6r@published\" data-editable=\"text\" class=\"paragraph paragraph--station\">\u201cThe importance of this decision at the end of September from the board is to confirm what\u2019s obvious \u2014 they are not an operating railroad, they do not have rail rights,\u201d Levy said.<\/p>\n<p data-uri=\"www.audacy.com\/_components\/paragraph\/instances\/cminrym2n0033357t66zsl56r@published\" data-editable=\"text\" class=\"paragraph paragraph--station\">That cleared the way for the bill to allow the city to condemn the land if it can\u2019t negotiate a price with Reading.
