But <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0026\/46817\/2022.11.25_time_for_respect_2022_final_digital.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">more than one in six (15 per cent)<\/a> incidents of sexual harassment in Australia happen at work social events. Sexual harassment also happens during work-related travel, which includes being <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0016\/46024\/Ahrc_wsh_report_2020.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">driven home from a work party<\/a>.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">You&#8217;re not alone. Community and legal centres are telling us they&#8217;re gearing up for an influx of cases over the coming weeks.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">And if you&#8217;re a partygoer who sees something that makes you uncomfortable, or a boss wanting to keep your employees safer \u2014 here&#8217;s how you can make a real difference too.<\/p>\n<p>What if I was harassed at a work party?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If someone&#8217;s made an unwelcome sexual advance, that wasn&#8217;t your fault. Especially when it&#8217;s someone you know and thought you could trust, being harassed can <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0024\/47382\/Speaking-from-Experience-Report_0_0.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">feel confusing and scary<\/a>.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">We&#8217;re part of a <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.bridgesatwork.au\/news-and-updates\/z40rt54qnks0oh2ptarr9lpjw55w4v\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">three-year research project<\/a> on how to prevent sexual harassment at work.<\/p>\n<blockquote class=\"Blockquote_blockquote__YVWQm ContentAlignment_marginBottom__4H_6E ContentAlignment_overflowAuto__c1_IL\" data-component=\"Blockquote\">\n<p class=\"paragraph_paragraph__iYReA\"><strong>What counts as sexual harassment?<\/strong><\/p>\n<p class=\"paragraph_paragraph__iYReA\"><a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0037\/56998\/Factsheet-for-workers.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">Sexual harassment at work<\/a> can include:<\/p>\n<ul class=\"ContentAlignment_marginBottom__4H_6E ContentAlignment_overflowVisible__N2zKU\">\n<li>unwanted touching<\/li>\n<li>unwanted staring<\/li>\n<li>repeated unwanted requests to go on dates<\/li>\n<li>sexual jokes<\/li>\n<li>questions or comments about your body<\/li>\n<li>displays of rude pictures<\/li>\n<li>not hiring or promoting someone because of their sex.<\/li>\n<\/ul>\n<p class=\"paragraph_paragraph__iYReA\">The Australian Human Rights Commission&#8217;s most recent <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0026\/46817\/2022.11.25_time_for_respect_2022_final_digital.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">national survey on sexual harassment<\/a> in workplaces from 2022 found:<\/p>\n<ul class=\"ContentAlignment_marginBottom__4H_6E ContentAlignment_overflowVisible__N2zKU\">\n<li>77 per cent of people sexually harassed at work were harassed by a man<\/li>\n<li>of those who experienced workplace sexual harassment in the last five years, 91 per cent of women and 55 per cent of men were harassed by men<\/li>\n<li>9 per cent of women and 44 per cent of men were harassed by women.<\/li>\n<\/ul>\n<\/blockquote>\n<p class=\"paragraph_paragraph__iYReA\">While undertaking that research, one of the warnings we&#8217;re seeing from victim-survivors who have made harassment complaints is how often invisibility was a factor. In other words, situations without many other people around as witnesses.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Another risk factor is close proximity. That can happen at the party itself, especially in crowded areas. Or it could happen on a drive to or from the party, where you&#8217;re stuck in a car, with little chance of getting away.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It&#8217;s often harder than people realise to get out of those situations. As soon as you can, tell a friend or colleague what&#8217;s happened and get help.<\/p>\n<p>What if I was sexually assaulted?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If you&#8217;ve been sexually assaulted, please seek help from <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/1800respect.org.au\/\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">1800RESPECT<\/a> and other support services.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Most sexual violence is still <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.aihw.gov.au\/family-domestic-and-sexual-violence\/responses-and-outcomes\/police\/sexual-assault-reported-to-police#:%7E:text=of%20sexual%20assaults-,7.7%25%20of%20women%20who%20experienced%20sexual%20assault%20by%20a%20male%20in%20the%2010%20years%20before%202021%E2%80%9322%20contacted%20police%20about%20the%20most%20recent%20incident.,-Examining%20whether%20police\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">not reported to police<\/a>. So don\u2019t ask \u201care you sure that\u2019s what happened?