{"id":427730,"date":"2025-12-06T01:43:12","date_gmt":"2025-12-06T01:43:12","guid":{"rendered":"https:\/\/www.europesays.com\/us\/427730\/"},"modified":"2025-12-06T01:43:12","modified_gmt":"2025-12-06T01:43:12","slug":"michael-jordan-testifies-at-nascar-trial-i-wasnt-afraid-to-challenge-them","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/427730\/","title":{"rendered":"Michael Jordan testifies at NASCAR trial: \u2018I wasn\u2019t afraid\u2019 to challenge them"},"content":{"rendered":"<p>CHARLOTTE, N.C. \u2014 \u201cMy name is Michael Jeffrey Jordan, and I grew up in Wilmington, North Carolina.\u201d<\/p>\n<p>That is how the tall man in the navy blue suit introduced himself to a federal courtroom in Charlotte on Friday, as Jordan took the witness stand in the NASCAR antitrust lawsuit brought by his race team, 23XI Racing, and one other.<\/p>\n<p>In exactly one hour of testimony, Jordan calmly made a case for why NASCAR needed to have a better partnership with its race teams \u2014 and said as a lifelong fan of stock car racing, he felt he was the one to bring about change through <a href=\"https:\/\/www.nytimes.com\/athletic\/6850286\/2025\/12\/01\/nascar-michael-jordan-hamlin-23xi-trial-lawsuit-guide\/\" target=\"_blank\" rel=\"noopener\">this lawsuit stemming from recent charter negotiations<\/a> between the league and its teams that resulted in what he saw as unacceptable terms.<\/p>\n<p>In meetings with other team owners, Jordan said, he could see they\u2019ve been \u201cbrowbeaten for so many years trying to get change and just could not get to that point.\u201d<\/p>\n<p>\u201cI wasn\u2019t afraid\u201d to challenge NASCAR with a lawsuit, he added.<\/p>\n<p>\u201cIt needed to be looked at from a whole different perspective, and that\u2019s why we are here\u201d in the courtroom, Jordan said.<\/p>\n<p>Like all witnesses, Jordan was asked to present some basic biographical information before his testimony. And, after needing to adjust his witness chair for height purposes, he did.<\/p>\n<p>\u201cDid you play any sports?\u201d said Danielle Williams, one of the teams\u2019 attorneys. \u201cI\u2019ve heard you were pretty good at basketball.\u201d<\/p>\n<p>\u201cI used to be,\u201d he said.<\/p>\n<p>When Williams asked him to run through his career, Jordan mentioned his time with the Chicago Bulls but omitted the Washington Wizards.<\/p>\n<p>\u201cDid you play for any other teams?\u201d Williams asked.<\/p>\n<p>\u201cI try to forget, but I did,\u201d Jordan cracked.<\/p>\n<p>Jordan spoke of driving to races as far away from Wilmington as Talladega Superspeedway in Alabama, piling into the car with his parents and siblings for a road trip that amounted to a family weekend vacation.<\/p>\n<p>Richard Petty was originally Jordan\u2019s favorite driver because that\u2019s who Jordan\u2019s father rooted for, but Jordan eventually transitioned to rooting for Cale Yarborough \u2014 the \u201coriginal No. 11,\u201d Jordan said.<\/p>\n<p>\u201cSorry, Denny,\u201d Jordan said to his co-plaintiff, Denny Hamlin, who currently drives the No. 11.<\/p>\n<p>Jordan and Hamlin became co-owners of their startup 23XI race team in 2020 in a \u201cspur of the moment\u201d manner, Jordan said, even though texts were shown from his financial advisor discouraging the move.<\/p>\n<p>Curtis Polk texted Jordan he was doing something \u201crisky to your brand and image\u201d and risking tens of millions of dollars in the Jordan Brand, \u201cbut you want to do it so I\u2019m doing my best to manage it.\u201d<\/p>\n<p>The original business plan showed Jordan only expected to see a $900,000 annual profit from the team, of which he owns 60 percent.<\/p>\n<p>Jordan said he has invested approximately $35 million to $40 million into 23XI so far, including paying for a $28 million charter \u2014 which is now expired after the team did not renew it.<\/p>\n<p>Jordan instructed his team not to sign the agreement for several reasons, including its unfavorable economic terms, a clause that prevented teams from bringing antitrust action and a take-it-leave-it ultimatum \u201cthat didn\u2019t best suit 23XI.\u201d<\/p>\n<p>None of the \u201cfour pillars\u201d the teams wanted in talks, including permanent charters, were even negotiated by NASCAR, Jordan said.<\/p>\n<p>\u201cIf those are not put on the table, why are we signing the deal?\u201d he said. \u201cWe looked at every other opportunity from that point forward, and this is where we ended up.\u201d<\/p>\n<p>But Jordan said he remains optimistic about NASCAR\u2019s future if the business model can change \u2014 which would require breaking away from what he deemed an unfair economic model today.<\/p>\n<p>\u201cThe thing I\u2019m hoping for is you create more of a partnership between two entities,\u201d he said. \u201cIf that\u2019s the case, it becomes a more valuable business. If you can ever compromise on the things that matter, you can grow your business.\u201d<\/p>\n<p>Presented with evidence that showed 23XI attempted to influence negotiations by speaking to other teams about the terms of the deal, Jordan said that was because those teams needed to educate themselves on how much they were falling short.<\/p>\n<p>Jordan wanted to \u201ccreate an environment to explain to other teams you should be looking at this from a stronger economic position.\u201d<br \/>\u201cNot just to benefit the teams, but the league as a whole,\u201d he added.<\/p>\n<p>After Jordan\u2019s testimony, Race Team Association executive director Jonathan Marshall followed on the witness stand, where his testimony primarily focused on team finances and the charter negotiating process. The RTA is a consortium of the 13 charter-holding teams, plus 23XI and Front Row, which lost their combined six charters after losing their preliminary injunction status in September.<\/p>\n<p>Both sides scrutinized several studies Marshall had compiled on the team business model and the economics of a sport both he and other team owners have said is not showing the same growth in franchise values compared to several other professional stick-and-ball sports, with Marshall specifically citing Major League Baseball, Major League Soccer, the NFL, NBA and NHL.<\/p>\n<p>Earlier Friday, NASCAR president Steve O\u2019Donnell and Joe Gibbs Racing co-owner Heather Gibbs <a href=\"https:\/\/www.nytimes.com\/athletic\/6865704\/2025\/12\/05\/nascar-trial-michael-jordan-steve-odonnell-heather-gibbs\/\" target=\"_blank\" rel=\"noopener\">also testified<\/a>. O\u2019Donnell concluded after a day of testimony Thursday about his role in the charter negotiations.
