The lawsuit, filed on November 19, 2025, in the U.S. District Court for the Northern District of Illinois, alleges trademark infringement, unfair competition, and dilution under the Lanham Act, along with related state-law claims.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">The dispute tests how far a successful restaurant\u2019s name can extend beyond its home city \u2014 and whether prestige and awards are enough to ensure the name belongs to the plaintiff.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">\u201cWhile I understand the desire to expand a successful brand,\u201d McDonald told Eater, \u201cchef Preston Clark and our dedicated team have spent years building what Smyth Tavern has become in Tribeca. Congratulations to the Chicago restaurant on their well-deserved recognition.\u201d<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">Smyth chef John and his wife, pastry chef Karen Urie Shields, <a href=\"https:\/\/chicago.eater.com\/2016\/8\/25\/12646108\/smyth-first-look-gallery-west-loop-shields\" target=\"_blank\" rel=\"noopener\">opened their Chicago restaurant in 2016<\/a>. The husband-wife team followed with its more casual sister restaurant, <a href=\"https:\/\/chicago.eater.com\/venue\/24940\/the-loyalist\" target=\"_blank\" rel=\"noopener\">the Loyalist<\/a>, at the same address in the West Loop neighborhood. They say in their filing that Tribeca\u2019s Smyth Tavern\u2019s use of the name creates confusion and improperly trades on the reputation of the Michelin-starred restaurant.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">Smyth Tavern, which <a href=\"https:\/\/ny.eater.com\/2022\/8\/5\/23293461\/tribeca-smyth-tavern-opening-john-mcdonald-mercer-street-hospitality\" target=\"_blank\" rel=\"noopener\">opened in 2022<\/a>, operates out of 85 West Broadway, at Chambers Street, inside the <a href=\"https:\/\/www.smythtribeca.com\/?_gl=1%2A16xgo3j%2A_gcl_au%2AMTY3Njc3NjUxNi4xNzU3OTYxNzM1%2A_ga%2AMTYwNjIzODI3Mi4xNzU5MTcxNjUy%2A_ga_7NQQXN1WX6%2AczE3NTkzMjU3NDAkbzEkZzEkdDE3NTkzMjU3NTgkajYwJGwwJGgw&amp;sjrncid=GA_23174255180&amp;sjrnaid=GA_780457352397&amp;gad_source=1&amp;gad_campaignid=23174255180&amp;gbraid=0AAAABBoGwkQz_TgYPgqRTQSISKh378j6H&amp;gclid=Cj0KCQiAo4TKBhDRARIsAGW29bfnj7Ww3B1gO5NSu2sNYmFHLh8SvpTUf7Ts3jBjmS1JdLCdAwdudmcaAtSQEALw_wcB\" target=\"_blank\" rel=\"noopener\">Smyth Tribeca<\/a> hotel. The restaurant is owned by John McDonald and his hospitality group, <a href=\"https:\/\/www.mercerstreethospitality.com\/\" target=\"_blank\" rel=\"noopener\">Mercer Street Hospitality<\/a>, which includes<a href=\"https:\/\/ny.eater.com\/2024\/12\/17\/24322810\/lure-fishbar-closing-prada-restaurant-rumors\" target=\"_blank\" rel=\"noopener\"> Lure Fishbar<\/a>, <a href=\"https:\/\/www.bowerymeatcompany.com\/\" target=\"_blank\" rel=\"noopener\">Bowery Meat Company<\/a>, and the newly opened <a href=\"https:\/\/ny.eater.com\/restaurant-openings\/404757\/seahorse-restaurant-w-hotel-union-square-nyc-john-mcdonald-john-villa-mercer-street-hospitality\" target=\"_blank\" rel=\"noopener\">Seahorse<\/a>, among others. Gary He<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">According to the complaint, Smyth and the Loyalist, have become nationally recognized, citing the restaurant\u2019s three Michelin stars and inclusion in food media as evidence of its\u201cfame.\u201d The filing claims that diners at Smyth in Chicago have asked whether the restaurant is affiliated with Smyth Tavern in New York, which the company cites as evidence of consumer confusion. The lawsuit seeks an injunction preventing further use of the name \u201cSmyth,\u201d along with damages, profits, and attorneys\u2019 fees. Representatives for Smyth in Chicago did not respond to Eater\u2019s multiple requests for comment.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">Smyth Tavern\u2019s attorney <a href=\"https:\/\/www.linkedin.com\/in\/anthonylopresti\/\" target=\"_blank\" rel=\"noopener\">Anthony LoPresti,<\/a> however, disputes those claims, arguing that the two businesses operate in entirely different markets and formats. The Chicago restaurant is a Michelin-starred fine-dining destination, while Smyth Tavern is a New York City neighborhood spot, and both have coexisted for four years without any known confusion. The NYC restaurant is named for the hotel it\u2019s attached to.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">In an interview with Eater, the lawyer said Smyth Tavern received a demand letter roughly a month before the lawsuit was filed, but the Chicago restaurant moved quickly to litigation rather than engaging in extended negotiations.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">\u201cThey rushed into court,\u201d the attorney tells Eater, noting that the case was filed in Chicago federal court without what he described as a typical back-and-forth between parties.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">The attorney continued that Smyth Tavern has never advertised in Chicago and has no plans to expand the brand beyond its single New York location. Trademark law centers on the likelihood of consumer confusion, the attorney said, and he argued that such confusion is implausible here. \u201cNo one is going to show up in Chicago thinking they\u2019re at a New York tavern, and no one is going to show up in Tribeca expecting a three-star Michelin restaurant from Chicago.\u201d<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">The lawyer also pointed to the name itself, noting that \u201cSmyth\u201d \u2014 or \u201cSmythe,\u201d with a long-i sound, as Smyth Tavern pronounces it, is a surname derived from \u201cSmith\u201d and has long been used by many businesses. According to the complaint, Smyth\u2019s initial trademark application in 2016 was rejected because the name was primarily a surname, before being accepted on the supplemental register. The Chicago restaurant filed a new trademark application in 2025, several years after Smyth Tavern opened.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph n2hx75i _1knl15h1 _1knl15h0 cej01i1\">The lawsuit also references Smyth Tavern\u2019s appearance on the website of Lure Fishbar, another McDonald-owned restaurant with a Chicago location.
