Santiago | Getty Images<\/p>\n<p><a href=\"https:\/\/www.nytimes.com\/\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a> on Thursday filed a lawsuit challenging new restrictions on reporters who cover the <a href=\"https:\/\/www.cnbc.com\/2025\/11\/29\/white-house-blasts-news-outlets-for-coverage-of-illegal-orders-video.html\" target=\"_blank\" rel=\"noopener\">Pentagon<\/a>, which the newspaper says violate the U.S Constitution&#8217;s free press protections.<\/p>\n<p>The suit against the <a href=\"https:\/\/www.cnbc.com\/2025\/09\/04\/trump-seeks-to-rebrand-the-department-of-defense-as-the-department-of-war.html\" target=\"_blank\" rel=\"noopener\">Defense Department<\/a> and Secretary <a href=\"https:\/\/www.cnbc.com\/2024\/11\/15\/trump-defense-pete-hegseth-sex-assault-investigation-.html\" target=\"_blank\" rel=\"noopener\">Pete Hegseth<\/a> comes nearly two months after reporters from The Times and other mainstream news outlets, including CBS, CNN, Fox News, and <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/five-major-broadcast-networks-say-will-not-sign-new-pentagon-press-pol-rcna237526\" target=\"_blank\" rel=\"noopener\">NBC staged a dramatic walkout<\/a> of the Pentagon and surrendered their credentials after refusing to comply with the rules. <\/p>\n<p>Those outlets have been replaced by reporters who are broadly sympathetic to the Trump administration.<\/p>\n<p>The Pentagon in October presented reporters who had desks there a <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/five-major-broadcast-networks-say-will-not-sign-new-pentagon-press-pol-rcna237526\" target=\"_blank\" rel=\"noopener\">21-page rulebook<\/a> that bars journalists from seeking or publishing information that has not been explicitly authorized by the Defense Department, even if the material is unclassified or obtained off Pentagon grounds.<\/p>\n<p>Outlets that refused to abide by the rules lost their Pentagon credentials.<\/p>\n<p>The Times&#8217; lawsuit, filed in U.S. District Court in Washington, D.C., asks a judge to block the Pentagon from enforcing the policy, and to declare it unconstitutional. <\/p>\n<p>&#8220;The policy, in violation of the <a href=\"https:\/\/www.cnbc.com\/2025\/04\/27\/white-house-journalists-celebrate-the-first-amendment-at-the-annual-press-dinner.html\" target=\"_blank\" rel=\"noopener\">First Amendment<\/a>, seeks to restrict journalists&#8217; ability to do what journalists have always done \u2014 ask questions of government employees and gather information to report stories that take the public beyond official pronouncements,&#8221; the suit says.<\/p>\n<p>The rules &#8220;deprive the public of vital information about the United States military and its leadership,&#8221; the suit says.<\/p>\n<p>The complaint also says that the Defense Department gave itself &#8220;unbridled discretion&#8221; to enforce the rules as it sees fit.<\/p>\n<p>Chief Pentagon Spokesman Sean Parnell, who is named as a defendant in the suit, told CNBC that the Defense Department &#8220;is aware of the New York Times lawsuit and [looks] forward to addressing these arguments in court.&#8221; <\/p>\n<p>The Times did immediately return a request for comment.<\/p>\n<p>The Pentagon&#8217;s media rules were the latest step in <a href=\"https:\/\/www.cnbc.com\/2025\/12\/02\/trump-cabinet-meeting-hegseth-boat-strikes.html\" target=\"_blank\" rel=\"noopener\">Hegseth&#8217;s<\/a> broader push to reshape the <a href=\"https:\/\/www.cnbc.com\/2025\/05\/24\/defense-secretary-hegseth-bedeviled-by-leaks-orders-more-restrictions-on-press-at-pentagon.html\" target=\"_blank\" rel=\"noopener\">press corps<\/a>. <\/p>\n<p>Since <a href=\"https:\/\/www.cnbc.com\/2025\/01\/24\/senate-is-preparing-to-confirm-hegseth-as-defense-secretary-in-late-evening-vote.html\" target=\"_blank\" rel=\"noopener\">arriving at the department<\/a> in January after a <a href=\"https:\/\/www.cnbc.com\/2025\/01\/14\/trump-pete-hegseth-defense-senate-confirmation.html\" target=\"_blank\" rel=\"noopener\">contentious confirmation fight<\/a>, Hegseth has stripped several national outlets of in-house workspaces, <a href=\"https:\/\/www.cnbc.com\/2025\/05\/24\/defense-secretary-hegseth-bedeviled-by-leaks-orders-more-restrictions-on-press-at-pentagon.html\" target=\"_blank\" rel=\"noopener\">tightened rules<\/a> on where <a href=\"https:\/\/www.cnbc.com\/2025\/04\/08\/white-house-cant-ban-associated-press.html\" target=\"_blank\" rel=\"noopener\">reporters<\/a> can move inside the building, and reassigned offices to conservative outlets and pro-Trump media figures willing to sign the agreement.<\/p>\n<p>Press-freedom advocates, including the <a href=\"https:\/\/www.rcfp.org\/nyt-pentagon-lawsuit-statement\/\" target=\"_blank\" rel=\"noopener\">Reporters Committee for Freedom of the Press<\/a>, say the Pentagon policy goes beyond past fights over individual White House press badges. Rather than targeting one reporter at a time, they argue, the rules bind the entire press corps \u2014 giving the Pentagon broad authority to revoke access based on the stories they pursue.<\/p>\n<p>&#8220;The Pentagon&#8217;s press access policy is unlawful because it gives government officials unchecked power over who gets a credential and who doesn&#8217;t, something the First Amendment prohibits,&#8221; Reporters Committee for Freedom of the Press Vice President of Policy <a href=\"https:\/\/www.rcfp.org\/author\/gabe-rottman\/\" target=\"_blank\" rel=\"noopener\">Gabe Rottman<\/a> said in a statement Thursday, after the Times filed its suit.<\/p>\n","protected":false},"excerpt":{"rendered":"The New York Times building is seen on September 16, 2025 in New York City.
