{"id":428605,"date":"2025-12-06T10:44:15","date_gmt":"2025-12-06T10:44:15","guid":{"rendered":"https:\/\/www.europesays.com\/us\/428605\/"},"modified":"2025-12-06T10:44:15","modified_gmt":"2025-12-06T10:44:15","slug":"unexpected-holiday-boost-for-cash-strapped-americans-just-weeks-before-490-monthly-hoa-fees-set-to-come-into-force","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/428605\/","title":{"rendered":"Unexpected holiday boost for cash-strapped Americans just weeks before $490 monthly HOA fees set to come into force"},"content":{"rendered":"<p>AT a time when most are focused on buying and wrapping gifts, potentially losing your home is likely the last thing on your mind.<\/p>\n<p>Unfortunately for some <a href=\"https:\/\/www.the-sun.com\/where\/united-states\/\" rel=\"nofollow noopener\" target=\"_blank\">United States<\/a> homeowners, this was the reality they faced as a massive increase in homeowners association fees loomed over the horizon.<\/p>\n<p>\t\t\t\t\t\t\tSign up for The US Sun newsletter\t\t\t\t\t\t<\/p>\n<p>\t\t\t\t\t\tThank you!\n\t\t\t\t<\/p>\n<p>Homeowners in the community rallied against the dramatic increase in monthly duesCredit: 8 News Now<\/p>\n<p>The community attempted to use state law to their advantage by making a petition against the increaseCredit: 8 News Now<\/p>\n<p>The <a href=\"https:\/\/www.the-sun.com\/money\/real-estate\/3529580\/what-is-the-meaning-of-hoa\/\" rel=\"nofollow noopener\" target=\"_blank\">HOA<\/a> had proposed a significant increase in monthly dues from $275 to $490 at a time when <a href=\"https:\/\/www.the-sun.com\/topic\/christmas\/\" rel=\"nofollow noopener\" target=\"_blank\">holiday season<\/a> <a href=\"https:\/\/www.the-sun.com\/shopping\/\" rel=\"nofollow noopener\" target=\"_blank\">shopping<\/a> leaves many strapped for cash.<\/p>\n<p>\u201cNone of us could afford that problem and the only people that seem to want to afford it were the HOA people that work here,\u201d said resident Denise Holden to local CBS affiliate <a href=\"https:\/\/www.8newsnow.com\/news\/local-news\/las-vegas-residents-reject-hoa-dues-increase\/\" target=\"_blank\" rel=\"nofollow noreferrer noopener\" data-nyp-affiliate=\"true\">KLAS<\/a>.<\/p>\n<p>However, residents of the <a href=\"https:\/\/www.the-sun.com\/where\/las-vegas\/\" rel=\"nofollow noopener\" target=\"_blank\">Las Vegas<\/a> community against the increase did have an out thanks to <a href=\"https:\/\/www.the-sun.com\/where\/nevada\/\" rel=\"nofollow noopener\" target=\"_blank\">Nevada<\/a> law which allows a budget to be overturned if a majority of homeowners signed a petition to do so.<\/p>\n<p>For the Bavington Court community, this threshold was 137 signatures. Thankfully, they were able to go well beyond this by gathering 151 signatures in total, much to the relief of the neighborhood at large.<\/p>\n<p>\t\t\t\t\t\t\t\t\t<a class=\"article-readmore__text-anchor-wrap\" href=\"https:\/\/www.the-sun.com\/news\/15566103\/rising-hoa-fees-nevada-las-vegas\/\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>\t\t\t\t\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" height=\"240\" width=\"360\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/12\/JL_CASH-STRAPPED-COMP.jpg\"\/>\t\t\t\t\t\t\t\t<\/p>\n<p class=\"article-readmore__text-kicker\">MONEY STRUGGLES<\/p>\n<p class=\"article-readmore__text-headline\">Americans face $490 monthly HOA fees &amp; the law isn&#8217;t on residents&#8217; side<\/p>\n<p>\t\t\t\t\t<\/a><br \/>\n\t\t\t\t\t\t\t\t\t<a class=\"article-readmore__text-anchor-wrap\" href=\"https:\/\/www.the-sun.com\/motors\/15424440\/florida-hoa-sues-disabled-veteran-building-second-driveway\/\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>\t\t\t\t\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" height=\"240\" width=\"360\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/12\/JA_HOA_Veteran_COMP.jpg\"\/>\t\t\t\t\t\t\t\t<\/p>\n<p class=\"article-readmore__text-kicker\">&#8216;BE FAIR&#8217;<\/p>\n<p class=\"article-readmore__text-headline\">HOA sues veteran for building &#8216;2nd driveway&#8217; even though he owns the land<\/p>\n<p>\t\t\t\t\t<\/a><\/p>\n<p>\u201cMore than a relief, it\u2019s fantastic because I thought I was going to lose my home and everything else, and I\u2019m just so grateful everyone joined in,\u201d said Holden in celebration.<\/p>\n<p>However, the fight isn\u2019t quite over yet, as there\u2019s no specific cap on the percentage by which HOA fees can increase annually per state <a href=\"https:\/\/www.the-sun.com\/topic\/law\/\" rel=\"nofollow noopener\" target=\"_blank\">law<\/a>. <\/p>\n<p>In other words, a similar battle could take place again next year, but residents are ready and willing to start the process all over again.<\/p>\n<p>\u201cIf it stops it for this next year at least, I have time to prepare for the next one and we know that we could do it, so hopefully it works again,\u201d said three-year local to the neighborhood Christy Escamilla.<\/p>\n<p>What residents were unable to stop is the HOA\u2019s special assessment fee, a mandatory charge that helps pay for major repairs or projects that will still move forward.<\/p>\n<p>Although state law doesn\u2019t mandate homeowner approval for these charges, residents are instead pushing for clarity on how the Bavington Court HOA plans to spend this money.<\/p>\n<p>\n\t\t\t\tHOA crackdowns in the US\n\t\t\t<\/p>\n<p class=\"article-boxout__content__intro\">\n\t\t\t\t\t\tStates across the country are working to restrict the power of HOAs.\t\t\t\t\t<\/p>\n<ul>\n<li>In Minnesota, lawmakers introduced a bill that would require HOA boards to create a schedule of fines and fees and distribute it to homeowners; ensure homeowners can contest an HOA fine; provide reasonable time to correct rule violations; and outlaw the practice of charging homeowners for asking questions.<\/li>\n<li>In Arizona, lawmakers are cracking down on HOA budgets. Under a newly proposed law, HOA boards would have strict guidelines for how they approve expenses.<\/li>\n<li>In Florida, a bill was passed that restricts the amount of control HOAs have over tenants\u2019 property.
