{"id":463608,"date":"2025-12-22T04:24:33","date_gmt":"2025-12-22T04:24:33","guid":{"rendered":"https:\/\/www.europesays.com\/us\/463608\/"},"modified":"2025-12-22T04:24:33","modified_gmt":"2025-12-22T04:24:33","slug":"nypd-cop-loses-month-pay-for-kneeling-on-back-of-manhattan-suspect-who-yelled-i-cant-breathe","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/463608\/","title":{"rendered":"NYPD cop loses month pay for kneeling on back of Manhattan suspect who yelled &#8216;I can&#8217;t breathe&#8217;"},"content":{"rendered":"<p>An NYPD cop lost 30 days pay for <a href=\"https:\/\/www.nyc.gov\/site\/nypd\/stats\/reports-analysis\/use-of-force.page\" rel=\"nofollow noopener\" target=\"_blank\">kneeling on the back<\/a> of an emotionally disturbed Manhattan suspect as he cried out \u201cI can\u2019t breathe,\u201d the Daily News has learned.<\/p>\n<p>Officer Gabriel Perez-Ponce was penalized by <a href=\"https:\/\/www.nydailynews.com\/2025\/11\/19\/jessica-tisch-accepts-offer-to-remain-nypd-commissioner-under-mamdani\/\" rel=\"nofollow noopener\" target=\"_blank\">NYPD Commissioner Jessica Tisch<\/a> in September after she agreed with the findings of an NYPD judge who earlier this year presided over a departmental trial prosecuted by the <a href=\"https:\/\/www.nyc.gov\/site\/ccrb\/index.page\" rel=\"nofollow noopener\" target=\"_blank\">Civlilan Complaint Review Board<\/a>.<\/p>\n<p>Perez-Ponce\u2019s partner, Officer Cesar Mejia, retired before he too could face a departmental trial at NYPD headquarters at One Police Plaza in Lower Manhattan, according to the CCRB.<\/p>\n<\/p>\n<p>\u00a0<\/p>\n<p>NYPD documents, recently posted on the department\u2019s website, describe an encounter in which P.C, the initials by which the man was identified, was face down, hands cuffed behind his back, for more than seven minutes until an NYPD supervisor showed up and ordered the officers to \u201cSit him up.\u201d<\/p>\n<p>P.C., 27 at the time, was then taken to Bellevue Hospital for treatment.<\/p>\n<p>\u201c[Perez-Ponce\u2019s] actions on the date in question posed a significant risk to P.C\u2019s well-being and could have resulted in more dire consequences,\u201d NYPD Judge Vanessa Facio-Lince wrote in her summary of the case.<\/p>\n<p>It took more than five years to adjudicate the case, in part because of COVID delays.<\/p>\n<p>The incident, in Chinatown on Feb. 11, 2020, happened six years after <a href=\"https:\/\/www.nydailynews.com\/2020\/06\/19\/i-cant-breathe-a-plea-that-resonates-in-policing-reform-and-vigilance-against-the-coronavirus\/\" rel=\"nofollow noopener\" target=\"_blank\">Eric Garner\u2019s similar plea of \u201cI can\u2019t breathe\u201d<\/a> as he was arrested by Staten Island NYPD cops became a rallying cry for social justice activists in the wake of his death.<\/p>\n<p>And just three months after the 2020 Chinatown incident, George Floyd was murdered by a Minnesota cop who pressed his knee into Floyd\u2019s neck for more than nine minutes.<\/p>\n<p>The <a href=\"https:\/\/www.nydailynews.com\/2023\/05\/25\/a-timeline-of-george-floyds-death-and-the-aftermath\/\" rel=\"nofollow noopener\" target=\"_blank\">Floyd murder<\/a> lead to a New York City <a href=\"https:\/\/www.nydailynews.com\/2022\/05\/19\/nyc-diaphragm-law-barring-nypd-use-of-chokeholds-is-reinstated-by-state-appeals-court\/\" rel=\"nofollow noopener\" target=\"_blank\">law<\/a> making it a crime to compress a suspect\u2019s diaphragm.<\/p>\n<p>According to the documents in P.C.\u2019s case, the officers were first called to a drug treatment center on Essex St., where a staffer told them P.C. was having a mental health episode and talking about killing himself.<\/p>\n<p>P.C. had already left the location but the officers got his description, found him nearby and arranged for him to go to a hospital, as P.C.requested.<\/p>\n<p>But he apparently wasn\u2019t at the hospital for long, with Perez-Ponce and Mejia about three hours later being called to Division St. near Canal St. by a woman who said there was a shirtless man swinging\u00a0 a stick or pipe.<\/p>\n<p>It was P.C., who ran when the officers approached.<\/p>\n<p>They chased him, took him to the ground and handcuffed him, his hands behind his back as he lay on the ground, the judge wrote.<\/p>\n<p>The officers, she said, held him \u201cdown on the ground with their hands and knees while they called for an ambulance and backup.\u201d<\/p>\n<p>When a lieutenant arrived he had Perez-Ponce and Mejia lift P.C. into a sitting position.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"lazyautosizes lazyload\" alt=\"NYPD Commissioner Jessica Tisch is pictured in Brooklyn on Thursday, Oct. 23, 2025. (Theodore Parisienne \/ New York Daily News)\" width=\"4228\" height=\"419\" data- src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/12\/TNY-P99-20251023-104422.jpg\" data-attachment-id=\"8568337\" \/>NYPD Commissioner Jessica Tisch (Theodore Parisienne \/ New York Daily News)<\/p>\n<p>The evidence presented at trial includes the partners\u2019 body-worn camera videos, plus other videos.<\/p>\n<p>P.C., who urged bystanders to record what was happening, did not resist during the encounter or appear to try to escape, the judge noted.<\/p>\n<p>Instead, she wrote, he was clearly worried about his well-being, citing video of the clash.<\/p>\n<p>\u201cP.C. is audibly upset, in that he is crying and grunting at various points during the encounter, but remains still on the ground while in the officers\u2019 custody.\u00a0 [Perez-Ponce] and Officer Mejia\u2019s hands and knees are on P.C.\u2019s back, keeping him pinned to the ground \u2026 At about the one minute mark, P.C. can be heard saying in sum and substance: \u201cI got a bad heart, I got asthma! (Ramsey Orta for New York Daily News)<\/p>\n<p>Perez-Ponce testifited that he kept P.C. on the ground because he was being \u201cvery erratic\u201d and a \u201cflight risk.\u201d<\/p>\n<p>He claimed he wasn\u2019t kneeling on the man\u2019s back but rather \u201ctouching\u201d P.C.\u2019s right shoulder with his knee and that P.C. never \u201cshowed any signs of distress.\u201d<\/p>\n<p>The judge called that claim \u201ca distinction without a diifference,\u201d noting that pressure on either spot \u201cmay result in reducng the subject\u2019s ability to brathe and (are) expressly prohibited by the Patrol Guide.\u201d<\/p>\n<p>The judge agreed with the CCRB that Perez-Ponce was guilty of violating the department\u2019s force guidelines and that he should lose 30 days pay. He did not respond to a request for comment and his lawyer had no comment.<\/p>\n<p style=\"text-align: left\">Mejia, who joined the department in April 2017, resigned in September 2021. The CCRB by then had recommended Mejia also be charged with violating the department\u2019s force guidelines by using a prohibited method of restraint.<\/p>\n<p>Mejia could not be reached for comment.<\/p>\n<p>P.C. told the CCRB he had been hospitalized at various times because he has a mental hearlth issue that causes him to act erratically.