\u201d (ABC News: Margaret Burin)<\/p>\n<p>Bystanders can make a difference<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The Human Rights Commission&#8217;s <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0026\/46817\/2022.11.25_time_for_respect_2022_final_digital.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">latest survey<\/a> on workplace sexual harassment found <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0026\/46817\/2022.11.25_time_for_respect_2022_final_digital.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">over a third (35 per cent) of bystanders<\/a> take action when they see, or find out about, sexual harassment at their work.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Men can be a great ally in this situation. Data shows <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0026\/46817\/2022.11.25_time_for_respect_2022_final_digital.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">male bystanders are slightly more likely<\/a> to take action than women. And <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0026\/46817\/2022.11.25_time_for_respect_2022_final_digital.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">they&#8217;re significantly more likely<\/a> (49 per cent vs 31 per cent of women) to actually say something to the harasser.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">That difference is understandable, given <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0026\/46817\/2022.11.25_time_for_respect_2022_final_digital.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">most harassers are men<\/a>, and people need to feel safe enough to speak up.<\/p>\n<p class=\"paragraph_paragraph__iYReA\"><a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0026\/46817\/2022.11.25_time_for_respect_2022_final_digital.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">Three in five bystanders (61 per cent)<\/a> who took action on workplace sexual harassment reported the sexual harassment stopped as a result of their intervention.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">At parties, people can be drunk or unpredictable. Here are two things you can try.<\/p>\n<p class=\"paragraph_paragraph__iYReA\"><a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/assets.ourwatch.org.au\/assets\/Workplace-resources\/Lead-the-change_How-to-be-Active-Bystander-Guide.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">Speak up to challenge the harassment<\/a>. Or, if it&#8217;s unsafe, you can try distraction: approach the person you think may be being harassed to say, &#8220;Sorry to interrupt, I need to speak to you&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If you aren&#8217;t comfortable speaking up, let the person being harassed know you&#8217;re there for them.<\/p>\n<p>What if a colleague discloses harassment or assault to you?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">This year, more than 300 Australian victim-survivors shared what were <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0024\/47382\/Speaking-from-Experience-Report_0_0.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">helpful and unhelpful responses<\/a> to their harassment.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Being believed matters. So don&#8217;t ask &#8220;are you sure that&#8217;s what happened?&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\"><a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0027\/51867\/07-SFE_Helpful_Guide_FINAL_0.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">Your first response<\/a> should be: &#8220;I&#8217;m so sorry that happened, thank you for telling me. Are you OK? What would help you feel safe?&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">And be there for support, rather than telling them what to do.<\/p>\n<p>What must all bosses and workplaces do \u2014 even at a party?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">All Australian businesses, big or small, now have a legal duty to take preventative action against a number of &#8220;<a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0023\/47066\/2310_fs_steps_to_meet_the_positive_duty_v2.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">unlawful behaviours<\/a>&#8221; \u2014 including sexual harassment connected with work.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Known as a &#8220;<a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0021\/47064\/What_is_the_positive_duty.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">positive duty<\/a>&#8220;, it&#8217;s been in force since the end of 2022.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The best preventative measures you can take start long before a work party. The <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/humanrights.gov.au\/__data\/assets\/file\/0024\/47382\/Speaking-from-Experience-Report_0_0.pdf\" data-component=\"Link\" target=\"_blank\" rel=\"noopener\">culture of an organisation<\/a> strongly shapes whether harassment is seen as something people can get away with.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In the lead up to a social event, managers can also send strong signals that harassment or assault at the work party will be treated as seriously as in the workplace.<\/p>\n<p class=\"paragraph_paragraph__iYReA\"><strong>Michelle Tuckey is a professor of work and organisational psychology at the University of South Australia.
