{"id":428987,"date":"2025-12-06T14:51:15","date_gmt":"2025-12-06T14:51:15","guid":{"rendered":"https:\/\/www.europesays.com\/us\/428987\/"},"modified":"2025-12-06T14:51:15","modified_gmt":"2025-12-06T14:51:15","slug":"the-supreme-courts-conservative-majority-eyes-more-power-for-the-president","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/428987\/","title":{"rendered":"The Supreme Court&#8217;s conservative majority eyes more power for the president"},"content":{"rendered":"<p>WASHINGTON (AP) \u2014 Chief Justice John Roberts has led the <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/us-supreme-court\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> \u2018s conservative majority on a steady march of increasing the power of the presidency, starting well before <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/donald-trump\" target=\"_blank\" rel=\"noopener\">Donald Trump\u2019s time in the White House<\/a>.<\/p>\n<p>The justices could take the next step in a case being argued Monday that calls for a unanimous <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/humphreys-executor-supreme-court-trump-independent-agencies-8facfe6107fa94b28f391734d1620fe4\" target=\"_blank\" rel=\"noopener\">90-year-old decision<\/a> limiting executive authority to be overturned.<\/p>\n<p>The court\u2019s conservatives, liberal Justice Elena Kagan noted in September, seem to be \u201craring to take that action.\u201d<\/p>\n<p>They already have allowed Trump, in the opening months of the Republican\u2019s second term, to fire almost everyone he has wanted, despite the court\u2019s 1935 decision in <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/tile.loc.gov\/storage-services\/service\/ll\/usrep\/usrep295\/usrep295602\/usrep295602.pdf\" target=\"_blank\" rel=\"noopener\">Humphrey\u2019s Executor<\/a> that prohibits the president from removing the heads of independent agencies without cause.<\/p>\n<p>The officials include <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-ftc-supreme-court-dbe174d342817e1ae84bce3e9c40bd48\" target=\"_blank\" rel=\"noopener\">Rebecca Slaughter<\/a>, whose <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-ftc-firings-bedoya-slaughter-488bfe5419e48d5acbd95d3f9401404b\" target=\"_blank\" rel=\"noopener\">firing<\/a> from the Federal Trade Commission is at issue in the current case, as well as officials from the National Labor Relations Board, the Merit Systems Protection Board and the Consumer Product Safety Commission.<\/p>\n<p>The only officials who have so far survived efforts to remove them are <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-trump-federal-reserve-lisa-cook-5a48941a9e30017b0ed3e5837492d288\" target=\"_blank\" rel=\"noopener\">Lisa Cook<\/a>, a Federal Reserve governor, and <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-supreme-court-copyright-official-firing-c5ccca29ff5413815347340ffa300f69\" target=\"_blank\" rel=\"noopener\">Shira Perlmutter<\/a>, a copyright official with the Library of Congress. The court already has <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a966_1b8e.pdf\" target=\"_blank\" rel=\"noopener\">suggested<\/a> that it will view the Fed differently from other independent agencies, and Trump has said he wants her out because of <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/lisa-cook-trump-fed-independence-firing-d06dfb46fbd300195c3cedc8cb5adadb\" target=\"_blank\" rel=\"noopener\">allegations of mortgage fraud<\/a>. Cook says she did nothing wrong.<\/p>\n<p>Humphrey\u2019s Executor has long been a target of the conservative legal movement that has embraced an expansive view of presidential power known as the unitary executive. <\/p>\n<p>The case before the high court involves the same agency, the FTC, that was at issue in 1935. The justices established that presidents \u2014 Democrat Franklin D. Roosevelt at the time \u2014 could not fire the appointed leaders of the alphabet soup of federal agencies without cause.<\/p>\n<p>The decision ushered in an era of powerful independent federal agencies charged with regulating labor relations, employment discrimination, the air waves and much else.<\/p>\n<p>Proponents of the unitary executive theory have said the modern administrative state gets the Constitution all wrong: Federal agencies that are part of the executive branch answer to the president, and that includes the ability to fire their leaders at will.<\/p>\n<p>As Justice Antonin Scalia wrote in a 1988 dissent that has taken on mythical status among conservatives, \u201cthis does not mean some of the executive power, but all of the executive power.\u201d<\/p>\n<p>Since 2010 and under Roberts\u2019 leadership, the Supreme Court has steadily whittled away at laws restricting the president\u2019s ability to fire people.<\/p>\n<p>In 2020, Roberts wrote for the court that \u201cthe President\u2019s removal power is the rule, not the exception\u201d in a decision upholding Trump\u2019s firing of the head of the Consumer Financial Protection Bureau despite job protections similar to those upheld in Humphrey\u2019s case.<\/p>\n<p>In the 2024 immunity decision that spared Trump from being prosecuted for his efforts to overturn the 2020 election results, Roberts included the power to fire among the president\u2019s \u201cconclusive and preclusive\u201d powers that Congress lacks the authority to restrict.<\/p>\n<p>But according to legal historians and even a prominent proponent of the originalism approach to interpreting the Constitution that is favored by conservatives, Roberts may be wrong about the history underpinning the unitary executive.<\/p>\n<p>\u201cBoth the text and the history of Article II are far more equivocal than the current Court has been suggesting,\u201d wrote Caleb Nelson, a University of Virginia law professor who once served as a law clerk to Justice Clarence Thomas.<\/p>\n<p>Jane Manners, a Fordham University law professor, said she and other historians filed briefs with the court to provide history and context about the removal power in the country\u2019s early years that also could lead the court to revise its views. \u201cI\u2019m not holding my breath,\u201d she said.<\/p>\n<p>Slaughter\u2019s lawyers embrace the historians\u2019 arguments, telling the court that limits on Trump\u2019s power are consistent with the Constitution and U.S. history.<\/p>\n<p>The Justice Department argues Trump can fire board members for any reason as he works to carry out <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/projects\/trump-campaign-promise-tracker\/\" target=\"_blank\" rel=\"noopener\">his agenda<\/a> and that the precedent should be tossed aside.<\/p>\n<p>\u201cHumphrey\u2019s Executor was always egregiously wrong,\u201d Solicitor General D. John Sauer wrote. <\/p>\n<p>A second question in the case could affect Cook, the Fed governor. Even if a firing turns out to be illegal, the court wants to decide whether judges have the power to reinstate someone.<\/p>\n<p>Justice Neil Gorsuch wrote earlier this year that fired employees who win in court can likely get back pay, but not reinstatement.<\/p>\n<p>That might affect Cook\u2019s ability to remain in her job. The justices have seemed wary about the economic uncertainty that might result if Trump can fire the leaders of the central bank.
